<section id="H638EB5DCA00C4B8400686F8685E340FC"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H9318C01C45294A15A51EC75CA0A01500"><enum>(1)</enum><text display-inline="yes-display-inline">In 2002, over 7,000,000 people were incarcerated in Federal, State, or local prisons or jails, or were under parole or court supervision. Nearly 650,000 people are released from Federal and State incarceration into communities nationwide each year.</text></paragraph> 
<paragraph id="H7FFE68CFD9B84FD8840015B376BC3DD"><enum>(2)</enum><text>There are over 3,200 jails throughout the United States, the vast majority of which are operated by county governments. Each year, these jails will release more than 10,000,000 people back into the community.</text></paragraph> 
<paragraph id="HB06B8FD9B5A447E99CA44D1F00C6F162"><enum>(3)</enum><text>Nearly <fraction>2/3</fraction> of released State prisoners are expected to be rearrested for a felony or serious misdemeanor within 3 years after release.</text></paragraph> 
<paragraph id="H6919B18D19DC4DBCA85003D320D1C307"><enum>(4)</enum><text>According to the Bureau of Justice Statistics, expenditures on corrections alone increased from $9,000,000,000 in 1982 to $59,600,000,000 in 2002. These figures do not include the cost of arrest and prosecution, nor do they take into account the cost to victims.</text></paragraph> 
<paragraph id="HDCDFAA4F22DC41B4951CBDD32FDFACE4"><enum>(5)</enum><text>The Serious and Violent Offender Reentry Initiative provided $139,000,000 in funding for State governments to develop and implement education, job training, mental health treatment, and substance abuse treatment for serious and violent offenders. This Act seeks to build upon the innovative and successful State reentry programs developed under the Serious and Violent Offender Reentry Initiative, which terminated after fiscal year 2005.</text></paragraph> 
<paragraph id="H781EEE1AEFAD4EF0944B269ECDAF87CE"><enum>(6)</enum><text>Between 1991 and 1999, the number of children with a parent in a Federal or State correctional facility increased by more than 100 percent, from approximately 900,000 to approximately 2,000,000. According to the Bureau of Prisons, there is evidence to suggest that inmates who are connected to their children and families are more likely to avoid negative incidents and have reduced sentences.</text></paragraph> 
<paragraph id="H2821C9E585C2425FA6D100D45FF8E983"><enum>(7)</enum><text>Released prisoners cite family support as the most important factor in helping them stay out of prison. Research suggests that families are an often underutilized resource in the reentry process.</text></paragraph> 
<paragraph id="H8C73AB06B8C64174AC6C149981CCDC5"><enum>(8)</enum><text>Approximately 100,000 juveniles (ages 17 years and under) leave juvenile correctional facilities, State prison, or Federal prison each year. Juveniles released from secure confinement still have their likely prime crime years ahead of them. Juveniles released from secure confinement have a recidivism rate ranging from 55 to 75 percent. The chances that young people will successfully transition into society improve with effective reentry and aftercare programs.</text></paragraph> 
<paragraph id="HD5EA8EE8053F4B1783174D03CCFBB8B7"><enum>(9)</enum><text>Studies have shown that between 15 percent and 27 percent of prisoners expect to go to homeless shelters upon release from prison.</text></paragraph> 
<paragraph id="H3E8CB743C0E24D45A61528B417646D80"><enum>(10)</enum><text>Fifty-seven percent of Federal and 70 percent of State inmates used drugs regularly before going to prison, and the Bureau of Justice Statistics report titled <quote>Trends in State Parole, 1990–2000</quote> estimates the use of drugs or alcohol around the time of the offense that resulted in the incarceration of the inmate at as high as 84 percent.</text></paragraph> 
<paragraph id="HB8A79C1449144D3CBC16AB612B648B4E"><enum>(11)</enum><text>Family-based treatment programs have proven results for serving the special populations of female offenders and substance abusers with children. An evaluation by the Substance Abuse and Mental Health Services Administration of family-based treatment for substance-abusing mothers and children found that 6 months after such treatment, 60 percent of the mothers remained alcohol and drug free, and drug-related offenses declined from 28 percent to 7 percent. Additionally, a 2003 evaluation of residential family-based treatment programs revealed that 60 percent of mothers remained clean and sober 6 months after treatment, criminal arrests declined by 43 percent, and 88 percent of the children treated in the program with their mothers remained stabilized.</text></paragraph> 
<paragraph id="HC8CF17BF78E74DF7B1BD712E87D2AEC"><enum>(12)</enum><text>A Bureau of Justice Statistics analysis indicated that only 33 percent of Federal inmates and 36 percent of State inmates had participated in residential in-patient treatment programs for alcohol and drug abuse 12 months before their release. Further, over <fraction>1/3</fraction> of all jail inmates have some physical or mental disability and 25 percent of jail inmates have been treated at some time for a mental or emotional problem.</text></paragraph> 
<paragraph id="H301CD7A8B4784B3FB319CD2654772635"><enum>(13)</enum><text display-inline="yes-display-inline">State Substance Abuse Agency Directors, also known as Single State Authorities (SSAs), manage the Nation’s publicly funded substance abuse prevention and treatment systems. SSAs are responsible for planning and implementing State-wide systems of care that provide clinically appropriate substance abuse services. Given the high rate of substance use disorders among offenders reentering our communities, successful reentry programs require close interaction and collaboration with SSAs when planning, implementing, and evaluating reentry programs. </text></paragraph> 
<paragraph id="H4B37BD68113D48B1ADB0E45E8143E33"><enum>(14)</enum><text>According to the National Institute of Literacy, 70 percent of all prisoners function at the lowest literacy levels.</text></paragraph> 
<paragraph id="H4AD0E677BBC147748412016D1F1EB051"><enum>(15)</enum><text>Less than 32 percent of State prison inmates have a high school diploma or a higher level of education, compared to 82 percent of the general population.</text></paragraph> 
<paragraph id="HDC7C5C80D4224065A1B793D81D06AA5B"><enum>(16)</enum><text>Approximately 38 percent of inmates who completed 11 years or less of school were not working before entry into prison.</text></paragraph> 
<paragraph id="HB1296FC6A4A8453B9D2095BDBBE40025"><enum>(17)</enum><text>The percentage of State prisoners participating in educational programs decreased by more than 8 percent between 1991 and 1997, despite growing evidence of how educational programming while incarcerated reduces recidivism.</text></paragraph> 
<paragraph id="HAB1F31D9FDE4418C8026E860A4B11300"><enum>(18)</enum><text>The National Institute of Justice has found that 1 year after release, up to 60 percent of former inmates are not employed.</text></paragraph>

<section commented="no" display-inline="no-display-inline" id="H7A5051DBA5B1417D84D5A3B7523D60DC"><enum>4.</enum><header>Submission of reports to Congress</header><text display-inline="no-display-inline">Not later than January 31 of each year, the Attorney General shall submit all reports received under this Act and the amendments made by this Act during the preceding year to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives.</text></section> 
<title id="H65A88E6ED35A4C4393002D6DD5387BCD"><enum>I</enum><header>Amendments related to the Omnibus Crime Control and Safe Streets Act of 1968</header> 
<subtitle id="H41FB1129026E40A2B9D2AFD7A2A6D708"><enum>A</enum><header>Improvements to existing programs</header> 
<section id="HA5510F9903A647CFB604B5B10252C5B2"><enum>101.</enum><header>Reauthorization of adult and juvenile offender State and local reentry demonstration projects</header> 
<subsection id="H351EA42B263E4E02B8F8F91881C1A197"><enum>(a)</enum><header>Adult and juvenile offender demonstration projects authorized</header><text>Section 2976(b) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3797w">42 U.S.C. 3797w(b)</external-xref>) is amended by striking paragraphs (1) through (4) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H9C9BF0627B5E432BB09C975C13941BB9" style="OLC"> 
<paragraph id="H35ED7B996A3447C59135A1412E58D5DE"><enum>(1)</enum><text>establishing or improving the system or systems under which—</text> 
<subparagraph id="H74E78D4BDC2147079EAE35597F299647"><enum>(A)</enum><text>correctional agencies and other criminal and juvenile justice agencies of the grant recipient develop and carry out plans to facilitate the reentry into the community of each offender in the custody of the jurisdiction involved;</text></subparagraph> 
<subparagraph id="H4EACC19A3A4443ABA372FD4CE5151800"><enum>(B)</enum><text>the supervision and services provided to offenders in the custody of the jurisdiction involved are coordinated with the supervision and services provided to offenders after reentry into the community, including coordination with Comprehensive and Continuous Offender Reentry Task Forces under section 2902 or with similar planning groups;</text></subparagraph> 
<subparagraph id="H2A27129EA8334AA496B8E7D25B5FD798"><enum>(C)</enum><text>the efforts of various public and private entities to provide supervision and services to offenders after reentry into the community, and to family members of such offenders, are coordinated; and</text></subparagraph> 
<subparagraph id="H5AC2BBEED05C41409C8DFD61B0489B27"><enum>(D)</enum><text>offenders awaiting reentry into the community are provided with documents (such as identification papers, referrals to services, medical prescriptions, job training certificates, apprenticeship papers, and information on obtaining public assistance) useful in achieving a successful transition from prison, jail, or a juvenile facility;</text></subparagraph></paragraph> 
<paragraph id="H06F7B2A2E32E4857876461A556003254"><enum>(2)</enum><text>carrying out programs and initiatives by units of local government to strengthen reentry services for individuals released from local jails, including coordination with Comprehensive and Continuous Offender Reentry Task Forces under section 2902 or with similar planning groups;</text></paragraph> 
<paragraph id="HB7D2417DC7B04828BCDFF5FBE7BF954E"><enum>(3)</enum><text>assessing the literacy, educational, and vocational needs of offenders in custody and identifying and providing services appropriate to meet those needs, including follow-up assessments and long-term services;</text></paragraph> 
<paragraph id="H32345115E525416F9F5E3890D4A373F9"><enum>(4)</enum><text>facilitating collaboration among corrections (including community corrections), technical schools, community colleges, businesses, nonprofit, and the workforce development and employment service sectors—</text> 
<subparagraph id="HDA96369D621E472A8EB1AF1BB3684DA"><enum>(A)</enum><text>to promote, where appropriate, the employment of people released from prison, jail, or a juvenile facility through efforts such as educating employers about existing financial incentives;</text></subparagraph> 
<subparagraph id="H82FEA2DFECBA4662ACD45E348C8EB335"><enum>(B)</enum><text>to facilitate the creation of job opportunities, including transitional jobs and time-limited subsidized work experience (where appropriate);</text></subparagraph> 
<subparagraph id="HAB183AC43B4D4D519ECB004E00385322"><enum>(C)</enum><text>to connect offenders to employment (including supportive employment and employment services before their release to the community), provide work supports (including transportation and retention services), as appropriate, and identify labor market needs to ensure that education and training are appropriate; and</text></subparagraph> 
<subparagraph id="H76DE1AE3FBEE4B1FAEE587839981E8C5"><enum>(D)</enum><text>to address obstacles to employment that are not directly connected to the offense committed and the risk that the offender presents to the community and provide case management services as necessary to prepare offenders for jobs that offer the potential for advancement and growth;</text></subparagraph></paragraph> 
<paragraph id="H44BD07C39D3341CCA61B9652B83221C"><enum>(5)</enum><text>providing offenders with education, job training, responsible parenting and healthy relationship skills training (designed specifically to address the needs of fathers and mothers in or transitioning from prison, jail, or a juvenile facility), English literacy education, work experience programs, self-respect and life skills training, and other skills useful in achieving a successful transition from prison, jail, or a juvenile facility;</text></paragraph> 
<paragraph id="HA7E51A50E492484AA446A6A660BB9611"><enum>(6)</enum><text>providing structured post-release housing and transitional housing (including group homes for recovering substance abusers (with appropriate safeguards that may include single-gender housing)) through which offenders are provided supervision and services immediately following reentry into the community;</text></paragraph> 
<paragraph id="H9F03A663A6F04B4F8D010080AA7E9984"><enum>(7)</enum><text>assisting offenders in securing permanent housing upon release or following a stay in transitional housing;</text></paragraph> 
