<official-title>To amend the Fair Debt Collection Practices Act to exempt mortgage servicers from certain requirements of the Act with respect to federally related mortgage loans secured by a first lien, and for other purposes.</official-title>

<section section-type="section-one" id="H0C4318196F504A7D00B2999BC465E9D5" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mortgage Servicing Clarification Act</short-title></quote>. </text></section>
<section id="H87708BDE0FE0402DA739A685C89FF8B2"><enum>2.</enum><header>Mortgage servicing clarification</header>
<subsection id="H1D453AB548174B8289C6894FB600FD16"><enum>(a)</enum><header>In general</header><text>The Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692">15 U.S.C. 1692 et seq.</external-xref>) is amended—</text>
<paragraph id="HB07FD727F8EE478A82588D731274033E"><enum>(1)</enum><text>by redesignating section 818 as section 819; and</text></paragraph>
<paragraph id="H9CF59C7CCA8E4805AA1CB828B0CBF88F"><enum>(2)</enum><text>by inserting after section 817 the following new section:</text>

<section id="H63EF4BA286F14A3EBC003C5127CA97E5"><enum>818.</enum><header>Mortgage servicer exemption</header>
<subsection id="HAB923E1A65F54D6B8441DD49BD6008C"><enum>(a)</enum><header>Exemption</header><text>A covered mortgage servicer who, whether by assignment, sale or transfer, becomes the person responsible for servicing federally related mortgage loans secured by first liens that include loans that were in default at the time such person became responsible for the servicing of such federally related mortgage loans shall be exempt from the requirements of section 807(11) in connection with the collection of any debt arising from such defaulted federally related mortgage loans.</text></subsection>
<subsection id="H1CA1CD6F7972441AA75012267D655620"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section, the following definitions shall apply:</text>
<paragraph id="H429DC3DF8FAD4C61B006EDA97FAAAF00"><enum>(1)</enum><header>Covered mortgage servicer</header><text>The term <term>covered mortgage servicer</term> means any servicer of federally related mortgage loans secured by first liens—</text>
<subparagraph id="H9943F7548CC64A6A83905D1BDED23BD4"><enum>(A)</enum><text>who is also debt collector; and</text></subparagraph>
<subparagraph id="H69CB2E4CFD6A4FD988F2D613A5079355"><enum>(B)</enum><text>for whom the collection of delinquent debts is incidental to the servicer’s primary function of servicing current federally related mortgage loans.</text></subparagraph></paragraph>
<paragraph id="HBA3982079FDE46BD9726A54845899879"><enum>(2)</enum><header>Federally related mortgage loan</header><text>The term <term>federally related mortgage loan</term> has the meaning given to such term in section 3(1) of the Real Estate Settlement Procedures Act of 1974, except that, for purposes of this section, such term includes only loans secured by first liens.</text></paragraph>
<paragraph id="H29B7DD24BCE640C4BF00B2B36695053E"><enum>(3)</enum><header>Person</header><text>The term <term>person</term> has the meaning given to such term in section 3(5) of the Real Estate Settlement Procedures Act of 1974.</text></paragraph>
<paragraph id="H492CE20B21034130A522DDF3F92F2160"><enum>(4)</enum><header>Servicer; servicing</header><text>The terms <term>servicer</term> and <term>servicing</term> have the meanings given to such terms in section 6(i) of the Real Estate Settlement Procedures Act of 1974.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HB5019982DF9A47508B4E80DBB728A2CA"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692">15 U.S.C. 1692 et seq.</external-xref>) is amended—</text>
<paragraph id="H44508946C16E44CCB9968D2CEB9E155D"><enum>(1)</enum><text>by redesignating the item relating to section 818 as section 819; and</text></paragraph>
<paragraph id="HB6FF20C2B53A41829B79EE291BEB42F"><enum>(2)</enum><text>by inserting after the item relating to section 817 the following new item:</text>
