<section id="HCBEEE25B76914B0FA05E2552F71E6B33" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Airline Passenger Bill of Rights Act of 2007</short-title></quote>.</text></section> 
<section id="H0D1D3DD5551B451A8E4738F7745DAE14"><enum>2.</enum><header>Air carrier passenger services</header> 
<subsection id="H01BEFD9F671146D2BDD86D595134BAA"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">Chapter 417</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<subchapter id="H948731B1D2FB4B578D86F9F6D5647300"><enum>IV</enum><header>Air carrier passenger services</header> 
<section id="HAE7343E65A9A414DB665006F12B597F0"><enum>41781.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter, the following definitions apply:</text> 
<paragraph id="H2510875777E74B83B000EBABE62E842"><enum>(1)</enum><header>Air transportation</header><text>The term <quote>air transportation</quote> includes intrastate air transportation. </text> </paragraph> 
<paragraph id="H66345D48AA6D4B678D002659BFB17296" commented="no"><enum>(2)</enum><header>Covered air carrier</header><text display-inline="yes-display-inline">The term <quote>covered air carrier</quote> means an air carrier holding a certificate issued under section 41102 that conducts scheduled passenger air transportation.</text></paragraph></section> 
<section id="HD91578807EBB4C6482208548BB600B7"><enum>41782.</enum><header>Standards for air carrier passenger services</header> 
<subsection id="H8DD0E6D411764F6AAEFDFC486242D0DD"><enum>(a)</enum><header>Passenger complaints</header><text>A covered air carrier shall establish and implement procedures for handling complaints from passengers of the air carrier.</text> </subsection> 
<subsection id="H8C02E10F57294EE7B284675B07EE4243"><enum>(b)</enum><header>Diversions, delays, and cancellations</header> 
<paragraph id="HC86324AC04C04AD2A514E0855815005B"><enum>(1)</enum><header>Notification of passengers</header><text>A covered air carrier shall provide customers at an airport and on board an aircraft, in a timely, reasonable, and truthful manner, the best information available to the air carrier regarding a delay, cancellation, or diversion affecting the customers’ flight, including—</text> 
<subparagraph id="H398A4C1F9811479E92E8503EE96CF8B4"><enum>(A)</enum><text>the cause of the delay, cancellation, or diversion; and</text></subparagraph> 
<subparagraph id="H501748D1312744F7AC9F476DC35E00C0"><enum>(B)</enum><text>for a delayed flight, the air carrier’s best estimate of departure time.</text></subparagraph></paragraph> 
<paragraph id="H451172FDB652493CBE15C0017B367E2"><enum>(2)</enum><header>Methods for notification</header><text>In complying with this subsection, a covered air carrier shall use airport overhead announcements, on aircraft announcements, and postings on airport television monitors.</text></paragraph></subsection> 
<subsection id="HA143E847085546949CD100E975E30418"><enum>(c)</enum><header>Departure and arrival delays</header> 
<paragraph id="H10C043E717B14388B8C0A64796433DE7"><enum>(1)</enum><header>Right of passengers to exit an aircraft</header><text>Subject to paragraph (2), a covered air carrier operating an aircraft in a flight in air transportation shall establish and implement procedures to allow passengers to exit the aircraft in the case of a departure or arrival delay which would otherwise require passengers to remain on the aircraft on the ground prior to departure or arrival for a period exceeding 3 hours.</text></paragraph> 
<paragraph id="HBD9551F17BD644EE8D8940D888E8D743"><enum>(2)</enum><header>Exceptions</header> 
<subparagraph id="H2FDF9413799F441FB74938BC60889D19"><enum>(A)</enum><header>In general</header><text>Paragraph (1) shall not apply—</text> 
<clause id="H08B49C8ADCD545B9B80045B0C400F4FC"><enum>(i)</enum><text>if the pilot of such flight reasonable determines that such flight will depart or arrive not later than 30 minutes after the 3-hour delay; or</text></clause> 
<clause id="H72A1BCBDABDC490D90B4F16E23CC00E0"><enum>(ii)</enum><text>if the pilot of such flight reasonable determines that permitting a passenger to deplane would jeopardize passenger safety or security.</text></clause></subparagraph> 
<subparagraph id="H5A2271F9E9654136A6EBA2F76B681725"><enum>(B)</enum><header>Extension of 30-minute period</header><text>A pilot may extend the 30-minute period referred to in subparagraph (A)(i) by not more than an additional 30 minutes in the case of an unanticipated extension of the delay.</text></subparagraph></paragraph> 
<paragraph id="HD9EB38F0364A4E1B9DC18063AD371F49"><enum>(3)</enum><header>Essential services</header><text display-inline="yes-display-inline">A covered air carrier operating an aircraft in air transportation shall provide for the essential needs of passengers at all times during which the aircraft is on the ground in the event of a departure or arrival delay, including the needs of passengers for food, water meeting the standards of the Safe Drinking Water Act or the Federal Food, Drug, and Cosmetic Act, as appropriate, sanitary facilities, medical access, adequate ventilation, and comfortable cabin temperatures.</text></paragraph></subsection> 
<subsection id="H8FE8CB9659934D4A94006997E72891E4"><enum>(d)</enum><header>Chronically delayed flights</header> 
<paragraph id="H59F67C3057394F29AAEB5070179F8BB7"><enum>(1)</enum><header>Publication of list of flights</header><text>A covered air carrier shall publish and update monthly on the Internet website of the air carrier a list of chronically delayed flights operated by the air carrier.</text></paragraph> 
<paragraph id="H16152006311E4419A975DECE1C73BB5E"><enum>(2)</enum><header>Disclosure to customers when purchasing tickets</header><text display-inline="yes-display-inline">Regardless of the method used by a consumer to contact a covered air carrier, the air carrier shall disclose, without being requested, the on-time performance for a chronically delayed flight of the air carrier whenever a customer makes a reservation or purchases a ticket on such a flight. </text></paragraph> 