<paragraph id="H906D975227B541A8998FBF98B8F1E5C4"><enum>(8)</enum><text>providing substance abuse treatment and services, including providing a full continuum of substance abuse treatment services that encompasses outpatient services, comprehensive residential services and recovery, and recovery home services to offenders reentering the community from prison, jail, or a juvenile facility;</text></paragraph> 
<paragraph id="HEFD1FFC536674FBE00D60719AFEA3FD2"><enum>(9)</enum><text>expanding family-based drug treatment centers that offer family-based comprehensive treatment services for parents and their children as a complete family unit, as appropriate to the safety, security, and well-being of the family;</text></paragraph> 
<paragraph id="HB289996E7CF247C198C3C8B8BA583017"><enum>(10)</enum><text>encouraging collaboration among juvenile and adult corrections, community corrections, and community health centers to allow access to affordable and quality primary health care for offenders during the period of transition from prison, jail, or a juvenile facility;</text></paragraph> 
<paragraph id="H27FEB73029D841E5B09F2782DA044808"><enum>(11)</enum><text>providing or facilitating health care services to offenders (including substance abuse screening, treatment, and aftercare, infectious disease screening and treatment, and screening, assessment, and aftercare for mental health services) to protect the communities in which offenders will live;</text></paragraph> 
<paragraph id="H22A4F5423FFF4AFFAB25897CB467C714"><enum>(12)</enum><text>enabling prison, jail, or juvenile facility mentors of offenders to remain in contact with those offenders (including through the use of all available technology) while in prison, jail, or a juvenile facility and after reentry into the community, and encouraging the involvement of prison, jail, or a juvenile facility mentors in the reentry process;</text></paragraph> 
<paragraph id="H115C2DFC70DD4831A91906F99C76EE"><enum>(13)</enum><text>systems under which family members of offenders are involved in facilitating the successful reentry of those offenders into the community (as appropriate to the safety, security, and well-being of the family), including removing obstacles to the maintenance of family relationships while the offender is in custody, strengthening the family’s capacity to function as a stable living situation during reentry, and involving family members in the planning and implementation of the reentry process;</text></paragraph> 
<paragraph id="H95203FBBB2F34206B500886BD0715556"><enum>(14)</enum><text>creating, developing, or enhancing offender and family assessments, curricula, policies, procedures, or programs (including mentoring programs)—</text> 
<subparagraph id="H0AFFE5D5343E4706ADDD1817A6F6456B"><enum>(A)</enum><text>to help offenders with a history or identified risk of domestic violence, dating violence, sexual assault, or stalking reconnect with their families and communities (as appropriate to the safety, security, and well-being of the family), and become non-abusive parents or partners; and</text></subparagraph> 
<subparagraph id="H2320430A8F52474A9CC09FC0B6C60969"><enum>(B)</enum><text>under which particular attention is paid to the safety of children affected and the confidentiality concerns of victims, and efforts are coordinated with victim service providers;</text></subparagraph></paragraph> 
<paragraph id="H936688DBFF344948A4D4F7445998385E"><enum>(15)</enum><text>maintaining the parent-child relationship, as appropriate to the safety, security, and well-being of the child as determined by the relevant corrections and child protective services agencies, including—</text> 
<subparagraph id="H7BA101531E1141F1A382FB36ECEA69DE"><enum>(A)</enum><text>implementing programs in correctional agencies to include the collection of information regarding any dependent children of an offender as part of intake procedures, including the number, age, and location or jurisdiction of such children;</text></subparagraph> 
<subparagraph id="HEE1B292EBEDE42499616FD159C07132E"><enum>(B)</enum><text>connecting those identified children with services as appropriate and needed;</text></subparagraph> 
<subparagraph id="H49B7BF1E8EDD497ABABFC7ED0045A26F"><enum>(C)</enum><text>carrying out programs (including mentoring) that support children of incarcerated parents, including those in foster care and those cared for by grandparents or other relatives (which is commonly referred to as kinship care);</text></subparagraph> 
<subparagraph id="H4E57C6F097984E8196426F8EA93D8C13"><enum>(D)</enum><text>developing programs and activities (including mentoring) that support parent-child relationships, as appropriate to the safety, security, and well-being of the family, including technology to promote the parent-child relationship and to facilitate participation in parent-teacher conferences, books on tape programs, family days, and visitation areas for children while visiting an incarcerated parent;</text></subparagraph> 
<subparagraph id="HA4A048AB5DE24923A4CE048C008E4169"><enum>(E)</enum><text>helping incarcerated parents to learn responsible parenting and healthy relationship skills;</text></subparagraph> 
<subparagraph id="HEAB9F82A306A49EDBFF7E1844C762452"><enum>(F)</enum><text>addressing visitation obstacles to children of an incarcerated parent, such as the location of facilities in remote areas, telephone costs, mail restrictions, and visitation policies; and</text></subparagraph> 
<subparagraph id="H17C5D361781F4E7784972DF7CBF54EB3"><enum>(G)</enum><text>identifying and addressing obstacles to collaborating with child welfare agencies in the provision of services jointly to offenders in custody and to the children of such offenders;</text></subparagraph></paragraph> 
<paragraph id="H5C32D68C5CD843960066D051EC72193"><enum>(16)</enum><text>carrying out programs for the entire family unit, including the coordination of service delivery across agencies;</text></paragraph> 
<paragraph id="H87B8C698799347E100D3E026968F7E88"><enum>(17)</enum><text>facilitating and encouraging timely and complete payment of restitution and fines by offenders to victims and the community;</text></paragraph> 
<paragraph id="HC576554BAE674FC58BF42700CB5473A6"><enum>(18)</enum><text>providing services as necessary to victims upon release of offenders, including security services and counseling, and facilitating the inclusion of victims, on a voluntary basis, in the reentry process;</text></paragraph> 
<paragraph id="H71C36062817D4C0392C8C16D33F22FA8"><enum>(19)</enum><text>establishing or expanding the use of reentry courts and other programs to—</text> 
<subparagraph id="H3F0745A725904F70939EC46CDCF228C1"><enum>(A)</enum><text>monitor offenders returning to the community;</text></subparagraph> 
<subparagraph id="H0AA924B718814243A30084F3032DCDB3"><enum>(B)</enum><text>provide returning offenders with—</text> 
<clause id="H55E679BB16044155A8450061095F4791"><enum>(i)</enum><text>drug and alcohol testing and treatment; and</text></clause> 
<clause id="H954280222D704F1A94BA10CEAE2B1D73"><enum>(ii)</enum><text>mental and medical health assessment and services;</text></clause></subparagraph> 
<subparagraph id="H4E37DB1C21D044418823366D28B102FB"><enum>(C)</enum><text>facilitate restorative justice practices and convene family or community impact panels, family impact educational classes, victim impact panels, or victim impact educational classes;</text></subparagraph> 
<subparagraph id="HC943BCC95B7A4A6D8344883650B6E246"><enum>(D)</enum><text>provide and coordinate the delivery of other community services to offenders, including—</text> 
<clause id="H49C29B4D2A00468697F2C018556DC526"><enum>(i)</enum><text>employment training;</text></clause> 
<clause id="HBF15F59808D24C1A864435DCAFAD5C52"><enum>(ii)</enum><text>education;</text></clause> 
<clause id="HFB79287911394F2DBF865EDBD8484298"><enum>(iii)</enum><text>housing assistance;</text></clause> 
<clause id="HB6F0639188D5466CB31F90DDCBDCE5C1"><enum>(iv)</enum><text>children and family support, to include responsible parenting and healthy relationship skill training designed specifically to address the needs of incarcerated and transitioning fathers and mothers;</text></clause> 
<clause id="H133069AE504A4982B275B37500B4612C"><enum>(v)</enum><text>conflict resolution skills training;</text></clause> 
<clause id="H360ABC8078264821A188A052EA4B749F"><enum>(vi)</enum><text>family violence intervention programs; and</text></clause> 
<clause id="HD880ACD2A8094AEBB93D9904BFE9B300"><enum>(vii)</enum><text>other appropriate services; and</text></clause></subparagraph> 
<subparagraph id="HD7605419FDCE4D5FBD83C644338E924F"><enum>(E)</enum><text>establish and implement graduated sanctions and incentives;</text></subparagraph></paragraph> 
<paragraph id="H5F7A917A17554B18B4F4A329BD62F859"><enum>(20)</enum><text>developing a case management reentry program that—</text> 
<subparagraph id="HE4FD78F1693B4E159989D565FC008F70"><enum>(A)</enum><text>provides services to eligible veterans, as defined by the Attorney General; and</text></subparagraph> 
<subparagraph id="HE5F52EAA17994C5BA470B828FC9C6CB7"><enum>(B)</enum><text>provides for a reentry service network solely for such eligible veterans that coordinates community services and veterans services for offenders who qualify for such veterans services; and</text></subparagraph></paragraph> 
<paragraph id="H5A75DD9DFE62420E84D02F3CEC37F17D"><enum>(21)</enum><text>protecting communities against dangerous offenders, including—</text> 
<subparagraph id="H7143E77C4F924FCDB8E74932D23DA07F"><enum>(A)</enum><text>conducting studies in collaboration with Federal research initiatives in effect on the date of enactment of the <short-title>Second Chance Act of 2007</short-title>, to determine which offenders are returning to prisons, jails, and juvenile facilities and which of those returning offenders represent the greatest risk to community safety;</text></subparagraph> 
<subparagraph id="HBD4F196819A64422BF694B13FE97ED4E"><enum>(B)</enum><text>developing and implementing procedures to assist relevant authorities in determining when release is appropriate and in the use of data to inform the release decision;</text></subparagraph> 
<subparagraph id="HFF502CBC45974AD5AC00002C5CEA8CAA"><enum>(C)</enum><text>using validated assessment tools to assess the risk factors of returning inmates, and developing or adopting procedures to ensure that dangerous felons are not released from prison prematurely; and</text></subparagraph> 
<subparagraph id="HCA61E82E74094D8D914F36AEAE046D4D"><enum>(D)</enum><text>developing and implementing procedures to identify efficiently and effectively those violators of probation, parole, or post-incarceration supervision who represent the greatest risk to community safety.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H58CB0DF6E2DF4D5AB05B76B2B2BE7072"><enum>(b)</enum><header>Juvenile offender demonstration projects reauthorized</header><text>Section 2976(c) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3797w">42 U.S.C. 3797w(c)</external-xref>) is amended by striking <quote>may be expended for</quote> and all that follows through the period at the end and inserting <quote>may be expended for any activity referred to in subsection (b).</quote>.</text></subsection> 
<subsection id="H0F5AAF22C0A047BBBB728DCB179925E"><enum>(c)</enum><header>Applications; requirements; priorities; performance measurements</header><text>Section 2976 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3797w">42 U.S.C. 3797w</external-xref>) is further amended—</text> 
<paragraph id="HE229E7B7AA6F4E349891B56327A7C00"><enum>(1)</enum><text>by redesignating subsection (h) as subsection (o); and</text></paragraph> 
<paragraph id="H8C827CD478454A3AA624CD04A38ECBD6"><enum>(2)</enum><text>by striking subsections (d) through (g) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="HA3B6FF68FD894F14B851E3BC08E84EB2" style="OLC"> 
<subsection id="H92F58939AECB47A9910325A4E8961485"><enum>(d)</enum><header>Applications</header><text>A State, unit of local government, territory, or Indian tribe, or combination thereof, desiring a grant under this section shall submit an application to the Attorney General that—</text> 
<paragraph id="H0B745D80530C411CBDB05C4EB7CA698"><enum>(1)</enum><text>contains a reentry strategic plan, as described in subsection (h), which describes the long-term strategy and incorporates a detailed implementation schedule, including the plans of the applicant to pay for the program after the Federal funding is discontinued;</text></paragraph> 
<paragraph id="H827C35849CEA47C8A66D710021A423C5"><enum>(2)</enum><text>identifies the local government role and the role of governmental agencies and nonprofit organizations that will be coordinated by, and that will collaborate on, the offender reentry strategy of the applicant and certifies their involvement; and</text></paragraph> 
<paragraph id="H12B271422500420B8CC06E63035DAE18"><enum>(3)</enum><text display-inline="yes-display-inline">describes the evidence-based methodology and outcome measures that will be used to evaluate the program, and specifically explains how such measurements will provide valid measures of the program’s impact.</text></paragraph></subsection> 
<subsection id="H8D8B77A09F7D4C5C81470693FB9234EB"><enum>(e)</enum><header>Requirements</header><text>The Attorney General may make a grant to an applicant under this section only if the application—</text> 
<paragraph id="H8DD8A922BF3F41C08F9031CE9344C77F"><enum>(1)</enum><text>reflects explicit support of the chief executive officer of the State, unit of local government, territory, or Indian tribe applying for a grant under this section;</text></paragraph> 
