<official-title>To amend the Bank Holding Company Act of 1956 and the Revised Statutes of the United States to prohibit financial holding companies and national banks from engaging, directly or indirectly, in real estate brokerage or real estate management activities, and for other purposes.</official-title>

<section section-type="section-one" id="HF4EE298DAEE9420E870046CF0716B72F" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community Choice in Real Estate Act</short-title></quote>.</text></section> 
<section id="H5FC48B0377DA4A1980E50132F1893F1C"><enum>2.</enum><header>Clarification that real estate brokerage and management activities are not banking or financial activities</header> 
<subsection id="HBDE12A4DF5C24255A96457ECD5006B26"><enum>(a)</enum><header><act-name parsable-cite="BHC65">Bank Holding Company Act of 1956</act-name></header><text>Section 4(k) of the <act-name parsable-cite="BHC65">Bank Holding Company Act of 1956</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1843">12 U.S.C. 1843(k)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H13550530F5E047A7BA57EAAFD76B5576"><enum>(8)</enum><header>Real estate brokerage and real estate management activities</header> 
<subparagraph id="H2E2CE684061F4C249139B9C55EB41E62"><enum>(A)</enum><header>In general</header><text>The Board may not determine that real estate brokerage activity or real estate management activity is an activity that is financial in nature, is incidental to any financial activity, or is complementary to a financial activity.</text></subparagraph> 
<subparagraph id="H19653897F7ED444A9B8B7970DC00C909"><enum>(B)</enum><header>Real estate brokerage activity defined</header><text>For purposes of this paragraph, the term <term>real estate brokerage activity</term> means any activity that involves offering or providing real estate brokerage services to the public, including—</text> 
<clause id="HC8DA536BF4D249A68BFEFC8BB553B415"><enum>(i)</enum><text>acting as an agent for a buyer, seller, lessor, or lessee of real property;</text></clause> 
<clause id="H3BB6BEF8C1294DD7BDE80554D880331D"><enum>(ii)</enum><text>listing or advertising real property for sale, purchase, lease, rental, or exchange;</text></clause> 
<clause id="H0C7C0332BCEF4128B915E1849C319E76"><enum>(iii)</enum><text>providing advice in connection with sale, purchase, lease, rental, or exchange of real property;</text></clause> 
<clause id="H5F8D246405024D0B9F02B415BADA50E6"><enum>(iv)</enum><text>bringing together parties interested in the sale, purchase, lease, rental, or exchange of real property;</text></clause> 
<clause id="H908779C9635A4D879E98FCC7808552A4"><enum>(v)</enum><text>negotiating, on behalf of any party, any portion of a contract relating to the sale, purchase, lease, rental, or exchange of real property (other than in connection with providing financing with respect to any such transaction);</text></clause> 
<clause id="HEEC1C6FEC8574A34BA87002C00A25CB4"><enum>(vi)</enum><text>engaging in any activity for which a person engaged in the activity is required to be registered or licensed as a real estate agent or broker under any applicable law; and</text></clause> 
<clause id="H2C74D23E5CDF4A739EA1A08352DD5508"><enum>(vii)</enum><text>offering to engage in any activity, or act in any capacity, described in clause (i), (ii), (iii), (iv), (v), or (vi).</text></clause></subparagraph> 
<subparagraph id="H19F139B0C82D40978CBB80C1D8383350"><enum>(C)</enum><header>Real estate management activity defined</header><text>For purposes of this paragraph, the term <term>real estate management activity</term> means any activity that involves offering or providing real estate management services to the public, including—</text> 
<clause id="H070B5B1C147A4830A86DB8444E7000E1"><enum>(i)</enum><text>procuring any tenant or lessee for any real property;</text></clause> 
<clause id="H6318D3A85D2D4E13B3417BD9E06C0000"><enum>(ii)</enum><text>negotiating leases of real property;</text></clause> 
<clause id="H74383A3AC9EF4EE5A06288967CC240FC"><enum>(iii)</enum><text>maintaining security deposits on behalf of any tenant or lessor of real property (other than as a depository institution for any person providing real estate management services for any tenant or lessor of real property);</text></clause> 
