<official-title>To amend the Animal Health Protection Act to require the establishment of an electronic nationwide livestock identification system, to prevent the unauthorized release of information collected under the system, to promote an objective review of Department of Agriculture responses to livestock disease outbreaks, and for other purposes.</official-title>

<section section-type="section-one" id="H34FF850D651D4F248426D64FA9C3D606" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Farm Animal Identification and Records Act</short-title></quote>.</text></section> 
<section id="HCCC28CC190214338AC4F7C9C884F5893"><enum>2.</enum><header>Nationwide livestock identification system</header><text display-inline="no-display-inline">The Animal Health Protection Act is amended by inserting after section 10409 (<external-xref legal-doc="usc" parsable-cite="usc/7/8308">7 U.S.C. 8308</external-xref>) the following new section:</text>

<section id="H64E4F63877404125B5002F5900C29EC"><enum>10409A.</enum><header>Nationwide livestock identification system</header> 
<subsection id="H87C3A098BB5D41A29E654DE804DF333D"><enum>(a)</enum><header>System required</header><text>Not later than 90 days after the date of the enactment of the <short-title>National Farm Animal Identification and Records Act</short-title>, the Secretary shall establish an electronic nationwide livestock identification system to require the identification of livestock to enhance the speed and accuracy of the response of the Department of Agriculture to outbreaks of disease in livestock. Because livestock diseases are not constrained by State boundaries, the livestock identification system shall apply to all livestock born in the United States or imported and cover the movement of livestock in both interstate commerce and intrastate commerce. </text></subsection> 
<subsection id="H3194925749614024B389687E30C1F108"><enum>(b)</enum><header>Capabilities</header><text>The livestock identification system shall be capable of tracing, within 48 hours, livestock from birth to slaughter.</text></subsection> 
<subsection id="H486841BA94DF4379BD139B72865B5E41"><enum>(c)</enum><header>Participation by States</header><text>The Secretary shall use the authority provided by section 10411(a) to cooperate with States to secure information for inclusion in the livestock identification system. Subject to subsection (f), the Secretary shall provide States with access to the livestock identification system.</text></subsection> 
<subsection id="HE7ECB620189F4FA4A398CC38B92D1BD6"><enum>(d)</enum><header>Use of existing technology</header><text>The Secretary may use technology developed by private entities before the date of the enactment of the <short-title>National Farm Animal Identification and Records Act</short-title> to operate the livestock identification system.</text></subsection> 
<subsection id="H99F491E4605D4C9DBE14B080357FD4B7"><enum>(e)</enum><header>Financial assistance</header><text>To the extent funds are made available pursuant to subsection (g) to carry out this subsection, the Secretary shall provide financial assistance to producers to assist the producers in complying with the requirements of the livestock identification system. In providing such assistance, the Secretary shall ensure that producers with smaller livestock operations are not placed at a financial disadvantage in complying with such requirements.</text></subsection> 
<subsection id="HB4072AC5570943F5B21EAA39D5E9D4C9"><enum>(f)</enum><header>Release of animal identification numbering information</header> 
<paragraph id="HF3FC25D914B94DD0B6E7167D5037F456"><enum>(1)</enum><header>Freedom of information act</header><text>Information obtained through the livestock identification system is exempt from disclosure under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code.</text></paragraph> 
<paragraph id="HD4B8F5D888354272AD49674D315F8700"><enum>(2)</enum><header>Character of livestock identification system information</header><text>Except as provided in paragraphs (3) and (4), information obtained through the livestock identification system—</text> 
<subparagraph id="H27D86211E0B84D17A670BA51FF19CDB"><enum>(A)</enum><text>may not be released;</text></subparagraph> 
<subparagraph id="HFC1560FAB94D44BBB0D77BB13CE65CD7"><enum>(B)</enum><text>shall not be considered information in the public domain; and</text></subparagraph> 
<subparagraph id="HE873F399021F414C992018AB2E439994"><enum>(C)</enum><text>shall be considered commercial information that is privileged and confidential.</text></subparagraph></paragraph> 
<paragraph id="HCCF3B058359B43C39EE5FBB1D00C13C"><enum>(3)</enum><header>Limited release of information authorized</header><text>Notwithstanding paragraph (2), the Secretary may release information obtained through the livestock identification system regarding particular livestock if—</text> 
<subparagraph id="H1BCFFFD3293C4628ACE7562BD0A165A5"><enum>(A)</enum><text>the information involves livestock threatened by disease or pest;</text></subparagraph> 
<subparagraph id="HB236B99333844D48B922E538A6B86427"><enum>(B)</enum><text> the release of the information is related to actions the Secretary may take under this subtitle; and</text></subparagraph> 
<subparagraph id="H5F97FB83396F4437849FA31D2885FD8F"><enum>(C)</enum><text>the person obtaining the information needs the information for reasons consistent with the public health and public safety purposes of the livestock identification system, as determined by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="HA7E8A14E9A1F44408209CFABFF55DC4E"><enum>(4)</enum><header>Limited release of information required</header><text>Notwithstanding paragraph (2), the Secretary shall release information obtained through the livestock identification system regarding particular livestock—</text> 
<subparagraph id="H8BB48CC17FF14AAD86BF3402A2528FD6"><enum>(A)</enum><text>to the person who owns or controls the livestock, if the person requests such information;</text></subparagraph> 
<subparagraph id="H9EF79AEA3BA14071B2BF21F515E691B9"><enum>(B)</enum><text> to the Attorney General for the purpose of law enforcement; </text></subparagraph> 
<subparagraph id="HF53A8AC2701F4C2A95B239D426EED22E"><enum>(C)</enum><text> to the Secretary of Homeland Security for the purpose of national security; </text></subparagraph> 
<subparagraph id="HD5808DD8146746ED837C3849D996E938"><enum>(D)</enum><text> to a court of competent jurisdiction; and </text></subparagraph> 
<subparagraph id="HE8B0460431914D0C971D62E83564DBA6"><enum>(E)</enum><text>to the government of a foreign country, if release of the information is necessary to trace livestock threatened by disease or pest, as determined by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="H9EF0E7EC6A7B46DBA96B3E495664B1A9"><enum>(5)</enum><header>Conflict of law</header><text>If the information disclosure limitations or requirements of this subsection conflict with information disclosure limitations or requirements of a State law—</text> 
<subparagraph id="HE38A6539D97E427EA5B3DEF15B9BE18B"><enum>(A)</enum><text> this subsection shall take precedence over the State law, if the conflict involves interstate or international commerce; and</text></subparagraph> 
<subparagraph id="H5997685927364B67811CD43B63AB3B34"><enum>(B)</enum><text>the State law shall take precedence over this subsection, if the conflict involves intrastate commerce in that State.</text></subparagraph></paragraph></subsection> 
<subsection id="HAA4CB613A9BB4B6A868254D67CB16B24"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary $175,000,000 to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H257854411BFA438EA11066E0221B6440"><enum>3.</enum><header>Review of Department of Agriculture responses to outbreaks of disease in livestock</header><text display-inline="no-display-inline">Section 10411 of the Animal Health Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/8310">7 U.S.C. 8310</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H3AA82054BE1B4E84AAF05324009F768E"><enum>(f)</enum><header>Review of responses to outbreaks of disease</header><text>The Secretary may appoint an international panel of scientific experts to provide an objective review of a response by the Department of Agriculture to an outbreak of disease in livestock and to identify areas for improvements in such responses.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