<paragraph id="H68A6FC7BF7D343448EE500731C950848"><enum>(2)</enum><text>provides extensive discussion of the role of State corrections departments, community corrections agencies, juvenile justice systems, or local jail systems in ensuring successful reentry of offenders into their communities;</text></paragraph> 
<paragraph id="H873A2D6276C34BBD994D006214DFFA00"><enum>(3)</enum><text>provides extensive evidence of collaboration with State and local government agencies overseeing health, housing, child welfare, education, substance abuse, victims services, and employment services, and with local law enforcement;</text></paragraph> 
<paragraph id="HBC8A85CD1E5F4404B6B34E5F3B0086E7"><enum>(4)</enum><text display-inline="yes-display-inline">provides a plan for analysis of the statutory, regulatory, rules-based, and practice-based hurdles to reintegration of offenders into the community; and</text> </paragraph> 
<paragraph id="H3B69CD6B01AB4B43AF422D17D2D143F7"><enum>(5)</enum><text>includes the use of a State, local, territorial, or tribal task force, described in subsection (i), to carry out the activities funded under the grant.</text></paragraph></subsection> 
<subsection id="H93725D5F39A84AF08D321DB392464C24"><enum>(f)</enum><header>Priority considerations</header><text>The Attorney General shall give priority to grant applications under this section that best—</text> 
<paragraph id="HC591A08836B848718B5E445C8B442E47"><enum>(1)</enum><text>focus initiative on geographic areas with a disproportionate population of offenders released from prisons, jails, and juvenile facilities;</text></paragraph> 
<paragraph id="H0FFD08D352824FAFA48231D33191CAC1"><enum>(2)</enum><text>include—</text> 
<subparagraph id="H60C127EC4CA740D000DFF921A4BE297E"><enum>(A)</enum><text>input from nonprofit organizations, in any case where relevant input is available and appropriate to the grant application;</text></subparagraph> 
<subparagraph id="H8B21911633194F50BC97D463506FF191"><enum>(B)</enum><text>consultations with crime victims and offenders who are released from prisons, jails, and juvenile facilities; and</text></subparagraph> 
<subparagraph id="H5ECB67F031BB417D00ABE1BED71C00E1"><enum>(C)</enum><text>coordination with families of offenders;</text></subparagraph></paragraph> 
<paragraph id="HF484E3D43016403B85178F8D0079F48B"><enum>(3)</enum><text>demonstrate effective case assessment and management abilities in order to provide comprehensive and continuous reentry, including—</text> 
<subparagraph id="H114FF3E81DF4494EB99C643D2B15F862"><enum>(A)</enum><text>planning while offenders are in prison, jail, or a juvenile facility, pre-release transition housing, and community release;</text></subparagraph> 
<subparagraph id="H8A5F1A01905E4B69AD6B2251DFDDD2D0"><enum>(B)</enum><text>establishing pre-release planning procedures to ensure that the eligibility of an offender for Federal or State benefits upon release is established prior to release, subject to any limitations in law, and to ensure that offenders obtain all necessary referrals for reentry services; and</text></subparagraph> 
<subparagraph id="H0EA90834F87649A5BD06292EA655ACD5"><enum>(C)</enum><text>delivery of continuous and appropriate drug treatment, medical care, job training and placement, educational services, or any other service or support needed for reentry;</text></subparagraph></paragraph> 
<paragraph id="H0739FC05BAF0468BAFFD3B040400F014"><enum>(4)</enum><text>review the process by which the applicant adjudicates violations of parole, probation, or supervision following release from prison, jail, or a juvenile facility, taking into account public safety and the use of graduated, community-based sanctions for minor and technical violations of parole, probation, or supervision (specifically those violations that are not otherwise, and independently, a violation of law);</text></paragraph> 
<paragraph id="HB9D97666D24A4BFC98D1F0200D86FE9"><enum>(5)</enum><text>provide for an independent evaluation of reentry programs that include, to the maximum extent possible, random assignment and controlled studies to determine the effectiveness of such programs; and</text></paragraph> 
<paragraph id="H9645B1C6C44F4874A500D5C358357D02"><enum>(6)</enum><text>target high-risk offenders for reentry programs through validated assessment tools.</text></paragraph></subsection> 
<subsection id="H6CA4136EA3F340018DD6773C7EEAE4FE"><enum>(g)</enum><header>Uses of grant funds</header> 
<paragraph id="H033669937B15488DA9FC264B481EF2FD"><enum>(1)</enum><header>Federal share</header> 
<subparagraph id="H0DC309AF279D41B8B800186943F5A565"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Federal share of a grant received under this section may not exceed 75 percent of the project funded under such grant in fiscal year 2008.</text></subparagraph> 
<subparagraph id="H7EF10F1FEC084873951B25392EEDD54"><enum>(B)</enum><header>Waiver</header><text>Subparagraph (A) shall not apply if the Attorney General—</text> 
<clause id="HDB38A6F394E94FCA9498ACA2E930EB8"><enum>(i)</enum><text>waives, in whole or in part, the requirement of this paragraph; and</text></clause> 
<clause id="H1A45C7C00482432D8CD5FB5F1F9604FB"><enum>(ii)</enum><text>publishes in the Federal Register the rationale for the waiver.</text></clause></subparagraph></paragraph> 
<paragraph id="H5E2AFE95ED6849DABDC9A898E0004BFE"><enum>(2)</enum><header>Supplement not supplant</header><text>Federal funds received under this section shall be used to supplement, not supplant, non-Federal funds that would otherwise be available for the activities funded under this section.</text></paragraph></subsection> 
<subsection id="H551F505084CF4B81AAC1D23EE728C5C9"><enum>(h)</enum><header>Reentry strategic plan</header> 
<paragraph id="H49ED7919ACF640E5B66F5D50A6499259"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">As a condition of receiving financial assistance under this section, each applicant shall develop a comprehensive strategic reentry plan that contains measurable annual and 5-year performance outcomes, and that uses, to the maximum extent possible, random assigned and controlled studies to determine the effectiveness of the program. One goal of the plan shall be to reduce the rate of recidivism (as defined by the Attorney General, consistent with the research on offender reentry undertaken by the Bureau of Justice Statistics) for offenders released from prison, jail, or a juvenile facility who are served with funds made available under this section. </text></paragraph> 
<paragraph id="HD905BB73EA3049CCB5EC2EDD23E7EE"><enum>(2)</enum><header>Coordination</header><text>In developing a reentry plan under this subsection, an applicant shall coordinate with communities and stakeholders, including persons in the fields of public safety, juvenile and adult corrections, housing, health, education, substance abuse, children and families, victims services, employment, and business and members of nonprofit organizations that can provide reentry services.</text></paragraph> 
<paragraph id="H4E0BB39861FA4444874EF7E4793D134F"><enum>(3)</enum><header>Measurements of progress</header><text>Each reentry plan developed under this subsection shall measure the progress of the applicant toward increasing public safety by reducing rates of recidivism and enabling released offenders to transition successfully back into their communities.</text></paragraph></subsection> 
<subsection id="H470D66C6A37C4F4BB8698422113E56CE"><enum>(i)</enum><header>Reentry task force</header> 
<paragraph id="H65EF48ADC15C4F528051587409E5DA47"><enum>(1)</enum><header>In general</header><text>As a condition of receiving financial assistance under this section, each applicant shall establish or empower a Reentry Task Force, or other relevant convening authority, to—</text> 
<subparagraph id="H8DC1CDFBFF37478C86B6883B73F487CC"><enum>(A)</enum><text>examine ways to pool resources and funding streams to promote lower recidivism rates for returning offenders and minimize the harmful effects of offenders’ time in prison, jail, or a juvenile facility on families and communities of offenders by collecting data and best practices in offender reentry from demonstration grantees and other agencies and organizations; and</text></subparagraph> 
<subparagraph id="HCFE26A67BEF54BB19742F069EE1BC468"><enum>(B)</enum><text>provide the analysis described in subsection (e)(4).</text></subparagraph></paragraph> 
<paragraph id="H58C783DBDAF74F659F38B43401DAAAB1"><enum>(2)</enum><header>Membership</header><text>The task force or other authority under this subsection shall be comprised of—</text> 
<subparagraph id="HDABEE4B538ED4644BF00F4A1806BBBC1"><enum>(A)</enum><text>relevant State, tribal, territorial, or local leaders; and</text></subparagraph> 
<subparagraph id="H078B3E4BC1714707B08BBF0007CEDC5"><enum>(B)</enum><text>representatives of relevant—</text> 
<clause id="H38028AC3607D4D9D93782DF5E8C78972"><enum>(i)</enum><text>agencies;</text></clause> 
<clause id="H92033411321F47948B8864B2874B5853"><enum>(ii)</enum><text>service providers;</text></clause> 
<clause id="HC17D56E5557141EAB92B7798AEFCD723"><enum>(iii)</enum><text>nonprofit organizations; and</text></clause> 
<clause id="HF9F6C3EAF15E43A4B5E0BE0055FAD344"><enum>(iv)</enum><text>stakeholders.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H56C7E06B6D474F629C431F2DDE265B50"><enum>(j)</enum><header>Strategic performance outcomes</header> 
<paragraph id="H10CDAD5F961B42899971B8631E2996E"><enum>(1)</enum><header>In general</header><text>Each applicant shall identify in the reentry strategic plan developed under subsection (h), specific performance outcomes related to the long-term goals of increasing public safety and reducing recidivism.</text></paragraph> 
<paragraph id="H36EC3E4944994465B3E5AEFB50F848CC"><enum>(2)</enum><header>Performance outcomes</header><text>The performance outcomes identified under paragraph (1) shall include, with respect to offenders released back into the community—</text> 
<subparagraph id="HCB5EBEB95942434BAE3700044804DC5E"><enum>(A)</enum><text>reduction in recidivism rates, which shall be reported in accordance with the measure selected by the Director of the Bureau of Prisons under section 234(c)(2) of the <short-title>Second Chance Act of 2007</short-title>;</text></subparagraph> 
<subparagraph id="H7E6864A477E54BD99CB1B9CBF5E0B024"><enum>(B)</enum><text>reduction in crime;</text></subparagraph> 
<subparagraph id="H5741F5355ACB449EB243001B6C811709"><enum>(C)</enum><text>increased employment and education opportunities;</text></subparagraph> 
<subparagraph id="HAB16D1EEBA0D4A5AB385F5D88690027"><enum>(D)</enum><text>reduction in violations of conditions of supervised release;</text></subparagraph> 
<subparagraph id="H5D86FF1AA4904237AD613200C7ACABC2"><enum>(E)</enum><text>increased child support;</text></subparagraph> 
<subparagraph id="H10E8D7F5FD214B24AB14E3B06665DB2C"><enum>(F)</enum><text>increased housing opportunities;</text></subparagraph> 
<subparagraph id="HABE1BA6370BA46509CEE9D423ED50749"><enum>(G)</enum><text>reduction in drug and alcohol abuse; and</text></subparagraph> 
<subparagraph id="H25614625329F4BC79FCD5D129F009E6C"><enum>(H)</enum><text>increased participation in substance abuse and mental health services.</text></subparagraph></paragraph> 
<paragraph id="H73F70D1A5DD84D0881FAAA8D131BDBA3"><enum>(3)</enum><header>Other outcomes</header><text>A grantee under this section may include in their reentry strategic plan other performance outcomes that increase the success rates of offenders who transition from prison, jails, or juvenile facilities.</text></paragraph> 
<paragraph id="H98EE69857666457AB240ABB88B5BF4DC"><enum>(4)</enum><header>Coordination</header><text>A grantee under this section shall coordinate with communities and stakeholders about the selection of performance outcomes identified by the applicant, and shall consult with the Attorney General for assistance with data collection and measurement activities as provided for in the grant application materials.</text></paragraph> 
<paragraph id="HDF22FDE5A1A94BAEB29DDF03ABF02692"><enum>(5)</enum><header>Report</header> 
<subparagraph id="H585743BB96384C088FC8B501247F1607"><enum>(A)</enum><header>In general</header><text>Each grantee under this section shall submit an annual report to the Attorney General that—</text> 
<clause id="H210BA6A78DFE4D4AACBB264DFBD6B36"><enum>(i)</enum><text>identifies the progress of the grantee toward achieving its strategic performance outcomes; and</text></clause> 
<clause id="HE9E878CACAAA475B8DA171DBADA52D45"><enum>(ii)</enum><text>describes other activities conducted by the grantee to increase the success rates of the reentry population, such as programs that foster effective risk management and treatment programming, offender accountability, and community and victim participation.</text></clause></subparagraph> 
<subparagraph id="H13112AA32C3D4D19900938B1B97577A2"><enum>(B)</enum><header>Submission to Congress</header><text>On an annual basis, the Attorney General shall submit all reports received under this paragraph during the previous year to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives.</text></subparagraph></paragraph></subsection> 
<subsection id="HD302BAE58245454EB786C43425425446"><enum>(k)</enum><header>Performance measurement</header> 
