<section section-type="section-one" id="H528C3ACE4BBD456700CF1D0031CFF3E6" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Assault Weapons Ban and Law Enforcement Protection Act of 2007</short-title></quote>.</text></section>
<section id="H51BF908A0DA649F4B3EACA5B1F58D2DC" display-inline="no-display-inline"><enum>2.</enum><header>Reinstatement for 10 years of repealed criminal provisions relating to assault weapons and large capacity ammunition feeding devices</header>
<subsection id="HA06005EC5C684D89ADA417772BE8062F"><enum>(a)</enum><header>Reinstatement of provisions wholly repealed</header><text>Paragraphs (30) and (31) of section 921(a), subsections (v) and (w) and Appendix A of section 922, and the last 2 sentences of <external-xref legal-doc="usc" parsable-cite="usc/18/923">section 923(i)</external-xref> of title 18, United States Code, as in effect just before the repeal made by section 110105(2) of the <act-name parsable-cite="VCCLEA94">Violent Crime Control and Law Enforcement Act of 1994</act-name>, are hereby enacted into law.</text></subsection>
<subsection id="HDAAF5933471B413B90AD3E2576C43EB3"><enum>(b)</enum><header>Reinstatement of provisions partially repealed</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/924">Section 924</external-xref> of title 18, United States Code, is amended—</text>
<paragraph id="H6605E33E669B49AE00C22249FDCD7C4F"><enum>(1)</enum><text>in subsection (a)(1), by striking subparagraph (B) and inserting the following:</text>
<quoted-block id="HBA650A2DFB0A47C48186FAE44DADDCB1">
<subparagraph indent="up1" id="HE235460CC8004C1898B081283B1E62F"><enum>(B)</enum><text>knowingly violates subsection (a)(4), (f), (k), (r), (v), or (w) of section 922;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="H21ED4640B2044E45A544C025C9DA7EB"><enum>(2)</enum><text>in subsection (c)(1)(B), by striking clause (i) and inserting the following:</text>

<clause indent="up2" id="H32310B96A312440ABC02D33CC63D506D"><enum>(i)</enum><text>is a short-barreled rifle, short-barreled shotgun, or semiautomatic assault weapon, the person shall be sentenced to a term of imprisonment of not less than 10 years; or</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
<section id="HA0416960B3604C028BFC78FDA191455C"><enum>3.</enum><header>Definitions</header>
<subsection id="HD83804AE9CF3448DB8B2B8A6AC5CC0C3"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/921">Section 921(a)(30)</external-xref> of title 18, United States Code, as added by section 2(a) of this Act, is amended to read as follows:</text>

<paragraph indent="up1" id="HF337FE52830C4D5FB54217BEFE9F9508"><enum>(30)</enum><text>The term <term>semiautomatic assault weapon</term> means any of the following:</text>
<subparagraph id="H57AE2FAC5CAC4A6DAD2746A007CB3F5"><enum>(A)</enum><text>The following rifles or copies or duplicates thereof:</text>
<clause id="HB3C62552B6F241308FB951739596EB6E"><enum>(i)</enum><text>AK, AKM, AKS, AK–47, AK–74, ARM, MAK90, Misr, NHM 90, NHM 91, SA 85, SA 93, VEPR;</text></clause>
<clause id="H27039E98FA5F4A3DB0E8129BF8EA80EA"><enum>(ii)</enum><text>AR–10;</text></clause>
<clause id="H21C68D5386D8455DA900514EC3B71B85"><enum>(iii)</enum><text>AR–15, Bushmaster XM15, Armalite M15, or Olympic Arms PCR;</text></clause>
<clause id="H7B3D70FE57B74B28BC88A23883A4E852"><enum>(iv)</enum><text>AR70;</text></clause>
<clause id="H588709F8C7474F2E8F782D007F440071"><enum>(v)</enum><text>Calico Liberty;</text></clause>