<paragraph id="H24500B79267F4823A2FD782E9F67E139"><enum>(3)</enum><header>Chronically delayed flight defined</header><text>In this subsection, the term <quote>chronically delayed flight</quote> means a regularly scheduled flight in air transportation that has failed to arrive within 30 minutes of the scheduled arrival time of the flight at least 40 percent of the time during the most recent 3-month period for which data is available.</text></paragraph></subsection> 
<subsection id="HD0DEB1F35D9B49D287514E409FC6E874"><enum>(e)</enum><header>Fares, schedules, and itineraries</header> 
<paragraph id="H7562219062FE414CA0FD70623516F577"><enum>(1)</enum><header>Publication of information</header><text>A covered air carrier shall publish lowest fare information, and information on schedules and itineraries, with respect to regularly scheduled flights of the air carrier in air transportation.</text></paragraph> 
<paragraph id="HD5372C352A8E42CB8437EE79B93200EF"><enum>(2)</enum><header>Availability of information</header><text>Information to be published under paragraph (1) shall be updated in a timely manner and shall be made available to the public on the Internet website of the air carrier.</text></paragraph></subsection> 
<subsection id="HC8FCE11254A54505AD578E02A2A55B05"><enum>(f)</enum><header>Baggage</header><text display-inline="yes-display-inline">If a passenger of a covered air carrier submits a claim to the air carrier for lost baggage, the air carrier shall make every reasonable effort to return the baggage to the passenger within 24 hours.</text></subsection> 
<subsection id="H49E47D2D652C4CF3AD0358EB27D62200"><enum>(g)</enum><header>Passenger rights notification</header><text display-inline="yes-display-inline">A covered air carrier shall prominently display for passengers of the air carrier information outlining the consumer rights of the passengers, including the rights specified in this section.</text></subsection> 
<subsection id="H31966F57E9674E0186939B75EB03C3E4" commented="no"><enum>(h)</enum><header>Contract of carriage</header><text>Each covered air carrier shall incorporate the consumer rights specified in this section into the contract of carriage of the air carrier.</text></subsection></section> 
<section id="H9F5FFCF8B8F8465B8C4E005F42A88882"><enum>41783.</enum><header>Procedures for departure delays</header> 
<subsection id="HB043A808B15A460EBFB81C62E43DFE85"><enum>(a)</enum><header>Procedures to permit pilots to return to airport terminals</header><text display-inline="yes-display-inline">The Secretary of Transportation shall work in coordination with air carriers to ensure that a pilot operating an aircraft in a flight in air transportation that is affected by a long departure delay is permitted to return the aircraft to the airport terminal to allow passengers to exit the aircraft without losing the position of the flight in the departure sequence.</text></subsection> 
<subsection id="H23457992EB924FDB95207859A0E98B74"><enum>(b)</enum><header>Contingency plans for weather emergencies</header> 
<paragraph id="H036EB62ECF3C42638E2E25FA6997718B"><enum>(1)</enum><header>Coordination of plans</header><text display-inline="yes-display-inline">The Secretary shall review the emergency contingency plans of air carriers and airports to ensure that the plans will effectively address weather emergencies in a coordinated manner. </text></paragraph> 
<paragraph id="H55880E6CB7A84CC3A2174E6187C7D47"><enum>(2)</enum><header>Meeting</header><text>In carrying out this subsection, the Secretary shall convene a meeting of representatives of air carriers, airports, and the Federal Aviation Administration to develop procedures to better respond to weather emergencies resulting in long departure delays.</text> </paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H037C75A12C114743B346ECF8B547A0CF"><enum>(b)</enum><header>Conforming amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">chapter 417</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<toc-entry level="subchapter">SUBCHAPTER IV—AIR CARRIER PASSENGER SERVICES</toc-entry> 
<toc-entry level="section">41781. Definitions. </toc-entry> 
<toc-entry level="section">41782. Standards for air carrier passenger services.</toc-entry> 
<toc-entry level="section">41783. Procedures for departure delays.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H6983854CFEDD40C89DE248C501D5B886"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation shall issue final regulations to carry out <external-xref legal-doc="usc" parsable-cite="usc/49/41782">section 41782</external-xref> of title 49, United States Code, as added by subsection (a) of this section. The regulations shall require covered air carriers to comply with the requirements of such section 41782 not later than one year after such date of enactment.</text></subsection></section> 
<section id="H69D93975F3DB47C09DFA008972B7EE4E"><enum>3.</enum><header>Diverted flights</header> 
<subsection id="HEDEFE2629C934F55A89CE8007CD9716F"><enum>(a)</enum><header>Study</header><text>The Secretary of Transportation shall conduct a study of the ability of air carriers to provide for the essential needs of passengers, including adequate food and water, in cases in which a flight of the air carrier is diverted for an unscheduled landing at an airport due to a weather situation or other emergency</text></subsection> 
<subsection id="HF98A98A12717425EB6C1D4538DD72D9C"><enum>(b)</enum><header>Report to Congress</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall transmit to Congress a report on the results of the study, including methods for ensuring that the essential needs of passengers are met in the case of a diverted flight described in subsection (a).</text> </subsection></section>