<paragraph id="HAB647CE720AD49B4B6B18FB18D49A896"><enum>(1)</enum><header>In general</header><text>The Attorney General, in consultation with grantees under this section, shall—</text> 
<subparagraph id="H74FB0C8E24E14D48AE5B8795273633B3"><enum>(A)</enum><text>identify primary and secondary sources of information to support the measurement of the performance indicators identified under this section;</text></subparagraph> 
<subparagraph id="H9DF4D802EBDA4DB680C206E21CFCD7D5"><enum>(B)</enum><text>identify sources and methods of data collection in support of performance measurement required under this section;</text></subparagraph> 
<subparagraph id="HE503C0BCCBFB4ADF8947B6538D87956"><enum>(C)</enum><text>provide to all grantees technical assistance and training on performance measures and data collection for purposes of this section; and</text></subparagraph> 
<subparagraph id="H245734874F2A4226AF95D768099089E1"><enum>(D)</enum><text>consult with the Substance Abuse and Mental Health Services Administration and the National Institute on Drug Abuse on strategic performance outcome measures and data collection for purposes of this section relating to substance abuse and mental health.</text></subparagraph></paragraph> 
<paragraph id="H73C1B478FF554CE0AB9E29335F6B1392"><enum>(2)</enum><header>Coordination</header><text>The Attorney General shall coordinate with other Federal agencies to identify national and other sources of information to support performance measurement of grantees.</text></paragraph> 
<paragraph id="HB03C335E3C964226A8ED131F6CB2AD98"><enum>(3)</enum><header>Standards for analysis</header><text>Any statistical analysis of population data conducted pursuant to this section shall be conducted in accordance with the Federal Register Notice dated October 30, 1997, relating to classification standards.</text></paragraph></subsection> 
<subsection id="HEB3E8DC142DB458C96026E3EFE9208EA"><enum>(l)</enum><header>Future eligibility</header><text>To be eligible to receive a grant under this section in any fiscal year after the fiscal year in which a grantee receives a grant under this section, a grantee shall submit to the Attorney General such information as is necessary to demonstrate that—</text> 
<paragraph id="H56A0CE88DA2B4C3B8D7408F42039E219"><enum>(1)</enum><text>the grantee has adopted a reentry plan that reflects input from nonprofit organizations, in any case where relevant input is available and appropriate to the grant application;</text></paragraph> 
<paragraph id="HBE2ADDB226374CB39B3C27BC9B9D40D8"><enum>(2)</enum><text>the reentry plan of the grantee includes performance measures to assess the progress of the grantee toward increasing public safety by reducing the rate at which individuals released from prisons, jails, or juvenile facilities who participate in the reentry system supported by Federal funds are recommitted to prisons, jails, or juvenile facilities; and</text></paragraph> 
<paragraph id="H52973254B1614F4B831659A1C42BC6EA"><enum>(3)</enum><text>the grantee will coordinate with the Attorney General, nonprofit organizations (if relevant input from nonprofit organizations is available and appropriate), and other experts regarding the selection and implementation of the performance measures described in subsection (k).</text></paragraph></subsection> 
<subsection id="H865DE550951F4D60B31F22DDB58CEB71"><enum>(m)</enum><header>National adult and juvenile offender reentry resource center</header> 
<paragraph id="H7037502AB7B3495EBEA500A5A89E9F22"><enum>(1)</enum><header>Authority</header><text>The Attorney General may, using amounts made available to carry out this subsection, make a grant to an eligible organization to provide for the establishment of a National Adult and Juvenile Offender Reentry Resource Center.</text></paragraph> 
<paragraph id="H64674F2F15EC4F29B0CDCFC0570349AA"><enum>(2)</enum><header>Eligible organization</header><text display-inline="yes-display-inline">An organization eligible for the grant under paragraph (1) is any national nonprofit organization approved by the Interagency Task Force on Federal Programs and Activities Relating to the Reentry of Offenders Into the Community, that provides technical assistance and training to, and has special expertise and broad, national-level experience in, offender reentry programs, training, and research.</text></paragraph> 
<paragraph id="HF1DD2C746AE24791A1F4AED417698DE5"><enum>(3)</enum><header>Use of funds</header><text>The organization receiving the grant under paragraph (1) shall establish a National Adult and Juvenile Offender Reentry Resource Center to—</text> 
<subparagraph id="H154FBDCD82CD4FEA97AC27AF0013EC57"><enum>(A)</enum><text>provide education, training, and technical assistance for States, tribes, territories, local governments, service providers, nonprofit organizations, and corrections institutions;</text></subparagraph> 
<subparagraph id="HA61ED21902054ED680C37300BEB01160"><enum>(B)</enum><text>collect data and best practices in offender reentry from demonstration grantees and others agencies and organizations;</text></subparagraph> 
<subparagraph id="HC6DAD3D0E7BD45C1B2A9938B9157F052"><enum>(C)</enum><text>develop and disseminate evaluation tools, mechanisms, and measures to better assess and document coalition performance measures and outcomes;</text></subparagraph> 
<subparagraph id="H88EFBF6B5073470D9DC48E5163D81218"><enum>(D)</enum><text>disseminate information to States and other relevant entities about best practices, policy standards, and research findings;</text></subparagraph> 
<subparagraph id="H6AF7D61117E246F691285B2F00F30060"><enum>(E)</enum><text>develop and implement procedures to assist relevant authorities in determining when release is appropriate and in the use of data to inform the release decision;</text></subparagraph> 
<subparagraph id="H8722E1EF9C82480CB2678C61BCF0541F"><enum>(F)</enum><text>develop and implement procedures to identify efficiently and effectively those violators of probation, parole, or supervision following release from prison, jail, or a juvenile facility who should be returned to prisons, jails, or juvenile facilities and those who should receive other penalties based on defined, graduated sanctions;</text></subparagraph> 
<subparagraph id="H4EE0DD0DEC9A4AEA996100ADA5A30051"><enum>(G)</enum><text display-inline="yes-display-inline">collaborate with the Interagency Task Force on Federal Programs and Activities Relating to the Reentry of Offenders Into the Community, and the Federal Resource Center for Children of Prisoners;</text></subparagraph> 
<subparagraph id="H4C718760F5384AA4AFDAF9D717A354B"><enum>(H)</enum><text>develop a national reentry research agenda;</text></subparagraph> 
<subparagraph id="HE4365590ADC943388360A23E6630BDAC"><enum>(I)</enum><text>bridge the gap between reentry research and practice by translating knowledge from research into practical information; and</text></subparagraph> 
<subparagraph id="H4ABCE01AD59C427F00DEFFEE28EFFA6"><enum>(J)</enum><text>establish a database to enhance the availability of information that will assist offenders in areas such as housing, employment, counseling, mentoring, medical and mental health services, substance abuse treatment, transportation, and daily living skills.</text></subparagraph></paragraph> 
<paragraph id="H08E765BEDC88484F8EA0296B83FC7600"><enum>(4)</enum><header>Limit</header><text>Of amounts made available to carry out this section, not more than 4 percent shall be available to carry out this subsection.</text></paragraph></subsection> 
<subsection id="HD9B88F946B864DBCBD734D15F3DD8B7"><enum>(n)</enum><header>Administration</header><text>Of amounts made available to carry out this section—</text> 
<paragraph id="H23D920A01F8849FD8290936265DCC7F7"><enum>(1)</enum><text>not more than 2 percent shall be available for administrative expenses in carrying out this section; and</text></paragraph> 
<paragraph id="HA32734DA920D44BA82B91263F46843E6"><enum>(2)</enum><text>not more than 2 percent shall be made available to the National Institute of Justice to evaluate the effectiveness of the demonstration projects funded under this section, using a methodology that—</text> 
<subparagraph id="H797D5C157CDD49A5A2004C52114DF6B2"><enum>(A)</enum><text>includes, to the maximum extent feasible, random assignment of offenders (or entities working with such persons) to program delivery and control groups; and</text></subparagraph> 
<subparagraph id="H1642D9B0C2864D98AE46D56B7BDC15A5"><enum>(B)</enum><text>generates evidence on which reentry approaches and strategies are most effective.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H390DF793F7C34FF7A15FC723E456AFBC"><enum>(d)</enum><header>Grant authorization</header><text>Section 2976(a) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3797w">42 U.S.C. 3797w(a)</external-xref>) is amended by striking <quote>States, Territories</quote> and all that follows through the period at the end and inserting the following: <quote>States, local governments, territories, or Indian tribes, or any combination thereof, in partnership with stakeholders, service providers, and nonprofit organizations.</quote>.</text></subsection> 
<subsection id="H29B431B4F9D14761829D695382D5FC19"><enum>(e)</enum><header>Authorization of appropriations</header><text>Section 2976(o) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3797w">42 U.S.C. 3797w</external-xref>), as so redesignated by subsection (c) of this section, is amended—</text> 
<paragraph id="H987D19ED25D4440800102295E308A5C8"><enum>(1)</enum><text>in paragraph (1), by striking <quote>$15,000,000 for fiscal year 2003</quote> and all that follows and inserting <quote>$65,000,000 for fiscal year 2008, and $65,000,000 for fiscal year 2009.</quote>; and</text></paragraph>

<subsection id="H82091C06BFE1469B8BBC93FC42691003"><enum>(b)</enum><header>Definition</header><text>Section 1904(d) of the <act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets Act of 1968</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3796ff-3">42 U.S.C. 3796ff–3(d)</external-xref>) is amended to read as follows:</text>

<subsection id="H0DD6948E2B5840A6A8F78E69139203D5"><enum>(d)</enum><header>Residential substance abuse treatment program defined</header><text display-inline="yes-display-inline">In this part, the term <term>residential substance abuse treatment program</term> means a course of comprehensive individual and group substance abuse treatment services, lasting a period of at least 6 months, in residential treatment facilities set apart from the general population of a prison or jail, which may include the use of pharmacological treatment, where appropriate, that may extend beyond such period.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H850F7E5E0A9B460CA2D75639F1979480"><enum>(c)</enum><header>Requirement for Study and report on aftercare services</header><text>The Attorney General, through the National Institute of Justice, and in consultation with the National Institute on Drug Abuse, shall conduct a study on the use and effectiveness of funds used by the Department of Justice for aftercare services under section 1902(c) of the Omnibus Crime Control and Safe Streets Act of 1968, as amended by subsection (a) of this section, for offenders who reenter the community after completing a substance abuse program in prison or jail.</text></subsection></section></subtitle> 
<subtitle id="H8C96E5CAA3DC45EFAEF09E22239DDB2C"><enum>B</enum><header>New and Innovative Programs to Improve Offender Reentry Services</header> 
<section id="HC331035268B846C9BAB5E7216D3ECC4" display-inline="no-display-inline" section-type="subsequent-section"><enum>111.</enum><header>State and local reentry courts</header> 
<subsection id="HBE002E1FC2B24F8AA1DD2CB6FAB2E029"><enum>(a)</enum><header>In general</header><text>Part FF of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3797w">42 U.S.C. 3797w et seq.</external-xref>), as amended by section 101, is further amended by inserting at the end the following:</text> 
<quoted-block style="OLC" id="H6DC8A5A66AF14F40A3234385663E76B6" display-inline="no-display-inline"> 
<section id="HC63F590D71E740C1AB185BA283DA7F"><enum>2978.</enum><header>State and local reentry courts</header> 
<subsection id="HE0A386841E4E44D6B1B300635558B7F1"><enum>(a)</enum><header>Grants authorized</header><text>The Attorney General shall award grants, in accordance with this section, of not more than $500,000 to—</text> 
<paragraph id="H0011FAED605149BDB75CD7D2D116131E"><enum>(1)</enum><text>State and local courts; and</text></paragraph> 
<paragraph id="H866D7A89784F40DBAEC569C03262F2ED"><enum>(2)</enum><text>State agencies, municipalities, public agencies, nonprofit organizations, territories, and Indian tribes that have agreements with courts to take the lead in establishing a reentry court (as described in section 2976(b)(19)).</text></paragraph></subsection> 
<subsection id="HC6DCC82328E84830AC951E5DE7BCEDF9"><enum>(b)</enum><header>Use of grant funds</header><text>Grant funds awarded under this section shall be administered in accordance with such guidelines, regulations, and procedures as promulgated by the Attorney General, and may be used to—</text> 
<paragraph id="HDE12A1A23B7548C2007C003F0610B3EC"><enum>(1)</enum><text>monitor juvenile and adult offenders returning to the community;</text></paragraph> 
<paragraph id="H770331A29705486FA911EDDA301FF967"><enum>(2)</enum><text display-inline="yes-display-inline">provide juvenile and adult offenders returning to the community with coordinated and comprehensive reentry services and programs such as—</text> 