<subparagraph id="H4D3549879FD6445FB74888467C68C85B"><enum>(D)</enum><text>A semiautomatic rifle that has an ability to accept a detachable magazine, and that has—</text>
<clause id="H69D33BB7F06545A395FD02D6CBA06EEC"><enum>(i)</enum><text>a folding or telescoping stock;</text></clause>
<clause id="H4FD3E23B37B24C09B887B1B06FF26C74"><enum>(ii)</enum><text>a threaded barrel;</text></clause>
<clause id="HC75D583F81604528818FE2130063F14F"><enum>(iii)</enum><text>a pistol grip;</text></clause>
<clause id="H414CE34B5CA4498CAEF1E280F198E895"><enum>(iv)</enum><text>a forward grip; or</text></clause>
<clause id="HDED660FB5A1B4F72BD0185BB44CC1F02"><enum>(v)</enum><text>a barrel shroud.</text></clause></subparagraph>
<subparagraph id="H7C9210E2F53C4BC084FBFD2FA6CA607B"><enum>(E)</enum>
<clause display-inline="yes-display-inline" id="H587829A4B8524793951E9B00A02EC43"><enum>(i)</enum><text>Except as provided in clause (ii), a semiautomatic rifle that has a fixed magazine with the capacity to accept more than 10 rounds.</text></clause>
<clause indent="up1" id="H7349C333E63D4D0D94AEF4A663E48B1E"><enum>(ii)</enum><text>Clause (i) shall not apply to an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.</text></clause></subparagraph>
<subparagraph id="H89EAB44070C94FB2AC9CFB60AA3E6FEB"><enum>(F)</enum><text>A semiautomatic pistol that has the ability to accept a detachable magazine, and has—</text>
<clause id="H89519AC180AC4A96BA03ABA3AA865DAA"><enum>(i)</enum><text>a second pistol grip;</text></clause>
<clause id="H14A922E46B9D431EB2A43E6386470088"><enum>(ii)</enum><text>a threaded barrel;</text></clause>
<clause id="H8785AF37348D4FBEB7EAB43913334D3B"><enum>(iii)</enum><text>a barrel shroud; or</text></clause>
<clause id="H7E2D172B56D7404F86F602910118FFCD"><enum>(iv)</enum><text>the capacity to accept a detachable magazine at a location outside of the pistol grip.</text></clause></subparagraph>
<subparagraph id="H7405B5AFDE2849959E03DE6964573F7D"><enum>(G)</enum><text>A semiautomatic pistol with a fixed magazine that has the capacity to accept more than 10 rounds.</text></subparagraph>
<subparagraph id="H10B9A24FB35541B5ADF5AAEB7DA23BF"><enum>(H)</enum><text>A semiautomatic shotgun that has—</text>
<clause id="H5C932598714B4DA9A800E9A593C2264F"><enum>(i)</enum><text>a folding or telescoping stock;</text></clause>
<clause id="H2222A25E087242F8ADF046588344E04C"><enum>(ii)</enum><text>a pistol grip;</text></clause>
<clause id="H03F87EDAD63F43F5AC56965B6634F229"><enum>(iii)</enum><text>the ability to accept a detachable magazine; or</text></clause>
<clause id="H0ED56153DBB74152B451C7D45BDCA0B5"><enum>(iv)</enum><text>a fixed magazine capacity of more than 5 rounds.</text>
<subclause indent="up2" id="H4380B93822234BE79FEFC84B18B3BFB"><enum>(I)</enum><text>A shotgun with a revolving cylinder.</text></subclause></clause></subparagraph>
<subparagraph id="H7D0ED517DC3C411CB31533BDB5CA7455"><enum>(J)</enum><text>A frame or receiver that is identical to, or based substantially on the frame or receiver of, a firearm described in any of subparagraphs (A) through (I) or (L).</text></subparagraph>
<subparagraph id="H151A2F7A65B64C30A6A91C15F45DB4CF"><enum>(K)</enum><text>A conversion kit.</text></subparagraph>
<subparagraph id="H209207728BBD45E7AACD4837EA55BA07"><enum>(L)</enum><text>A semiautomatic rifle or shotgun originally designed for military or law enforcement use, or a firearm based on the design of such a firearm, that is not particularly suitable for sporting purposes, as determined by the Attorney General. In making the determination, there shall be a rebuttable presumption that a firearm procured for use by the United States military or any Federal law enforcement agency is not particularly suitable for sporting purposes, and a firearm shall not be determined to be particularly suitable for sporting purposes solely because the firearm is suitable for use in a sporting event.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HB93F6E47BEA44280ABA5AEF4A1BF363"><enum>(b)</enum><header>Related definitions</header><text>Section 921(a) of such title is amended by adding at the end the following:</text>