<clause id="H02A449A646B145AD80D4DF3CC6C5FB8B"><enum>(iv)</enum><text>billing and collecting rental payments with respect to real property or providing periodic accounting for such payments;</text></clause> 
<clause id="H695221ED51FD47DFA88EB37F9C2F5FCB"><enum>(v)</enum><text>making principal, interest, insurance, tax, or utility payments with respect to real property (other than as a depository institution or other financial institution on behalf of, and at the direction of, an account holder at the institution);</text></clause> 
<clause id="H8C4A4CDA7877437A96DF0169838F3EC7"><enum>(vi)</enum><text>overseeing the inspection, maintenance, and upkeep of real property, generally; and</text></clause> 
<clause id="HDBA334972AD044C69F39F8F37EDDF937"><enum>(vii)</enum><text>offering to engage in any activity, or act in any capacity, described in clause (i), (ii), (iii), (iv), (v), or (vi).</text></clause></subparagraph> 
<subparagraph id="H2629541232A744B5A809D2C33BD52273"><enum>(D)</enum><header>Exception for company property</header><text>This paragraph shall not apply to an activity of a bank holding company or any affiliate of such company that directly relates to managing any real property owned by such company or affiliate, or the purchase, sale, or lease of property owned, or to be used or occupied, by such company or affiliate.</text></subparagraph> 
<subparagraph id="HCAFD5496E14C4E9681FE6B2FBF6FAEA2"><enum>(E)</enum><header>Current activities not affected</header><text>No provision of this paragraph, or any determination made pursuant to any such provision, may be construed as prohibiting, restricting, altering, or otherwise affecting, the right, power, or ability of any financial holding company to engage in any activity, or acquire or retain the shares of any company engaged in an activity, if engaging in such activity, or acquiring or retaining such shares, was authorized for financial holding companies on December 6, 2001.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H67E2DBD4F08047FDA89DF72684EE85EB"><enum>(b)</enum><header>Revised Statutes of the United States</header><text>Section 5136A(b) of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/12/24a">12 U.S.C. 24a(b)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HBF90EC3EE44A486F838C2DB9BB3410EB"><enum>(4)</enum><header>Real estate brokerage and real estate management activities</header> 
<subparagraph id="HFA98E661A3CB4F7591EFDFDF53CB5232"><enum>(A)</enum><header>In general</header><text>The Secretary may not determine that real estate brokerage activity or real estate management activity is an activity that is financial in nature, is incidental to any financial activity, or is complementary to a financial activity.</text></subparagraph> 
<subparagraph id="HFBBC0940F70342A00035745EFCC838CF"><enum>(B)</enum><header>Definitions</header><text>For purposes of this paragraph, the terms <term>real estate brokerage activity</term> and <term>real estate management activity</term> have the same meanings as in section 4(k)(8) of the <act-name parsable-cite="BHC65">Bank Holding Company Act of 1956</act-name>.</text></subparagraph> 
<subparagraph id="H2F6A582B3F9F485A849E945F63398378"><enum>(C)</enum><header>Exception for company property</header><text>This paragraph shall not apply to an activity of a national bank, or a subsidiary of a national bank, that directly relates to managing any real property owned by such bank or subsidiary, or the purchase, sale, or lease of property owned, or to be owned, by such bank or subsidiary.</text></subparagraph> 
<subparagraph id="HB7CB9718525E4A5393AAC4E0B5A1DE17"><enum>(D)</enum><header>Current activities not affected</header><text>No provision of this paragraph, or any determination made pursuant to any such provision, may be construed as prohibiting, restricting, altering, or otherwise affecting, the right, power, or ability of any national bank, or a subsidiary of a national bank, to engage in any activity, or acquire or retain the shares of any company engaged in an activity, if engaging in such activity, or acquiring or retaining such shares, was authorized for national banks, or subsidiaries of national banks, on December 6, 2001.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