<subparagraph id="H4CA75FF35D6D42C6A98800DC30148D1"><enum>(A)</enum><text>drug and alcohol testing and assessment for treatment;</text></subparagraph> 
<subparagraph id="H404624C5C2FD47CCABB3F552AB7CB6BF"><enum>(B)</enum><text display-inline="yes-display-inline">assessment for substance abuse from a substance abuse professional who is approved by the State and licensed by the appropriate entity to provide alcohol and drug addiction treatment, as appropriate;</text></subparagraph> 
<subparagraph id="H6DA3AD8B9D4245EA9F62E9A9481DE42"><enum>(C)</enum><text>substance abuse treatment from a provider that is approved by the State, and licensed, if necessary, to provide medical and other health services;</text></subparagraph> 
<subparagraph id="HEFB5CA6B10D34D188B966FAA02CACEFC"><enum>(D)</enum><text>health (including mental health) services and assessment;</text></subparagraph> 
<subparagraph id="HF6BF5487B1A3436A8047A66868B35BB3"><enum>(E)</enum><text>aftercare and case management services that—</text> 
<clause id="H04903126239940FE99B1D5871D41A477"><enum>(i)</enum><text>facilitate access to clinical care and related health services; and</text></clause> 
<clause id="HF9C681BEFDC34EE6AF1103295F046B94"><enum>(ii)</enum><text>coordinate with such clinical care and related health services; and</text></clause></subparagraph> 
<subparagraph id="H4FBD9F3B25294057B320FDB82D96E999"><enum>(F)</enum><text>any other services needed for reentry;</text></subparagraph></paragraph> 
<paragraph id="H8B8003E394584D59BE5EF5B9D354267B"><enum>(3)</enum><text>convene community impact panels, victim impact panels, or victim impact educational classes;</text></paragraph> 
<paragraph id="HAF0796CD761B45C08896CC9E13CC101"><enum>(4)</enum><text>provide and coordinate the delivery of community services to juvenile and adult offenders, including—</text> 
<subparagraph id="HDB63906CC9CF4366BBDEB0045230054"><enum>(A)</enum><text>housing assistance;</text></subparagraph> 
<subparagraph id="H05385081F3BB4498A5FD03B1AF8DCA65"><enum>(B)</enum><text>education;</text></subparagraph> 
<subparagraph id="H13B34B92B92744FD8E79ABB8F7D5D520"><enum>(C)</enum><text>employment training;</text></subparagraph> 
<subparagraph id="H1F035206977B43A090B1DDBB5FC3825"><enum>(D)</enum><text>conflict resolution skills training;</text></subparagraph> 
<subparagraph id="H826DBED212694AA3AF4360CD9B037008"><enum>(E)</enum><text>batterer intervention programs; and</text></subparagraph> 
<subparagraph id="HAAB5D13A720C4E728026FCC714CBC6D"><enum>(F)</enum><text>other appropriate social services; and</text></subparagraph></paragraph> 
<paragraph id="HA10C19226ED0448C87FB2453458FFC57"><enum>(5)</enum><text>establish and implement graduated sanctions and incentives.</text></paragraph></subsection> 
<subsection id="H4EB0E0E17EC045B98222DB3103EE010"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed as preventing a grantee that operates a drug court under part EE at the time a grant is awarded under this section from using funds from such grant to supplement the drug court under part EE in accordance with paragraphs (1) through (5) of subsection (b).</text></subsection> 
<subsection id="H6F25F9C803BE445CB3D17B02ECCEFA4"><enum>(d)</enum><header>Application</header><text>To be eligible for a grant under this section, an entity described in subsection (a) shall, in addition to any other requirements required by the Attorney General, submit to the Attorney General an application that—</text> 
<paragraph id="HDCA433AC271B40CF995864038EBD954D"><enum>(1)</enum><text>describes the program to be assisted under this section and the need for such program;</text></paragraph> 
<paragraph id="H3936A7A48C394BBABD139D35BA941713"><enum>(2)</enum><text>describes a long-term strategy and detailed implementation plan for such program, including how the entity plans to pay for the program after the Federal funding ends;</text></paragraph> 
<paragraph id="HD31AC19411EB48E78353CF444E705712"><enum>(3)</enum><text>identifies the governmental and community agencies that will be coordinated by the project;</text></paragraph> 
<paragraph id="H2DE27644DC5640DFA100B13578BFF533"><enum>(4)</enum><text>certifies that—</text> 
<subparagraph id="H83639BF790CF4EA1AE198583562D308D"><enum>(A)</enum><text>all agencies affected by the program, including existing community corrections and parole entities, have been appropriately consulted in the development of the program;</text></subparagraph> 
<subparagraph id="H5F3B2D1C7CDF425D001FC920667C9C3E"><enum>(B)</enum><text>there will be appropriate coordination with all such agencies in the implementation of the program; and</text></subparagraph> 
<subparagraph id="H0C106F857D354287B1DD52E64F03E57C"><enum>(C)</enum><text>there will be appropriate coordination and consultation with the Single State Authority for Substance Abuse (as defined in section 201(e) of the Second Chance Act of 2007) of the State; and</text></subparagraph></paragraph> 
<paragraph id="H64BDB7357FF643A2001C4493A300BE6E"><enum>(5)</enum><text>describes the methodology and outcome measures that will be used to evaluate the program.</text></paragraph></subsection> 
<subsection id="H8750016D060346D4AD30DE646CC4829"><enum>(e)</enum><header>Matching requirements</header><text>The Federal share of a grant under this section may not exceed 75 percent of the costs of the project assisted by such grant unless the Attorney General—</text> 
<paragraph id="HFAE803981EC242749F4711C569B8084D"><enum>(1)</enum><text>waives, wholly or in part, the matching requirement under this subsection; and</text></paragraph> 
<paragraph id="H3B284C13903F46489C2C83A02ED5E37C"><enum>(2)</enum><text>publicly delineates the rationale for the waiver.</text></paragraph></subsection> 
<subsection id="H0F47F51A7A254C849F86004984BCFA78"><enum>(f)</enum><header>Annual report</header><text>Each entity receiving a grant under this section shall submit to the Attorney General, for each fiscal year in which funds from the grant are expended, a report, at such time and in such manner as the Attorney General may reasonably require, that contains—</text> 
<paragraph id="H201C7F68ED364E8E9047DD6500A6E84D"><enum>(1)</enum><text>a summary of the activities carried out under the program assisted by the grant;</text></paragraph> 
<paragraph id="HD65A466B6220486DA9A0C87BA0FF9B74"><enum>(2)</enum><text>an assessment of whether the activities are meeting the need for the program identified in the application submitted under subsection (d); and</text></paragraph> 
<paragraph id="HC164954D5FD342F389BE3D5E7D158B9C"><enum>(3)</enum><text>such other information as the Attorney General may require.</text></paragraph></subsection> 
<subsection id="H6A84A68A096241E7BE9F8907A6E125E9"><enum>(g)</enum><header>Authorization of Appropriations</header> 
<paragraph id="HC5E3A56F48654F3DA5A3B3D8B5A1DA39"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated $10,000,000 for each of fiscal years 2008 and 2009 to carry out this section.</text></paragraph> 
<paragraph id="HBA3A881064BB4CA6BCE8C2CDB5CB74B3"><enum>(2)</enum><header>Limitations</header><text>Of the amount made available to carry out this section in any fiscal year—</text> 
<subparagraph id="HDE2E245074CA4A99A6EFF97C46E1D488"><enum>(A)</enum><text>not more than 2 percent may be used by the Attorney General for salaries and administrative expenses; and</text></subparagraph> 
<subparagraph id="H93E5F70B16A046B5A8A866148C90C838"><enum>(B)</enum><text>not more than 5 percent nor less than 2 percent may be used for technical assistance and training.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HB5BE4007519A4FC9B35FE0F8CB55F100"><enum>112.</enum><header>Grants for comprehensive and continuous offender reentry task forces</header><text display-inline="no-display-inline">Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3711">42 U.S.C. 3711 et seq.</external-xref>) is further amended by inserting after part BB the following new part:</text>

<part id="H549FF5AD7FC248CC841B7978ADC5CF4D"><enum>CC</enum><header>Grants for comprehensive and continuous offender reentry task forces</header> 
<section id="H4FDA318BE5BB4EB0A3F386402C545BCD"><enum>2901.</enum><header>Authorization</header><text display-inline="no-display-inline">The Attorney General shall carry out a grant program under which the Attorney General makes grants to States, units of local government, territories, Indian tribes, and other public and private entities for the purpose of establishing and administering task forces (to be known as <quote>Comprehensive and Continuous Offender Reentry Task Forces</quote>), in accordance with this part.</text></section> 
<section id="H66DAB5339D674D43865B105DE1C0443"><enum>2902.</enum><header>Comprehensive and Continuous Offender Reentry Task Forces</header> 
<subsection id="HC9D39EBBB71146F7AA7D53F3C04D9533"><enum>(a)</enum><header>In general</header><text>For purposes of this part, a Comprehensive and Continuous Offender Reentry Task Force is a planning group of a State, unit of local government, territory, or Indian tribe that—</text> 
<paragraph id="HD8C12D79F3034BBBACE3D610028CC43"><enum>(1)</enum><text>develops a community reentry plan, described in <internal-xref idref="HE27E9710E31441F6B49DE800D11518B9" legis-path="2903.">section 2903</internal-xref>, for each juvenile and adult offender to be released from a correctional facility in the applicable jurisdiction;</text></paragraph> 
<paragraph id="H021313ECE16446F5BD0021ED878C387F"><enum>(2)</enum><text>supervises and assesses the progress of each such offender, with respect to such plan, starting on a date before the offender is released from a correctional facility and ending on the date on which the court supervision of such offender ends;</text></paragraph> 
<paragraph id="H19DB28CB7D9A42A9BAE9BF394FCC2D03"><enum>(3)</enum><text display-inline="yes-display-inline">conducts a detailed assessment of the needs of each offender to address employment training, medical care, drug treatment, education, and any other identified need of the offender to assist in the offender’s reentry;</text></paragraph> 
<paragraph id="H5A28D0AFECE04AA1A70796BC3928D67C"><enum>(4)</enum><text>demonstrates affirmative steps to implement such a community reentry plan by consulting and coordinating with other public and nonprofit entities, as appropriate;</text></paragraph> 
<paragraph id="HB8EB081BBCCB437AB577000093056804"><enum>(5)</enum><text display-inline="yes-display-inline">establishes appropriate measurements for determining the efficacy of such community reentry plans by monitoring offender performance under such reentry plans;</text></paragraph> 
<paragraph id="HFA15B92B26A048F4B9F5AC4109ABB647"><enum>(6)</enum><text display-inline="yes-display-inline">complies with applicable State, local, territorial, and tribal rules and regulations regarding the provision of applicable services and treatment in the applicable jurisdiction; and</text></paragraph> 
<paragraph id="H027B16E58723473297301FB6CED4694F"><enum>(7)</enum><text>consults and coordinates with the Single State Authority for Substance Abuse (as defined in section 201(e) of the Second Chance Act of 2007) and the criminal justice agencies of the State to ensure that offender reentry plans are coordinated and delivered in the most cost-effective manner, as determined by the Attorney General, in consultation with the grantee.</text></paragraph></subsection> 
<subsection id="HAB2D0AB77B8E477BB7AB1E347090FFBF"><enum>(b)</enum><header>Consultation required</header><text display-inline="yes-display-inline">A Comprehensive and Continuous Offender Reentry Task Force for a county or other defined geographic area shall perform the duties described in paragraphs (1) and (2) of <internal-xref idref="HC9D39EBBB71146F7AA7D53F3C04D9533" legis-path="2902.(a)">subsection (a)</internal-xref> in consultation with representatives of—</text> 
<paragraph id="H9FD152733F2644CE9B2BF7ECD27EF61"><enum>(1)</enum><text>the criminal and juvenile justice and correctional facilities within the county or area;</text></paragraph> 
<paragraph id="H66B3B08EB4384E4E9519A1F6F5CBD69"><enum>(2)</enum><text>the community health care services of the county or area;</text></paragraph> 
<paragraph id="HFDD1A7066B1045E189F42851B546F36D"><enum>(3)</enum><text>the drug treatment programs of the county or area;</text></paragraph> 
<paragraph id="H74B74129FED74EB9BC794E95B51831C5"><enum>(4)</enum><text>the employment opportunities available in the county or area;</text></paragraph> 
<paragraph id="HE7973B4142F84455809EE5C0107FA4F3"><enum>(5)</enum><text>housing opportunities available in the county or area; and</text></paragraph> 
<paragraph id="H9DA556E888E045B79841BBF44EF82414"><enum>(6)</enum><text>any other appropriate community services available in the county or area.</text></paragraph></subsection></section> 
<section id="HE27E9710E31441F6B49DE800D11518B9"><enum>2903.</enum><header>Community reentry plan described</header><text display-inline="no-display-inline">For purposes of <internal-xref idref="HD8C12D79F3034BBBACE3D610028CC43" legis-path="2902.(a)(1)">section 2902(a)(1)</internal-xref>, a community reentry plan for an offender is a plan relating to the reentry of the offender into the community and, according to the needs of the offender, shall—</text> 
<paragraph id="HCA3547187C22435DB606CBC3662698CD"><enum>(1)</enum><text>identify employment opportunities and goals;</text></paragraph> 
<paragraph id="HED97739A3EAC4E4000F9E3A34B437B61"><enum>(2)</enum><text>identify housing opportunities;</text></paragraph> 
