				tribe</header><text>The term <quote>Indian tribe</quote> means any Indian

				1601 et seq.), that is recognized as eligible for the special programs and

				term <quote>region</quote> means—</text>

				combined population of at least 1,650,000 or have an area of not less than

				such geographic area, and that is established by law or by agreement of 2 or
				more such governments or governmental agencies in a mutual aid agreement;

				combination of contiguous local government units (including such a combination
				established by law or agreement of two or more governments or governmental

				management planning and assistance account grants</header><text>The Emergency

										</paragraph></subsection></section><section id="H013BFAADC67B4A2FAB4D09ACEFACE684"><enum>2003.</enum><header>Covered grant
				eligibility and criteria</header>
									<subsection id="H9D5B9DEB2D58404DA03170F9D5323293"><enum>(a)</enum><header>Grant
				Eligibility</header>
										<paragraph id="H33CB1443911641DFA3E4DB45CC837706"><enum>(1)</enum><header>State, region,
				or directly eligible tribe</header><text display-inline="yes-display-inline">Any State, region, or directly eligible
				tribe shall be eligible to apply for a covered grant under the programs
				referred to in paragraphs (1) and (3) of section 1802(a).</text>
										</paragraph><paragraph id="H0B6415C07A2E4BFBAD73B9D496B57A8"><enum>(2)</enum><header>High-threat urban
				areas</header><text display-inline="yes-display-inline">Any urban area that is
				determined by the Secretary to be a high-threat urban areas shall be eligible
				to apply for a covered grant referred to in paragraph (2) of section
				1802(a).</text>
										</paragraph></subsection><subsection id="H6F0AD9F7C5034446A5DE66C366E7D9A8"><enum>(b)</enum><header>Grant
				Criteria</header><text>The Secretary shall award covered grants to assist
				States and local governments in achieving, maintaining, and enhancing the
				capabilities for terrorism preparedness established by the Secretary.</text>
									</subsection><subsection id="H89FF094C8C92457A8C5B2838D1F4DEA8"><enum>(c)</enum><header>Submission of
				State Preparedness Report</header>
										<paragraph id="H1C269C9FFF314A08894E00DFB45B0016"><enum>(1)</enum><header>Submission
				required</header><text>The Secretary shall require that any State applying to
				the Secretary for a covered grant must submit State Preparedness Report
				specified in section 652(c) of the Department of Homeland Security
				Appropriations Act, 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/109/295">Public Law 109–295</external-xref>).</text>
										</paragraph><paragraph id="H86112AE03DCD4C4DA2ECC7225867DE02"><enum>(2)</enum><header>Consultation</header><text>The
				State report submitted under paragraph (1) shall be developed in consultation
				with and subject to appropriate comment by local governments and first
				responders within the State.</text>
										</paragraph></subsection><subsection id="H560D688AF5874F0F97798774656E7EFF"><enum>(d)</enum><header>Consistency With
				State Plans</header>
										<paragraph id="HFED114CC25C14DD0805D264639212B5E"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall ensure that each covered grant is
				used to supplement and support, in a consistent and coordinated manner, the
				applicable State homeland security report or plan.</text>
										</paragraph><paragraph id="H303A4168F40344179CF396653E71946F"><enum>(2)</enum><header>Approval of plan
				by secretary</header><text>The Secretary may not award any covered grant to a
				State unless the Secretary has approved the applicable State homeland security
				plan.</text>
										</paragraph><paragraph id="H03F0F413EEBB428F00FEDB25FCE700BB"><enum>(3)</enum><header>Revisions</header><text>A
				State may revise the applicable State homeland security plan approved by the
				Secretary under this subsection, subject to approval of the revision by the
				Secretary.</text>
										</paragraph></subsection><subsection id="HFE054619B9DA4D63B625C0CF09CB2A"><enum>(e)</enum><header>Application for
				Grant</header>
										<paragraph id="HBCBD1B5A37254D49A5497B9755E5547C"><enum>(1)</enum><header>In
				general</header><text>Except as otherwise provided in this subsection, any
				State, urban area, region, or directly eligible tribe may apply for a covered
				grant by submitting to the Secretary an application at such time, in such
				manner, and containing such information as is required under this subsection,
				or as the Secretary may reasonably require.</text>
										</paragraph><paragraph id="H387A0DBF358E46EAB28C4241E14F00B7"><enum>(2)</enum><header>Deadlines for
				applications and awards</header><text>All applications for covered grants must
				be submitted at such time as the Secretary may reasonably require for the
				fiscal year for which they are submitted. The Secretary shall award covered
				grants pursuant to all approved applications for such fiscal year as soon as
				practicable, but not later than March 1 of such year.</text>
										</paragraph><paragraph id="H64DCCC85F7994A3FBE1E515900BB37B3"><enum>(3)</enum><header>Availability of
				funds</header><text>All funds awarded by the Secretary under covered grants in
				a fiscal year shall be available for obligation through the end of the
				subsequent fiscal year.</text>
										</paragraph><paragraph id="HCC42A84EDE87435BAAA591E925008403"><enum>(4)</enum><header>Minimum contents
