<official-title display="yes">To amend the Revised Statutes of the United States to prevent the use of the legal system in a manner that extorts money from State and local governments, and the Federal Government, and inhibits such governments’ constitutional actions under the first, tenth, and fourteenth amendments.</official-title>

<section id="H6D7728C81BEB4029AAE0A8B1F9FF6284" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans’ Memorials, Boy Scouts, Public Seals, and Other Public Expressions of Religion Protection Act of 2006</short-title></quote>.</text></section> 
<section id="HD4FC37F884D0426EAB18A922538400D5"><enum>2.</enum><header>Limitations on certain lawsuits against State and local officials</header> 
<subsection id="H7BA7707B5393496191F5AB9BA09E16E6"><enum>(a)</enum><header>Civil action for deprivation of rights</header><text>Section 1979 of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/42/1983">42 U.S.C. 1983</external-xref>) is amended—</text> 
<paragraph id="H3877D59C1F934623B708343E41E8E477"><enum>(1)</enum><text>by inserting <quote>(a)</quote> before the first sentence; and</text></paragraph> 
<paragraph id="H8A6F4AB89D2D4A5E8F63396C25AE2228"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="HEEFB186C1D914D8785FF387820DA759E"><enum>(b)</enum><text display-inline="yes-display-inline">The remedies with respect to a claim under this section are limited to injunctive and declaratory relief where the deprivation consists of a violation of a prohibition in the Constitution against the establishment of religion, including, but not limited to, a violation resulting from—</text> 
<paragraph id="HAE5B994A36A44631A6B3EE4B387105CA"><enum>(1)</enum><text display-inline="yes-display-inline">a veterans’ memorial’s containing religious words or imagery;</text></paragraph> 
<paragraph id="H7CA093B4F9474045913720F5BA79B72C"><enum>(2)</enum><text display-inline="yes-display-inline">a public building’s containing religious words or imagery;</text></paragraph> 
<paragraph id="H2B576682C69A4D4AA5FDFDE388F879D"><enum>(3)</enum><text display-inline="yes-display-inline">the presence of religious words or imagery in the official seals of the several States and the political subdivisions thereof; or</text></paragraph> 
<paragraph id="H0DC9E9DEA6D6436B92BD9283834972FA"><enum>(4)</enum><text display-inline="yes-display-inline">the chartering of Boy Scout units by components of States and political subdivisions, and the Boy Scouts’ using public buildings of States and political subdivisions.</text></paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HF00FB19756D646AEB7D73D04C3257FB1"><enum>(b)</enum><header>Attorney’s fees</header><text>Section 722(b) of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/42/1988">42 U.S.C. 1988(b)</external-xref>) is amended by adding at the end the following: <quote>However, no fees shall be awarded under this subsection with respect to a claim described in subsection (b) of section nineteen hundred and seventy nine.</quote>.</text></subsection></section> 
<section id="H561CFFE3B85D4115A0521CA627758237"><enum>3.</enum><header>Limitations on certain lawsuits against the United States and federal officials</header> 
<subsection id="H8010BBFD1E3E464DBE85C8D08D7286BA"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, a court shall not award reasonable fees and expenses of attorneys to the prevailing party on a claim of injury consisting of the violation of a prohibition in the Constitution against the establishment of religion brought against the United States or any agency or any official of the United States acting in his or her official capacity in any court having jurisdiction over such claim, and the remedies with respect to such a claim shall be limited to injunctive and declaratory relief.</text></subsection> 
<subsection id="HA61D36CD3E664733B0385B3302EE4051"><enum>(b)</enum><header>Definition</header><text>As used in this section, the term <quote>a claim of injury consisting of the violation of a prohibition in the Constitution against the establishment of religion</quote> includes, but is not limited to, a claim of injury resulting from—</text> 
<paragraph id="H53EE205B6DB44A91A4F6A628E4B9FD2B" commented="no"><enum>(1)</enum><text>a veterans’ memorial’s containing religious words or imagery;</text></paragraph> 
<paragraph id="HD3E4ABE27B0D4A00831693A06E3B3221" commented="no"><enum>(2)</enum><text>a Federal building’s containing religious words or imagery;</text></paragraph> 
<paragraph id="H8297D885D631421E8DC3F94E0892F416"><enum>(3)</enum><text>the presence of religious words or imagery in the official seal of the United States and in its currency and official Pledge; or</text></paragraph> 
<paragraph id="HFC256432A88B457E89888C7EB8825204"><enum>(4)</enum><text>the chartering of Boy Scout units by components of the Armed Forces of the United States and by other public entities, and the Boy Scouts’ using Department of Defense and other public installations.</text></paragraph></subsection></section> 
<section id="H096B86E1CC1C4DFB00935EE7E5AB71B4"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act take effect on the date of the enactment of this Act and apply to any case that—</text> 
<paragraph id="H6530467C64E2450F9B98FA9715DF08BC"><enum>(1)</enum><text>is pending on such date of enactment; or</text></paragraph> 
<paragraph id="HF29175A80D51461C89CAB4EAF35E1C90"><enum>(2)</enum><text>is commenced on or after such date of enactment.</text></paragraph></section>