<paragraph indent="up1" id="H43DB35A866BA4723A263CCECA564D2E1"><enum>(36)</enum><header>Barrel shroud</header><text>The term <term>barrel shroud</term> means a shroud that is attached to, or partially or completely encircles, the barrel of a firearm so that the shroud protects the user of the firearm from heat generated by the barrel, but does not include a slide that encloses the barrel, and does not include an extension of the stock along the bottom of the barrel which does not encircle or substantially encircle the barrel.</text></paragraph>
<paragraph indent="up1" id="H3CD206FF8620494684D7E9C4BBA3689"><enum>(37)</enum><header>Conversion kit</header><text>The term <term>conversion kit</term> means any part or combination of parts designed and intended for use in converting a firearm into a semiautomatic assault weapon, and any combination of parts from which a semiautomatic assault weapon can be assembled if the parts are in the possession or under the control of a person.</text></paragraph>
<paragraph indent="up1" id="H71950362649E47FBBF0000E38716BDB1"><enum>(38)</enum><header>Detachable magazine</header><text>The term <term>detachable magazine</term> means an ammunition feeding device that can readily be inserted into a firearm.</text></paragraph>
<paragraph indent="up1" id="H2ECCC7CB9B574EEB80137BD55831C1F"><enum>(39)</enum><header>Fixed magazine</header><text>The term <term>fixed magazine</term> means an ammunition feeding device contained in, or permanently attached to, a firearm.</text></paragraph>
<paragraph indent="up1" id="HC9B164628A144B9DA2CAA4001BEDB550"><enum>(40)</enum><header>Folding or telescoping stock</header><text>The term <term>folding or telescoping stock</term> means a stock that folds, telescopes, or otherwise operates to reduce the length, size, or any other dimension, or otherwise enhances the concealability, of a firearm.</text></paragraph>
<paragraph indent="up1" id="HA39F6D0836C64880AE18FD51CE03D679"><enum>(41)</enum><header>Forward grip</header><text>The term <term>forward grip</term> means a grip located forward of the trigger that functions as a pistol grip.</text></paragraph>
<paragraph indent="up1" id="H0B8FB42EAE064F23B37FD0FB3D15A3E9"><enum>(42)</enum><header>Pistol grip</header><text>The term <term>pistol grip</term> means a grip, a thumbhole stock, or any other characteristic that can function as a grip.</text></paragraph>
<paragraph indent="up1" id="H5E3B9C11D3734618B300A5A22C2407BE"><enum>(43)</enum><header>Threaded barrel</header><text>The term <term>threaded barrel</term> means a feature or characteristic that is designed in such a manner to allow for the attachment of a firearm as defined in section 5845(a) of the <act-name parsable-cite="NFA">National Firearms Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/26/5845">26 U.S.C. 5845(a)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="H86C45DDC08B44ED29952589BF5F4DE80"><enum>4.</enum><header>Grandfather provision</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/922">Section 922(v)(2)</external-xref> of title 18, United States Code, as added by section 2(a) of this Act, is amended—</text>
<paragraph id="HAAC5DDB85DE44B56A14E71C66DBB00EC"><enum>(1)</enum><text>by inserting <quote>(A)</quote> after <quote>(2)</quote>; and</text></paragraph>
<paragraph id="HB901AB41116E46D7977421B1B6773E8C"><enum>(2)</enum><text>by adding after and below the end the following:</text>
<quoted-block id="HD59DEB4973F34E3D83E0869C00C7F6A7">
<subparagraph indent="up2" id="HBB63876993E54C90A504B3F85B78A500"><enum>(B)</enum><text>Paragraph (1) shall not apply to any firearm the possession or transfer of which would (but for this subparagraph) be unlawful by reason of this subsection, and which is otherwise lawfully possessed on the date of the enactment of this subparagraph.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="HABC12C49B739446FA2A700F0E10ABCC"><enum>5.</enum><header>Repeal of certain exemptions</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/922">Section 922(v)(3)</external-xref> of title 18, United States Code, as added by section 2(a) of this Act, is amended by striking <quote>(3)</quote> and all that follows through the 1st sentence and inserting the following:</text>

