<legis-type>A BILL</legis-type> 
<official-title>To amend the Revised Statutes of the United States to eliminate the chilling effect on the constitutionally protected expression of religion by State and local officials that results from the threat that potential litigants may seek damages and attorney’s fees.</official-title>

<section id="H3DB6A51C56E04CA4B1CEB879A938F97" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Expression of Religion Act of 2005</short-title></quote>.</text> </section> 
<section id="H213A91A3AE0948028691DDB58540D968"><enum>2.</enum><header>Limitations on certain lawsuits against State and local officials</header> 
<subsection id="H5BEF6BC192E848BDB9A4C83D14FFCBFD"><enum>(a)</enum><header>Civil action for deprivation of rights</header><text>Section 1979 of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/42/1983">42 U.S.C. 1983</external-xref>) is amended—</text> 
<paragraph id="H9F82EE876F9A43B687F7462852C52EFD"><enum>(1)</enum><text>by inserting <quote>(a)</quote> before the first sentence; and</text></paragraph> 
<paragraph id="H3BCF4013821845F5A248F2BAE86BA4EC"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="HAE8867A43383430B9D85FF00AE44364E"> 
<subsection id="H418CBC8295D0492DAFE4DA365283449"><enum>(b)</enum><text>The remedies with respect to a claim under this section where the deprivation consists of a violation of a prohibition in the Constitution against the establishment of religion shall be limited to injunctive relief.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H816A9168826A4C76008D17578232321D"><enum>(b)</enum><header>Attorneys fees</header><text>Section 722(b) of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/42/1988">42 U.S.C. 1988(b)</external-xref>) is amended by adding at the end the following: <quote>However, no fees shall be awarded under this subsection with respect to a claim described in subsection (b) of section nineteen hundred and seventy nine.</quote>.</text></subsection></section>