<paragraph id="H5DF670EF0DB14FD8A0C921939EB8E956"><enum>(3)</enum><text>provide for any needed drug treatment;</text></paragraph> 
<paragraph id="H8E338C124A494611A7FE9B883476CDA2"><enum>(4)</enum><text>provide for any needed mental health services;</text></paragraph> 
<paragraph id="H6DC3C96BA8B34D6A9500192C3CA2CD5D"><enum>(5)</enum><text>provide for any needed health care services;</text></paragraph> 
<paragraph id="H758F1CC14DE84DF8B642195B8DA7D414"><enum>(6)</enum><text>provide for any needed family counseling;</text></paragraph> 
<paragraph id="H3E32FD20F89542F3B392EA89BF0034D0"><enum>(7)</enum><text>provide for offender case management programs or services; and</text></paragraph> 
<paragraph id="H2E2A18BA90B94AEB8458742B5B7F3150"><enum>(8)</enum><text>provide for any other service specified by the Comprehensive and Continuous Offender Reentry Task Force as necessary for the offender.</text></paragraph></section> 
<section id="H1CA6567A79364C75B3D51F8C514C18FA"><enum>2904.</enum><header>Application</header><text display-inline="no-display-inline">To be eligible for a grant under this part, a State or other relevant entity shall submit to the Attorney General an application in such form and manner and at such time as the Attorney General specifies. Such application shall contain such information as the Attorney General specifies.</text></section> 
<section id="H2890EFAE860D4C848087D7FF76B5843F"><enum>2905.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this part shall be construed as supplanting or modifying a sentence imposed by a court, including any terms of supervision.</text></section> 
<section id="H6FFF182F0DF14294B19E2BC8FA667500"><enum>2906.</enum><header>Reports</header><text display-inline="no-display-inline">An entity that receives funds under this part for a Comprehensive and Continuous Offender Reentry Task Force during a fiscal year shall submit to the Attorney General, not later than a date specified by the Attorney General, a report that describes and evaluates the effectiveness of such Task Force during such fiscal year.</text></section> 
<section id="H4C455060FE2C4F9FA8C09CBED8167CC"><enum>2907.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated $10,000,000 to carry out this section for each of fiscal years 2008 and 2009.</text></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H27A66208CB224D3AB02DC2FAAC20F563" display-inline="no-display-inline" section-type="subsequent-section"><enum>113.</enum><header>Prosecution drug treatment alternative to prison programs</header> 
<subsection id="HB3C84F1E1D564E5AA94DD90597F559D"><enum>(a)</enum><header>Authorization</header><text>Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3711">42 U.S.C. 3711 et seq.</external-xref>), as amended by <internal-xref idref="HB5BE4007519A4FC9B35FE0F8CB55F100" legis-path="112.">section 112</internal-xref> of this Act, is further amended by inserting after section 2907 the following new part:</text>

<part id="H31C61F8C04F94ADFA88DA3F23131F0EA"><enum>DD</enum><header>Prosecution drug treatment alternative to prison programs</header> 
<section id="H4A591CDB03184FA88974AF4F50B8D9DE"><enum>2911.</enum><header>Grant authority</header> 
<subsection id="H8B60A1F75A094C6D9107F3E37FFEF6E9"><enum>(a)</enum><header>In general</header><text>The Attorney General may make grants to State and local prosecutors to develop, implement, or expand qualified drug treatment programs that are alternatives to imprisonment, in accordance with this section.</text></subsection> 
<subsection id="H567A6681CA4C4547A3664628E9149426" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Qualified drug treatment programs described</header><text>For purposes of this part, a qualified drug treatment program is a program—</text> 
<paragraph id="H7E5486B0E3774E22B1F85C82007DDB90" commented="no"><enum>(1)</enum><text>that is administered by a State or local prosecutor;</text></paragraph> 
<paragraph id="H4CFF5F2BCCE04ECF9889DDB77DC4F4F4" commented="no"><enum>(2)</enum><text>that requires an eligible offender who is sentenced to participate in the program (instead of incarceration) to participate in a comprehensive substance abuse treatment program that is approved by the State and licensed, if necessary, to provide medical and other health services;</text></paragraph> 
<paragraph id="HDC910225584143FDB435D9AFEC328766" commented="no"><enum>(3)</enum><text>that requires an eligible offender to receive the consent of the State or local prosecutor involved to participate in such program;</text></paragraph> 
<paragraph id="H47F17B2494F34F7289F2AF1C8C234D7F" commented="no"><enum>(4)</enum><text>that, in the case of an eligible offender who is sentenced to participate in the program, requires the offender to serve a sentence of imprisonment with respect to the crime involved if the prosecutor, in conjunction with the treatment provider, determines that the offender has not successfully completed the relevant substance abuse treatment program described in paragraph (2);</text></paragraph> 
<paragraph id="H0FA4A6CA323E4035B66F411385633D6C" commented="no"><enum>(5)</enum><text>that provides for the dismissal of the criminal charges involved in an eligible offender’s participation in the program if the offender is determined to have successfully completed the program;</text></paragraph> 
<paragraph id="HC7F85882ACD34676A1D2911FC8522C32" commented="no"><enum>(6)</enum><text>that requires each substance abuse provider treating an eligible offender under the program to—</text> 
<subparagraph id="H13756A2F023C44298C60D3585C9D05AA" commented="no"><enum>(A)</enum><text>make periodic reports of the progress of the treatment of that offender to the State or local prosecutor involved and to the appropriate court in which the defendant was convicted; and</text></subparagraph> 
<subparagraph id="H56412528034E4040A349F67CFE87C2D9" commented="no"><enum>(B)</enum><text>notify such prosecutor and such court if the offender absconds from the facility of the treatment provider or otherwise violates the terms and conditions of the program, consistent with Federal and State confidentiality requirements; and</text></subparagraph></paragraph> 
<paragraph id="HE23B4A88BCDB4DD79D52B2BEF0B54CE8" commented="no"><enum>(7)</enum><text>that has an enforcement unit comprised of law enforcement officers under the supervision of the State or local prosecutor involved, the duties of which shall include verifying an offender’s addresses and other contacts, and, if necessary, locating, apprehending, and arresting an offender who has absconded from the facility of a substance abuse treatment provider or otherwise violated the terms and conditions of the program, consistent with Federal and State confidentiality requirements, and returning such offender to court for sentencing for the crime involved.</text></paragraph></subsection></section> 
<section id="HB29002DCA4364A9AAC577FEB2BD2948C" commented="no"><enum>2912.</enum><header>Use of grant funds</header> 
<subsection id="H8EA622BB807C417C8DAF174D6935625D" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A State or local prosecutor who receives a grant under this part shall use such grant for expenses of a qualified drug treatment program, including for the following expenses:</text> 
<paragraph id="HFF8EF473AC984E3B9333EE8FDBEB2D39" commented="no"><enum>(1)</enum><text>Salaries, personnel costs, equipment costs, and other costs directly related to the operation of the program, including the enforcement unit.</text></paragraph> 
<paragraph id="H55172BB5E28C44260066EBDC9988D06C" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Payments for substance abuse treatment providers that are approved by the State and licensed, if necessary, to provide alcohol and drug addiction treatment to eligible offenders participating in the program, including aftercare supervision, vocational training, education, and job placement.</text></paragraph> 
<paragraph id="H22AEA166C51C41E6A4DDD1556D1B9B63" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Payments to public and nonprofit private entities that are approved by the State and licensed, if necessary, to provide alcohol and drug addiction treatment to offenders participating in the program.</text></paragraph></subsection> 
<subsection id="H3F62416620CD4C81BD22001B082C6C7E" display-inline="no-display-inline"><enum>(b)</enum><header>Supplement and not supplant</header><text>Grants made under this part shall be used to supplement, and not supplant, non-Federal funds that would otherwise be available for programs described in such subsection.</text></subsection></section> 
<section id="H1D977D9404DE47A9B2BDC098079201E"><enum>2913.</enum><header>Applications</header><text display-inline="no-display-inline">To request a grant under this part, a State or local prosecutor shall submit an application to the Attorney General in such form and containing such information as the Attorney General may reasonably require. Each such application shall contain the certification of the State or local prosecutor that the program for which the grant is requested is a qualified drug treatment program in accordance with this part.</text></section> 
<section id="HCC7EE84A8F1E4A56977FFEB409794BA0"><enum>2914.</enum><header>Federal share</header><text display-inline="no-display-inline">The Federal share of a grant made under this part shall not exceed 75 percent of the total costs of the qualified drug treatment program funded by such grant for the fiscal year for which the program receives assistance under this part.</text></section> 
<section id="H67E5910B6DB04CECA1BB3743628958D3"><enum>2915.</enum><header>Geographic distribution</header><text display-inline="no-display-inline">The Attorney General shall ensure that, to the extent practicable, the distribution of grants under this part is equitable and includes State or local prosecutors—</text> 
<paragraph id="H44DB805135C24069A8B532F300874083"><enum>(1)</enum><text>in each State; and</text></paragraph> 
<paragraph id="HEAD4D0CFC5BF4AC7A4BE18CA6893ECA0"><enum>(2)</enum><text>in rural, suburban, and urban jurisdictions.</text></paragraph></section> 
<section id="H732E6F7E7F0F451AA8AA11FD3B6B95E"><enum>2916.</enum><header>Reports and evaluations</header><text display-inline="no-display-inline">For each fiscal year, each recipient of a grant under this part during such fiscal year shall submit to the Attorney General a report with respect to the effectiveness of activities carried out using that grant. Each report shall include an evaluation in such form and containing such information as the Attorney General may reasonably require. The Attorney General shall specify the dates on which such reports shall be submitted.</text></section> 
<section id="H23BDFB17020A4CD9AD1CDBA383EB5F81"><enum>2917.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text> 
<paragraph id="H0C835E96D2BD410DB95D263DE0015435"><enum>(1)</enum><header>State or local prosecutor</header><text>The term <term>State or local prosecutor</term> means any district attorney, State attorney general, county attorney, or corporation counsel who has authority to prosecute criminal offenses under State or local law.</text></paragraph> 
<paragraph id="H2110A7D2E72A4EE196E0AE78166D4B20"><enum>(2)</enum><header>Eligible offender</header><text>The term <term>eligible offender</term> means an individual who—</text> 
<subparagraph id="H38B84618B0CE4BC29456A0FB00B2C697"><enum>(A)</enum><text>has been convicted, pled guilty, or admitted guilt with respect to a crime for which a sentence of imprisonment is required and has not completed such sentence;</text></subparagraph> 
<subparagraph id="HC0D439B334764B14B5D4BF78B6F2C1DA"><enum>(B)</enum><text>has never been charged with or convicted of an offense, during the course of which—</text> 
<clause id="H122306AD9E404638BF82F4CE8D229072"><enum>(i)</enum><text>the person carried, possessed, or used a firearm or dangerous weapon; or</text></clause> 
<clause id="H9F23E4DEA81040A39B647D898DA1BFA2"><enum>(ii)</enum><text>there occurred the use of force against the person of another, without regard to whether any of the behavior described in clause (i) or (ii) is an element of the offense or for which the person is charged or convicted;</text></clause></subparagraph> 
<subparagraph id="H457D113485C1407EB7DFDD9BCA088FFF"><enum>(C)</enum><text>does not have one or more prior convictions for a felony crime of violence involving the use or attempted use of force against a person with the intent to cause death or serious bodily harm; and</text></subparagraph> 
<subparagraph id="HBCEF0032DF06403F99BA0171AD705189"><enum>(D)</enum> 
<clause id="H066320BBB3F346CD8610FBD2D547CA30" display-inline="yes-display-inline"><enum>(i)</enum><text>has received an assessment for alcohol or drug addiction from a substance abuse professional who is approved by the State and licensed by the appropriate entity to provide alcohol and drug addiction treatment, as appropriate; and</text></clause> 