<paragraph indent="up1" id="H12DE5E11EB674381802CB450191EB510"><enum>(3)</enum><text>Paragraph (1) shall not apply to any firearm that—</text>
<subparagraph id="H0786A714D5534264B878DDADA4CD0695"><enum>(A)</enum><text>is manually operated by bolt, pump, level, or slide action;</text></subparagraph>
<subparagraph id="H170C8D717B1D41BF93E398CAE3C3B1D"><enum>(B)</enum><text>has been rendered permanently inoperable; or</text></subparagraph>
<subparagraph id="H412D978F56154DBA94F4B23E18CF008E"><enum>(C)</enum><text>is an antique firearm.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H6BEFE031CF80435E93DDE056599CF32F"><enum>6.</enum><header>Requiring background checks for the transfer of lawfully possessed semiautomatic assault weapons</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/922">Section 922(v)</external-xref> of title 18, United States Code, as added by section 2(a) of this Act, is amended by adding at the end the following:</text>
<quoted-block id="H4FB782D4056D48E7B19EC453007F4FDA">
<paragraph indent="up1" id="HC9D2008300A945EDB6A53CED2F32E9E3"><enum>(5)</enum><text>It shall be unlawful for any person to transfer a semiautomatic assault weapon to which paragraph (1) does not apply, except through—</text>
<subparagraph id="H87C0486D9CD04FBD82CDFDBCB300772D"><enum>(A)</enum><text>a licensed dealer, and for purposes of subsection (t) in the case of such a transfer, the weapon shall be considered to be transferred from the business inventory of the licensed dealer and the dealer shall be considered to be the transferor; or</text></subparagraph>
<subparagraph id="H0646AD606C2A4BE89264AD09262D5540"><enum>(B)</enum><text>a State or local law enforcement agency if the transfer is made in accordance with the procedures provided for in subsection (t) of this section and section 923(g).</text></subparagraph></paragraph>
<paragraph indent="up1" id="H0513DA5B0F524B009CE5613E56CAB7A6"><enum>(6)</enum><text>The Attorney General shall establish and maintain, in a timely manner, a record of the make, model, and date of manufacture of any semiautomatic assault weapon which the Attorney General is made aware has been used in relation to a crime under Federal or State law, and the nature and circumstances of the crime involved, including the outcome of relevant criminal investigations and proceedings. The Attorney General shall annually submit the record to the Congress and make the record available to the general public.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HE72045FBC388489AB700CFC5009726AD"><enum>7.</enum><header>Strengthening the ban on the possession or transfer of a large capacity ammunition feeding device</header>
<subsection id="H3A1688464E9F4BECBCBF61C76B12BE41"><enum>(a)</enum><header>Ban on transfer of semiautomatic assault weapon with large capacity ammunition feeding device</header>
<paragraph id="HB6F67ECBFA8E4219986200FF1E44BAB"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/922">Section 922</external-xref> of title 18, United States Code, is amended by inserting after subsection (y) the following:</text>

<subsection id="HFDCB4B33572A41BD9216B9A33804B400"><enum>(z)</enum><text>It shall be unlawful for any person to transfer any assault weapon with a large capacity ammunition feeding device.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H3A2E6DF176CF44BB97006E915E050841"><enum>(2)</enum><header>Penalties</header><text>Section 924(a) of such title is amended by adding at the end the following:</text>

<paragraph indent="up1" id="HB42B1024449A4DC08167DDA92B22E39"><enum>(8)</enum><text>Whoever knowingly violates section 922(z) shall be fined under this title, imprisoned not more than 10 years, or both.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HF9E8774427584150B1A28397C1297E9D"><enum>(b)</enum><header>Certification requirement</header>
<paragraph id="H6B674D1513454EED97EB2400D5D3F87C"><enum>(1)</enum><header>In general</header><text>Section 922(w) of such title, as added by section 2(a) of this Act, is amended—</text>
<subparagraph id="H2A79AF6D52734F42834EDEC3D6E000E4"><enum>(A)</enum><text>in paragraph (3)—</text>