				of application</header><text>The Secretary shall require that each applicant
				include in its application, at a minimum—</text>
											<subparagraph id="H2E0965D0ADBB4CD4A1C17BCFC24CE4A6"><enum>(A)</enum><text>the purpose for
				which the applicant seeks covered grant funds and the reasons why the applicant
				needs the covered grant to meet the capabilities for terrorism preparedness
				within the State, urban area, region, or directly eligible tribe to which the
				application pertains;</text>
											</subparagraph><subparagraph id="H545640C79FF941DDA31B688161F92EFF"><enum>(B)</enum><text>a description of
				how, by reference to the applicable State homeland security plan or plans under
				subsection (c), the allocation of grant funding proposed in the application,
				including, where applicable, the amount not passed through under section
				2005(g)(1), would assist in fulfilling the capabilities for terrorism
				preparedness specified in such plan or plans;</text>
											</subparagraph><subparagraph id="HBC628F30C71C43A80060E62C4973C572"><enum>(C)</enum><text>a statement of
				whether a mutual aid agreement applies to the use of all or any portion of the
				covered grant funds;</text>
											</subparagraph><subparagraph id="H3D6D61846C9F48A580D8599EE76D8971"><enum>(D)</enum><text>if the applicant
				is a State, a description of how the State plans to allocate the covered grant
				funds to local governments and Indian tribes;</text>
											</subparagraph><subparagraph id="H21AC20AFDA7A46FCBA251E5368D5F821"><enum>(E)</enum><text>if the applicant
				is a region—</text>
												<clause id="HBFDBD55B461C4F058DA0A66BEB13C84E"><enum>(i)</enum><text>a
				precise geographical description of the region and a specification of all
				participating and nonparticipating local governments within the geographical
				area comprising that region;</text>
												</clause><clause id="HA75F9B97368E4654839ED9D96F4B0182"><enum>(ii)</enum><text>a
				specification of what governmental entity within the region will administer the
				expenditure of funds under the covered grant; and</text>
												</clause><clause id="H79A3043DE3D44327B68200583FB12F9B"><enum>(iii)</enum><text>a designation of
				a specific individual to serve as regional liaison;</text>
												</clause></subparagraph><subparagraph id="HD83FFADCF81C4AC29BB91EBD41C8AF82"><enum>(F)</enum><text>a capital budget
				showing how the applicant intends to allocate and expend the covered grant
				funds;</text>
											</subparagraph><subparagraph id="HA95A5E2F4E2C47BDB242DA67408B6FE1"><enum>(G)</enum><text>if the applicant
				is a directly eligible tribe, a designation of a specific individual to serve
				as the tribal liaison; and</text>
											</subparagraph><subparagraph id="H2DBC3C8C421D493F859DCC632E01D754"><enum>(H)</enum><text>a statement of how
				the applicant intends to meet the matching requirement, if any, that applies
				under section 2005(g)(2).</text>
											</subparagraph></paragraph><paragraph id="HCC07FD9D45D345FCA1E24391949FDCCF"><enum>(5)</enum><header>Regional
				applications</header>
											<subparagraph id="HB966B781FD42426C8FCDDF857E00BC82"><enum>(A)</enum><header>Relationship to
				state applications</header><text>A regional application—</text>
												<clause id="H1DE95D93237E473DA2E709686D2215B8"><enum>(i)</enum><text>shall be
				coordinated with an application submitted by the State or States of which such
				region is a part;</text>
												</clause><clause id="H23F088DEDEB545688F5C711672154034"><enum>(ii)</enum><text>shall supplement
				and avoid duplication with such State application; and</text>
												</clause><clause id="H58EB6351D5B748809E3184C0908AC59"><enum>(iii)</enum><text>shall address the
				unique regional aspects of such region’s terrorism preparedness needs beyond
				those provided for in the application of such State or States.</text>
												</clause></subparagraph><subparagraph id="HBE66382B86FD4368B37B5C2990D368AB"><enum>(B)</enum><header>State review and
				submission</header><text>To ensure the consistency required under subsection
				(d) and the coordination required under subparagraph (A) of this paragraph, an
				applicant that is a region must submit its application to each State of which
				any part is included in the region for review and concurrence prior to the
				submission of such application to the Secretary. The regional application shall
				be transmitted to the Secretary through each such State within 30 days of its
				receipt, unless the Governor of such a State notifies the Secretary, in
				writing, that such regional application is inconsistent with the State’s
				homeland security plan and provides an explanation of the reasons
				therefor.</text>
											</subparagraph><subparagraph id="HC08E296047324B1CAD66731B420365AC"><enum>(C)</enum><header>Distribution of
				regional awards</header><text>If the Secretary approves a regional application,
				then the Secretary shall distribute a regional award to the State or States
				submitting the applicable regional application under subparagraph (B), and each
				such State shall, not later than the end of the 45-day period beginning on the
				date after receiving a regional award, pass through to the region all covered
				grant funds or resources purchased with such funds, except those funds
				necessary for the State to carry out its responsibilities with respect to such