<clause id="H802F8436233B4A02000311E923E0E0C5" indent="up1"><enum>(ii)</enum><text>has been found to be in need of substance abuse treatment because that offender has a history of substance abuse that is a significant contributing factor to that offender’s criminal conduct.</text></clause></subparagraph></paragraph></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H147A711132334BC6A8FB00990220E288"><enum>(b)</enum><header>Authorization of appropriations</header><text>Section 1001(a) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3793">42 U.S.C. 3793(a)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<section id="H9BC350A3E00E4704A0919FFF1557EEE3" display-inline="no-display-inline" section-type="subsequent-section"><enum>114.</enum><header>Grants for family substance abuse treatment alternatives to incarceration</header><text display-inline="no-display-inline">Title I of the Omnibus Crime Control and Safe Streets Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3711">42 U.S.C. 3711 et seq.</external-xref>) is further amended by inserting after Part II the following new part:</text>

<section id="H3418690AD43C4C6F9D1C8542C99F378D"><enum>3001.</enum><header>Grants authorized</header><text display-inline="no-display-inline">The Attorney General may make grants to States, units of local government, territories, and Indian tribes to develop, implement, and expand comprehensive and clinically-appropriate family-based substance abuse treatment programs as alternatives to incarceration for nonviolent parent drug offenders.</text></section> 
<section id="H66BA78CA00C54B0CBE213900BFCD00E8"><enum>3002.</enum><header>Use of grant funds</header><text display-inline="no-display-inline">Grants made to an entity under <internal-xref idref="H3418690AD43C4C6F9D1C8542C99F378D" legis-path="3001.">section 3001</internal-xref> for a program described in such section may be used for the following:</text> 
<paragraph id="H0534F1515E3647CF80A010917C2E38AE"><enum>(1)</enum><text>Salaries, personnel costs, facility costs, and other costs directly related to the operation of the program.</text></paragraph> 
<paragraph id="HAA84EBC50FB9437288003950D73FCF3F"><enum>(2)</enum><text>Payments to providers of substance abuse treatment for providing treatment and case management to nonviolent parent drug offenders participating in the program, including comprehensive treatment for mental health disorders, parenting classes, educational classes, vocational training, and job placement.</text></paragraph> 
<paragraph id="H120A55F65C2A49C8AF1908103BC10418"><enum>(3)</enum><text display-inline="yes-display-inline">Payments to public and nonprofit private entities to provide substance abuse treatment to nonviolent parent drug offenders participating in the program.</text></paragraph></section> 
<section id="H7AE42B8ED60F4FAA95FCB563513BE19"><enum>3003.</enum><header>Program requirements</header><text display-inline="no-display-inline">A program for which a grant is made under <internal-xref idref="H3418690AD43C4C6F9D1C8542C99F378D" legis-path="3001.">section 3001</internal-xref> shall comply with the following requirements:</text> 
<paragraph id="H184A496161A446C6A3D103A1DBC23FF"><enum>(1)</enum><text display-inline="yes-display-inline">The program shall ensure that all providers of substance abuse treatment are approved by the State and are licensed, if necessary, to provide medical and other health services.</text></paragraph> 
<paragraph id="H4FC655957D6A499EA11B1468EE59FB45"><enum>(2)</enum><text display-inline="yes-display-inline">The program shall provide for appropriate coordination and consultation with the Single State Authority for Substance Abuse (as defined in section 201(e) of the Second Chance Act of 2007) of the State in which the program is located. </text></paragraph> 
<paragraph id="HAECCA8B53CA5487888B528683EB335BB"><enum>(3)</enum><text>The program shall consist of clinically-appropriate, comprehensive, and long-term family treatment, including the treatment of the nonviolent parent drug offender, the child of such offender, and any other appropriate member of the family of the offender.</text></paragraph> 
<paragraph id="H20F7F31D4F80484A937741CDCEAD2DAF"><enum>(4)</enum><text>The program shall be provided in a residential setting that is not a hospital setting or an intensive outpatient setting.</text></paragraph> 
<paragraph id="HB4E63079B98B4D7493DAE064F76EDA36"><enum>(5)</enum><text>The program shall provide that if a nonviolent parent drug offender who participates in the program does not successfully complete the program the offender shall serve an appropriate sentence of imprisonment with respect to the underlying crime involved.</text></paragraph> 
<paragraph id="HCF03CFF9FCD24E25937D61EDEF88579F" commented="no"><enum>(6)</enum><text display-inline="yes-display-inline">The program shall ensure that a determination is made as to whether or not a nonviolent drug offender has completed the substance abuse treatment program.</text></paragraph> 
<paragraph id="H51567D1F367A4DC993E878D6AFB5A451"><enum>(7)</enum><text>The program shall include the implementation of a system of graduated sanctions (including incentives) that are applied based on the accountability of the nonviolent parent drug offender involved throughout the course of the program to encourage compliance with the program.</text></paragraph> 
<paragraph id="H51A9A98CDE6640F6B5301E6CF9181FFC"><enum>(8)</enum><text display-inline="yes-display-inline">The program shall develop and implement a reentry plan for each nonviolent parent drug offender that shall include reinforcement strategies for family involvement as appropriate, relapse strategies, support groups, placement in transitional housing, and continued substance abuse treatment, as needed.</text></paragraph></section> 
<section id="HE26A14B6E6524C31BFB5368B9DBEEF12"><enum>3004.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text> 
<paragraph id="HAB5D5DCF77C24246975D47E611AC21AF"><enum>(1)</enum><header>Nonviolent parent drug offenders</header><text display-inline="yes-display-inline">The term <term>nonviolent parent drug offender</term> means an offender who is a parent of a minor and who is convicted of a drug (or drug-related) felony that is a nonviolent offense.</text></paragraph> 
<paragraph id="HE3B3B3ADF43C48D59543AAAAE27358D4"><enum>(2)</enum><header>Nonviolent offense</header><text>The term <term>nonviolent offense</term> has the meaning given such term under section 2991(a).</text></paragraph></section> 
<section id="H4177354FEB314F5A8554E7D664F0F1BF"><enum>3005.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this part $10,000,000 for each of fiscal years 2008 and 2009.</text></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H8394C1010E20450AB81F965FF131968"><enum>115.</enum><header>Prison-based family treatment programs for incarcerated parents of minor children</header><text display-inline="no-display-inline">Title I of the Omnibus Crime Control and Safe Streets Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3711">42 U.S.C. 3711 et seq.</external-xref>), is further amended—</text> 
<paragraph id="H3C515F2462E4468E8573D9E737B912FE"><enum>(1)</enum><text>by redesignating Part X at the end (relating to grants for sex offender apprehension and juvenile sex offender treatment) as Part KK; and</text></paragraph> 
<paragraph id="H9821C730D2ED4DBFBFE810BB30FCB9FA"><enum>(2)</enum><text>by adding at the end the following new part:</text>

<part id="HC4C70EEF891F4B58B97E8CD8A4130092"><enum>LL</enum><header>Prison-based family treatment programs for incarcerated parents of minor children</header> 
<section id="HC1B54237BC0A4C3500BC00C1666CE6D9"><enum>3021.</enum><header>Grants authorized</header><text display-inline="no-display-inline">The Attorney General may make grants to States, units of local government, territories, and Indian tribes to provide prison-based family treatment programs for incarcerated parents of minor children.</text></section> 
<section id="HB811A66E0CF44FC7A7D6CAD2DF806DEA"><enum>3022.</enum><header>Use of grant funds</header><text display-inline="no-display-inline">An entity that receives a grant under this part shall use amounts provided under the grant to—</text> 
<paragraph id="H3F3872481D10412F80D0DE99E28CFC4F"><enum>(1)</enum><text>develop, implement, and expand prison-based family treatment programs in correctional facilities for incarcerated parents with minor children, excluding from the programs those parents with respect to whom there is reasonable evidence of domestic violence or child abuse;</text></paragraph> 
<paragraph id="HF9A2936D7C714B51BE6D11ABB614994"><enum>(2)</enum><text display-inline="yes-display-inline">coordinate the design and implementation of such programs between appropriate correctional facility representatives, the Single State Authority for Substance Abuse (as defined in section 201(e) of the Second Chance Act of 2007), and other appropriate governmental agencies; and</text></paragraph> 
<paragraph id="H0413A24212DE4376AC3189CB1620518E"><enum>(3)</enum><text display-inline="yes-display-inline">develop and implement a pre-release assessment and a reentry plan for each incarcerated parent scheduled to be released to the community, and such plan shall include—</text> 
<subparagraph id="H10FBBC0E130D497D99E537DB008E1D69"><enum>(A)</enum><text>a treatment program for the incarcerated parent to receive continuous substance abuse treatment services and related support services, as needed;</text></subparagraph> 
<subparagraph id="H4EB9D7BE21904876BBC07B806F39DBA5"><enum>(B)</enum><text>a housing plan during transition from incarceration to reentry, as needed;</text></subparagraph> 
<subparagraph id="H48525A7BFDB4449D9E7B9DD05CB8E26F"><enum>(C)</enum><text>a vocational or employment plan, including training and job placement services; and</text></subparagraph> 
<subparagraph id="H602370925D4A4484A9B14FD8D153E904"><enum>(D)</enum><text>any other services necessary to provide successful reentry into the community.</text></subparagraph></paragraph></section> 
<section id="H695F552385AE4B1E8255D652AF530177"><enum>3023.</enum><header>Program requirements</header><text display-inline="no-display-inline">A prison-based family treatment program for incarcerated parents with respect to which a grant is made shall comply with the following requirements:</text> 
<paragraph id="HD48436E2EB304131BF03E1BD1C6CEDD3"><enum>(1)</enum><text>The program shall integrate techniques to assess the strengths and needs of immediate and extended family of the incarcerated parent to support a treatment plan of the incarcerated parent.</text></paragraph> 
<paragraph id="H696C0A034D98408BAC5BE496D638D7FA"><enum>(2)</enum><text>The program shall ensure that each participant in the program has access to consistent and uninterrupted care if transferred to a different correctional facility within the State or other relevant entity.</text></paragraph> 
<paragraph id="H737DD50964284705B297C62BFDE77760"><enum>(3)</enum><text display-inline="yes-display-inline">The program shall be located in an area separate from the general population of the prison or jail. </text></paragraph></section> 
<section id="H994BB457DE42433BAC2E8BB9005ECAFF"><enum>3024.</enum><header>Applications</header><text display-inline="no-display-inline">To be eligible for a grant under this part for a prison-based family treatment program, an entity described in <internal-xref idref="HC1B54237BC0A4C3500BC00C1666CE6D9" legis-path="3021.">section 3021</internal-xref> shall, in addition to any other requirement specified by the Attorney General, submit an application to the Attorney General in such form and manner and at such time as specified by the Attorney General. Such application shall include a description of the methods and measurements the entity will use for purposes of evaluating the program involved and such other information as the Attorney General may reasonably require.</text></section> 
<section id="H27EDE7433BE04EF3A2F229D8A0F0483E"><enum>3025.</enum><header>Reports</header><text display-inline="no-display-inline">An entity that receives a grant under this part for a prison-based family treatment program during a fiscal year shall submit to the Attorney General, not later than a date specified by the Attorney General, a report that describes and evaluates the effectiveness of such program during such fiscal year. Such evaluation shall be based on evidence-based data and shall use the methods and measurements described in the application of the entity for purposes of evaluating the program.</text></section> 
<section id="HC6273D8B3866418085F9B0BE627D8EF7"><enum>3026.</enum><header>Prison-based family treatment program defined</header><text display-inline="no-display-inline">In this part, the term <term>prison-based family treatment program</term> means a program for incarcerated parents in a correctional facility that provides a comprehensive response to offender needs, including substance abuse treatment, child early intervention services, family counseling, legal services, medical care, mental health services, nursery and preschool, parenting skills training, pediatric care, physical therapy, prenatal care, sexual abuse therapy, relapse prevention, transportation, and vocational or GED training.</text></section> 
<section id="H620FC6291CD84593A98E01B906FC00B0"><enum>3027.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this part $10,000,000 for each of fiscal years 2008 and 2009.</text></section></part><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>

<subsection id="H5D2455897F7346B49DAE8E47F7E2A5DD"><enum>(a)</enum><header>Grant program authorized</header><text display-inline="yes-display-inline">The Attorney General shall carry out a grant program under which the Attorney General makes grants to States, units of local government, territories, Indian tribes, and other public and private entities to—</text> 
<paragraph id="HF0D52E6AC5F448CA9752B40910A21B51"><enum>(1)</enum><text>evaluate methods to improve academic and vocational education for offenders in prisons, jails, and juvenile facilities; and</text></paragraph> 