<paragraph indent="up1" id="H2597AC1AD4184DDBB5209E13D57C4F53"><enum>(4)</enum><text>It shall be unlawful for a licensed manufacturer, licensed importer, or licensed dealer who transfers a large capacity ammunition feeding device that was manufactured on or before the date of the enactment of this subsection, to fail to certify to the Attorney General before the end of the 60-day period that begins with the date of the transfer, in accordance with regulations prescribed by the Attorney General, that the device was manufactured on or before the date of the enactment of this subsection.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H1822CE07089143A788B446BB7020D964"><enum>(2)</enum><header>Penalties</header><text>Section 924(a) of such title, as amended by subsection (a)(2) of this section, is amended by adding at the end the following:</text>

<paragraph indent="up1" id="HAF9DFF0541FC46DBA7926FABB5EBA09"><enum>(9)</enum><text>Whoever knowingly violates section 922(w)(4) shall be fined under this title, imprisoned not more than 5 years, or both.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
<section id="H16F7A9C64CDE478799E6009DE701D0E5"><enum>8.</enum><header>Unlawful weapons transfers to juveniles</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/922">Section 922(x)</external-xref> of title 18, United States Code, is amended—</text>
<paragraph id="H6F38EE54398F4F0CAC36ED85D045B48F"><enum>(1)</enum><text>in paragraph (1)—</text>
<subparagraph id="H7A492C0D987F4826006EB4E999AAD519"><enum>(A)</enum><text>in subparagraph (B), by striking the period and inserting a semicolon; and</text></subparagraph>
<subparagraph id="H71445CDD552348C0AD0374BEDDBA54DD"><enum>(B)</enum><text>by adding at the end the following:</text>
<quoted-block id="H6DBE2967438C443394F831831F28E2BC">
<subparagraph indent="up1" id="H486D72C5E13748FBB64B15208EC27E7C"><enum>(C)</enum><text>a semiautomatic assault weapon; or</text></subparagraph>
<subparagraph indent="up1" id="HD470D17F1AE64451A9C21C3F3F8B3185"><enum>(D)</enum><text>a large capacity ammunition feeding device.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H9410F8178FA5404EB796432E5301F054"><enum>(2)</enum><text>in paragraph (2)—</text>
<subparagraph id="H7C5F32610C554E9FBA5132B84E301D11"><enum>(A)</enum><text>in subparagraph (B), by striking the period and inserting a semicolon; and</text></subparagraph>
<subparagraph id="H9DA684CA1D7F45059F0031CA767D2B15"><enum>(B)</enum><text>by adding at the end the following:</text>

<section id="H497C1235DBD6405293C3DDE8503FDFF"><enum>9.</enum><header>Ban on importation of large capacity ammunition feeding device</header>
<subsection id="H4405AC2D42734D0EB5C9864C07EBA168"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/922">Section 922(w)</external-xref> of title 18, United States Code, as added by section 2(a) of this Act, is amended—</text>
<paragraph id="H631A51FF79E1444281B9754CFBD69DC5"><enum>(1)</enum><text>in paragraph (1), by striking <quote>(1) Except as provided in paragraph (2)</quote> and inserting <quote>(1)(A) Except as provided in subparagraph (B)</quote>;</text></paragraph>
<paragraph id="HF8A5CCFEC41746C9B5777C4FCDF22C67"><enum>(2)</enum><text>in paragraph (2), by striking <quote>(2) Paragraph (1)</quote> and inserting <quote>(B) Subparagraph (A)</quote>; and</text></paragraph>
<paragraph id="H67704CE0E2B3444DBBD09F1400FD25F"><enum>(3)</enum><text>by inserting before paragraph (3) the following:</text>

<subsection id="H67D1BBBFAD0A4694AA03A70931DC4E42"><enum>(b)</enum><header>Conforming amendment</header><text>Section 921(a)(31)(A) of such title, as added by section 2(a) of this Act, is amended by striking <quote>manufactured after the date of enactment of the <act-name parsable-cite="VCCLEA94">Violent Crime Control and Law Enforcement Act of 1994</act-name></quote>.</text></subsection></section>
