<official-title>To prohibit the misappropriation of databases while ensuring consumer access to factual information.</official-title>

<section id="HB8DE72E0FF6D4AF9BB239F4504EEB560" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text> </section> 
<section id="H1D6D2200597A418CA05E3183F9224FE4"><enum>2.</enum><header>Misappropriation of a database</header> 
<subsection id="H4746A14C74AE41278FCDE4C1A71CEB8F"><enum>(a)</enum><header>Misappropriation prohibited</header><text>The misappropriation of a database is an unfair method of competition and an unfair or deceptive act or practice in commerce under section 5(a)(1) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(a)(1)</external-xref>).</text></subsection> 
<subsection id="HF7BF70E351504C93BD0072DE4115A5B9"><enum>(b)</enum><header>Definition</header><text>For purposes of subsection (a), the term <term>misappropriation of a database</term> means that— </text> 
<paragraph id="H1E8E5B5527984B6B8056B55192D389B"><enum>(1)</enum><text>a person (referred to in this section as the <quote>first person</quote>) generates or collects the information in the database at some cost or expense;</text></paragraph> 
<paragraph id="H84253D3CEB784EFE8F88569945A9BB41"><enum>(2)</enum><text>the value of the information is highly time-sensitive;</text></paragraph> 
<paragraph id="HFFD8CD598AC24CD09EC721D3346FE3F4"><enum>(3)</enum><text>another person’s (referred to in this section as the <quote>other person</quote>) use of the information constitutes free-riding on the first person’s costly efforts to generate or collect it;</text></paragraph> 
<paragraph id="H895B18A80F8341538E7BD961B6D92DE"><enum>(4)</enum><text>the other person’s use of the information is in direct competition with a product or service offered by the first person; and</text></paragraph> 
<paragraph id="H445E54F86C2349F100A7C00F384131F"><enum>(5)</enum><text>the ability of other parties to free-ride on the efforts of the first person would so reduce the incentive to produce the product or service that its existence or quality would be substantially threatened.</text></paragraph></subsection></section> 
<section id="H7AF0D35867F54004A93CA8D19E7BE302"><enum>3.</enum><header>Limitation on liability of certain entities</header> 
<subsection id="H58D76F6CC4D847CF8D7CF783250568B8"><enum>(a)</enum><header>Limitation on liability</header><text>No provider of an interactive computer service shall be liable under section 2 for making available information that is provided by another information content provider.</text></subsection> 
<subsection id="H42AF32728F7541B4A1EDC555FDB891FF"><enum>(b)</enum><header>Definitions</header><text>In this section, the terms <term>interactive computer service</term> and <term>information content provider</term> have the meaning given to those terms in section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>).</text></subsection> 
<subsection id="HAA521706F47F423DB1B429A0BFA0B7FB"><enum>(c)</enum><header>Construction</header><text>For purposes of section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>), the provisions of this Act shall not be construed to be a law pertaining to intellectual property.</text></subsection></section> 
<section id="HD901F55889874EC9B1C89E658D6E00AA"><enum>4.</enum><header>Remedies</header> 
<subsection id="HC6FEB8BC307A472EABBCBCBFEABAA1AB"><enum>(a)</enum><header>Treatment of violations as rule violations</header><text>A misappropriation of a database under section 2 shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></subsection> 
<subsection id="HB8131CE608FA4B83AF4B5B32BF5208B5"><enum>(b)</enum><header>FTC authority</header><text>The Federal Trade Commission shall enforce this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></subsection></section> 
<section id="H1E055ABD41F44592BE819866FBEF5000"><enum>5.</enum><header>Exclusions</header><text display-inline="no-display-inline"> Nothing in this Act shall—</text> 
<paragraph display-inline="no-display-inline" id="HF505A7AC239B4BEE8245FD2EFE7C56CB"><enum>(1)</enum><text>affect the operation of the Securities Act of 1933 (<external-xref legal-doc="usc" parsable-cite="usc/15/78a">15 U.S.C. 78a et seq.</external-xref>), the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78a">15 U.S.C. 78a et seq.</external-xref>), the Trust Indenture Act of 1939 (<external-xref legal-doc="usc" parsable-cite="usc/15/77aaa">15 U.S.C. 77aaa et seq.</external-xref>), the Investment Company Act of 1940 (<external-xref legal-doc="usc" parsable-cite="usc/15/80a-1">15 U.S.C. 80a–1 et seq.</external-xref>), the Investment Advisers Act of 1940 (<external-xref legal-doc="usc" parsable-cite="usc/15/80b">15 U.S.C. 80b et seq.</external-xref>), the Securities Investor Protection Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/15/78aaa">15 U.S.C. 78aaa et seq.</external-xref>), or the rules and regulations thereunder;</text></paragraph> 
<paragraph id="H79C77ADF4EFC4E6490BFCBE5CCAE8E7D"><enum>(2)</enum><text>affect the authority of the Securities and Exchange Commission; or</text></paragraph> 
<paragraph id="H6284F49C528B44D0A3B2D8D4F5E8236E"><enum>(3)</enum><text>apply to information with respect to quotations for, or indications, orders, or transactions in, securities.</text></paragraph></section>