<paragraph id="H2EF46B51FB6B44D39B281EA886B9A8E2"><enum>(2)</enum><text>identify, and make recommendations to the Attorney General regarding, best practices relating to academic and vocational education for offenders in prisons, jails, and juvenile facilities, based on the evaluation under <internal-xref idref="HF0D52E6AC5F448CA9752B40910A21B51" legis-path="3031.(a)(1)">paragraph (1)</internal-xref>.</text></paragraph></subsection> 
<subsection id="HE4CFE9F3A29640C68F063E452F03C8A6"><enum>(b)</enum><header>Application</header><text>To be eligible for a grant under this section, a State or other entity described in <internal-xref idref="H5D2455897F7346B49DAE8E47F7E2A5DD" legis-path="3031.(a)">subsection (a)</internal-xref> shall submit to the Attorney General an application in such form and manner and at such time as the Attorney General specifies. Such application shall contain such information as the Attorney General specifies.</text></subsection> 
<subsection id="H734570CA77174B51B504E75EB56D0392"><enum>(c)</enum><header>Report</header><text>Not later than 90 days after the last day of the final fiscal year for which an entity described in <internal-xref idref="H5D2455897F7346B49DAE8E47F7E2A5DD" legis-path="3031.(a)">subsection (a)</internal-xref> receives a grant under such subsection, such an entity shall submit to the Attorney General a detailed report of the aggregate findings and conclusions of the evaluation described in <internal-xref idref="H5D2455897F7346B49DAE8E47F7E2A5DD" legis-path="3031.(a)">subsection (a)(1)</internal-xref>, and the recommendations to the Attorney General described in <internal-xref idref="H2EF46B51FB6B44D39B281EA886B9A8E2" legis-path="3031.(a)(2)">subsection (a)(2)</internal-xref>.</text></subsection>

<subsection id="HD26DBD38E0E04135A2CFFD275D33E300"><enum>(b)</enum><header>Application</header><text>To be eligible for a grant under this section, an entity described in <internal-xref idref="H388A2831572A4F6DA59DCA68911068B6" legis-path="3032.(a)">subsection (a)</internal-xref> shall submit to the Attorney General an application in such form and manner and at such time as the Attorney General specifies. Such application shall contain such information as the Attorney General specifies.</text></subsection> 
<subsection id="HEE173059A6184BECB39C39FC3B593D49"><enum>(c)</enum><header>Reports</header><text>An entity that receives a grant under <internal-xref idref="H388A2831572A4F6DA59DCA68911068B6" legis-path="3032.(a)">subsection (a)</internal-xref> during a fiscal year shall, not later than the last day of the following fiscal year, submit to the Attorney General a report that describes and assesses the uses of such grant.</text></subsection>

<subtitle id="H080933E6E96844448F9FB0F335803225"><enum>A</enum><header>Drug treatment</header> 
<section id="H905155CC395D4C05ADBC43FF8F4F3E72" display-inline="no-display-inline"><enum>201.</enum><header>Grants for demonstration programs to reduce drug use and recidivism in long-term substance abusers</header> 
<subsection id="HAC1FC883C71A4760859C081D6F1EBA19"><enum>(a)</enum><header>Awards required</header><text display-inline="yes-display-inline">The Attorney General shall make competitive grants to eligible partnerships, in accordance with this section, for the purpose of establishing demonstration programs to reduce the use of alcohol and other drugs by supervised long-term substance abusers during the period in which each such long-term substance abuser is in prison, jail, or a juvenile facility, and until the completion of parole or court supervision of such abuser.</text></subsection> 
<subsection id="H5A2657158A83424693C04418868ECA6D"><enum>(b)</enum><header>Use of grant funds</header><text>A grant made under subsection (a) to an eligible partnership for a demonstration program, shall be used—</text> 
<paragraph id="H7B53DA78C2A447BBAF9D63DBA114F523"><enum>(1)</enum><text display-inline="yes-display-inline">to support the efforts of the agencies, organizations, and researchers included in the eligible partnership, with respect to the program;</text></paragraph> 
<paragraph id="H7861FC64DFBD4C788F907BEEBB660017"><enum>(2)</enum><text display-inline="yes-display-inline">to develop and implement a program for supervised long-term substance abusers during the period described in subsection (a), which shall include—</text> 
<subparagraph id="H69C912E662F44F0BAD5E8BA739A7F870"><enum>(A)</enum><text>alcohol and drug abuse assessments that—</text> 
<clause id="H3BF787A1AB274A6DB86FF2C25611800"><enum>(i)</enum><text>are provided by a State-approved program; and</text></clause> 
<clause id="H83F9843B178040B18493F06832A83E4"><enum>(ii)</enum><text>provide adequate incentives for completion of a comprehensive alcohol or drug abuse treatment program, including through the use of graduated sanctions; and</text></clause></subparagraph> 
<subparagraph id="H93E61336CF2B474FB1C85B01CAF26212"><enum>(B)</enum><text>coordinated and continuous delivery of drug treatment and case management services during such period; and</text></subparagraph></paragraph> 
<paragraph id="H4D387ADC67D74559A787001BDD7D59BB"><enum>(3)</enum><text display-inline="yes-display-inline">to provide addiction recovery support services (such as job training and placement, peer support, mentoring, education, and other related services) to strengthen rehabilitation efforts for long-term substance abusers.</text></paragraph></subsection> 
<subsection id="H58815F8D5DEE45E3A1E000470148B814"><enum>(c)</enum><header>Application</header><text>To be eligible for a grant under subsection (a) for a demonstration program, an eligible partnership shall submit to the Attorney General an application that—</text> 
<paragraph id="H273DD50A369841579726234FB4FEF3E6"><enum>(1)</enum><text>identifies the role, and certifies the involvement, of each agency or organization involved in such partnership, with respect to the program;</text></paragraph> 
<paragraph id="H5BBC6A9B9A53490C9FF2C6C1426C266"><enum>(2)</enum><text display-inline="yes-display-inline">includes a plan for using judicial or other criminal or juvenile justice authority to supervise the long-term substance abusers who are participating in a demonstration program under this section, including for—</text> 
<subparagraph id="H23186753E3AA4515948151451779B2A9"><enum>(A)</enum><text>administering drug tests for such abusers on a regular basis; and</text></subparagraph> 
<subparagraph id="HB0B7360E9B7549A3892F1B5CD7B177AF"><enum>(B)</enum><text>swiftly and certainly imposing an established set of graduated sanctions for non-compliance with conditions for reentry into the community relating to drug abstinence (whether imposed as a pre-trial, probation, or parole condition, or otherwise);</text></subparagraph></paragraph> 
<paragraph id="HF1E451892FC145DA88597E26C326011E"><enum>(3)</enum><text display-inline="yes-display-inline">includes a plan to provide supervised long-term substance abusers with coordinated and continuous services that are based on evidence-based strategies that assist such abusers by providing such abusers with—</text> 
<subparagraph id="H738F4B7BE76740E19915566774C049B1"><enum>(A)</enum><text>drug treatment while in prison, jail, or a juvenile facility;</text></subparagraph> 
<subparagraph id="HEB5740A8B3DE4657AE271EECEE5D1B33"><enum>(B)</enum><text>continued treatment during the period in which each such long-term substance abuser is in prison, jail, or a juvenile facility, and until the completion of parole or court supervision of such abuser;</text></subparagraph> 
<subparagraph id="H0C921965139948F8B8A8CAED6E8D1158"><enum>(C)</enum><text display-inline="yes-display-inline">addiction recovery support services;</text></subparagraph> 
<subparagraph id="H83ED4E75B07A456B9C23F5E6A0E2E795"><enum>(D)</enum><text>employment training and placement;</text></subparagraph> 
<subparagraph id="H942D8CB4A558446FB70427AB5853C859"><enum>(E)</enum><text>family-based therapies;</text></subparagraph> 
<subparagraph id="H890D603AC44D4E90953C4B003D689F6F"><enum>(F)</enum><text display-inline="yes-display-inline">structured post-release housing and transitional housing, including housing for recovering substance abusers; and</text></subparagraph> 
<subparagraph id="H3A554E5A8AD14438B7E368B92273C95F"><enum>(G)</enum><text>other services coordinated by appropriate case management services;</text></subparagraph></paragraph> 
<paragraph id="H3EFFE0D5E08C4AF38ED4BD0012E4A277"><enum>(4)</enum><text>includes a plan for coordinating the data infrastructures among the entities included in the eligible partnership and between such entities and the providers of services under the demonstration program involved (including providers of technical assistance) to assist in monitoring and measuring the effectiveness of demonstration programs under this section; and</text></paragraph> 
<paragraph id="HD0C09F68D6ED41C989CDCE1F36091CA0"><enum>(5)</enum><text display-inline="yes-display-inline">includes a plan to monitor and measure the number of long-term substance abusers—</text> 
<subparagraph id="HB0C969553A054ED7B374E7AC1D7E47E4"><enum>(A)</enum><text>located in each community involved; and</text></subparagraph> 
<subparagraph id="HAAFDD1E3F2474A73AAC655A09470999E"><enum>(B)</enum><text>who improve the status of their employment, housing, health, and family life.</text></subparagraph></paragraph></subsection> 
<subsection id="HE697660298FC41CA9FFE8EE1AF6E4EE1"><enum>(d)</enum><header>Reports to Congress</header> 
<paragraph id="H3F45356986594357A88DE0DEF178CD8"><enum>(1)</enum><header>Interim report</header><text display-inline="yes-display-inline">Not later than September 30, 2008, the Attorney General shall submit to Congress a report that identifies the best practices relating to the comprehensive and coordinated treatment of long-term substance abusers, including the best practices identified through the activities funded under this section.</text></paragraph> 
<paragraph id="H2BC08777000E4C4EBE83F4F374DD008E"><enum>(2)</enum><header>Final report</header><text>Not later than September 30, 2009, the Attorney General shall submit to Congress a report on the demonstration programs funded under this section, including on the matters specified in paragraph (1). </text></paragraph></subsection> 
<subsection id="HE2F3AD9C3DD74373AFD4AD6F4CEE3E6"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H62A700FE9BBE409D83EDE516F600A3AF"><enum>(1)</enum><header>Eligible partnership</header><text>The term <term>eligible partnership</term> means a partnership that includes—</text> 
<subparagraph id="H2C87C9C4718F426FBB7D1D4500BD5783"><enum>(A)</enum><text display-inline="yes-display-inline">the applicable Single State Authority for Substance Abuse;</text></subparagraph> 
<subparagraph id="H3C33F71439074CCD8900E100A49BEFBF"><enum>(B)</enum><text display-inline="yes-display-inline">the State, local, territorial, or tribal criminal or juvenile justice authority involved;</text></subparagraph> 
<subparagraph id="H25E299BAC549469E9BC307CCE21BCC"><enum>(C)</enum><text>a researcher who has experience in evidence-based studies that measure the effectiveness of treating long-term substance abusers during the period in which such abusers are under the supervision of the criminal or juvenile justice system involved;</text></subparagraph> 
<subparagraph id="HD916921910BD45E8A98216790275DEBB"><enum>(D)</enum><text>community-based organizations that provide drug treatment, related recovery services, job training and placement, educational services, housing assistance, mentoring, or medical services; and</text></subparagraph> 
<subparagraph id="HA4A2850118664906A723A45F074CCA49"><enum>(E)</enum><text>Federal agencies (such as the Drug Enforcement Agency, the Bureau of Alcohol, Tobacco, Firearms, and Explosives, and United States Attorney’s offices).</text></subparagraph></paragraph> 
<paragraph id="H3BDC0E2C285C42DAA473E8A8783EBD6D"><enum>(2)</enum><header>Long-term substance abuser</header><text display-inline="yes-display-inline">The term <term>long-term substance abuser</term> means an offender, who—</text> 
<subparagraph id="HDB8AEF09C8C64B0C90AD38C00CFD1B"><enum>(A)</enum><text>is in a prison, jail, or juvenile facility;</text></subparagraph> 
<subparagraph id="HA1BBC20629EE4BFABCC081E8829926C9"><enum>(B)</enum><text>has abused illegal drugs or alcohol for a significant number of years; and</text></subparagraph> 
<subparagraph id="HF4C2C0B31113469DADFE45D31CCA3EA"><enum>(C)</enum><text>is scheduled to be released from prison, jail, or a juvenile facility within the next 24 months.</text></subparagraph></paragraph> 
<paragraph id="HA5597E47809842F6B0779EF639997C1D"><enum>(3)</enum><header>Single State Authority for Substance Abuse</header><text display-inline="yes-display-inline">The term <term>Single State Authority for Substance Abuse</term> means an entity designated by the Governor or chief executive officer of a State as the single State administrative authority responsible for the planning, development, implementation, monitoring, regulation, and evaluation of substance abuse services. </text></paragraph></subsection> 
<subsection id="H440EF3EC720A4CDD843BB4873752523"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $5,000,000 for each of fiscal years 2008 and 2009.</text></subsection></section>

<subsection id="H99F59C7E73F44F609217614FDEC38C8B"><enum>(a)</enum><header>Grant awards required</header><text>The Attorney General shall make competitiv
