A BILL

To limit the number of H1-B nonimmigrant visas issued in any fiscal year.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the `High-tech Work Fairness and Economic Stimulus Act of 2001'.

SEC. 2. LIMITATION ON H1-B NONIMMIGRANT VISAS.

    (a) IN GENERAL- Subject to subsection (b) and notwithstanding any other provision of law, the number of nonimmigrants who may be admitted under section 101(a)(15)(H)(i)(b) of the Immigration and Nationality Act shall not exceed 65,000 in any fiscal year.

    (b) REDUCTION IN NUMBER BASED ON UNEMPLOYMENT RATE- The number under subsection (a) shall be reduced by 10,000 for each quarter percentage point by which the unemployment rate for the United States exceeds 6 percent, as reported by the Department of Commerce for the latest 12-month period preceding the beginning of the fiscal year for which the number under subsection (a) is to be adjusted.