				regional application: Provided, That in no such case shall the State or States
				pass through to the region less than 80 percent of the regional award.</text>
											</subparagraph><subparagraph id="H51DC58887A1F47F8A8A14D1D3BD5733B"><enum>(D)</enum><header>Certifications
				regarding distribution of grant funds to regions</header><text>Any State that
				receives a regional award under subparagraph (C) shall certify to the
				Secretary, by not later than 30 days after the expiration of the period
				described in subparagraph (C) with respect to the grant, that the State has
				made available to the region the required funds and resources in accordance
				with subparagraph (C).</text>
											</subparagraph><subparagraph id="H2984D17F04084B8997F3E046316687B2"><enum>(E)</enum><header>Direct payments
				to regions</header><text>If any State fails to pass through a regional award to
				a region as required by subparagraph (C) within 45 days after receiving such
				award and does not request or receive an extension of such period under section
				2006(h)(2), the region may petition the Secretary to receive directly the
				portion of the regional award that is required to be passed through to such
				region under subparagraph (C).</text>
											</subparagraph><subparagraph id="H164F6A5562EA41A8B43D1E8BC100642F"><enum>(F)</enum><header>Regional
				liaisons</header><text>A regional liaison designated under paragraph
				(4)(E)(iii) shall—</text>
												<clause id="H76FFE914CA9B4DAAA120F4A4F3CA8765"><enum>(i)</enum><text>coordinate with
				Federal, State, local, regional, and private officials within the region
				concerning terrorism preparedness;</text>
												</clause><clause id="H58D8521DEC1A48E282BAEA51FAA5F0F5"><enum>(ii)</enum><text>develop a process
				for receiving input from Federal, State, local, regional, and private sector
				officials within the region to assist in the development of the regional
				application and to improve the region’s access to covered grants; and</text>
												</clause><clause id="HEBF73B8109A747FDB8074E016F0867AB"><enum>(iii)</enum><text>administer, in
				consultation with State, local, regional, and private officials within the
				region, covered grants awarded to the region.</text>
												</clause></subparagraph></paragraph><paragraph id="HFA3418BB6F7C4557A92F2989B799739C"><enum>(6)</enum><header>Tribal
				applications</header>
											<subparagraph id="H2241B484F3C44E1C8B6B497DB9B3C78D"><enum>(A)</enum><header>Submission to
				the state or states</header><text>To ensure the consistency required under
				subsection (d), an applicant that is a directly eligible tribe must submit its
				application to each State within the boundaries of which any part of such tribe
				is located for direct submission to the Department along with the application
				of such State or States.</text>
											</subparagraph><subparagraph id="HBEBB849BEB5447D0B954303BDA686198"><enum>(B)</enum><header>Opportunity for
				state comment</header><text>Before awarding any covered grant to a directly
				eligible tribe, the Secretary shall provide an opportunity to each State within
				the boundaries of which any part of such tribe is located to comment to the
				Secretary on the consistency of the tribe’s application with the State’s
				homeland security plan. Any such comments shall be submitted to the Secretary
				concurrently with the submission of the State and tribal applications.</text>
											</subparagraph><subparagraph id="HE3D13949BEE84556BEE2987CF9F9B592"><enum>(C)</enum><header>Final
				authority</header><text>The Secretary shall have final authority to determine
				the consistency of any application of a directly eligible tribe with the
				applicable State homeland security plan or plans, and to approve any
				application of such tribe. The Secretary shall notify each State within the
				boundaries of which any part of such tribe is located of the approval of an
				application by such tribe.</text>
											</subparagraph><subparagraph id="H1A253C35D9204EC0A5D83C9B07D76366"><enum>(D)</enum><header>Tribal
				liaison</header><text>A tribal liaison designated under paragraph (4)(G)
				shall—</text>
												<clause id="H65D71432482F466FAA5B6C4D22F228AB"><enum>(i)</enum><text>coordinate with
				Federal, State, local, regional, and private officials concerning terrorism
				preparedness;</text>
												</clause><clause id="H62FB00F427C541B2BCE36CBCE02E6122"><enum>(ii)</enum><text>develop a process
				for receiving input from Federal, State, local, regional, and private sector
				officials to assist in the development of the application of such tribe and to
				improve the tribe’s access to covered grants; and</text>
												</clause><clause id="H6DA3710EF84040F083680000CC3FDA99"><enum>(iii)</enum><text>administer, in
				consultation with State, local, regional, and private officials, covered grants
				awarded to such tribe.</text>
												</clause></subparagraph><subparagraph id="HFDEE983D7B714399BE1B00F2E777ACB9"><enum>(E)</enum><header>Limitation on
				the number of direct grants</header><text>The Secretary may make covered grants
				directly to not more than 20 directly eligible tribes per fiscal year.</text>
											</subparagraph><subparagraph id="HEACC060765C6436F8DE8A337EAB6C709"><enum>(F)</enum><header>Tribes not
				receiving direct grants</header><text>An Indian tribe that does not receive a
				grant directly under this section is eligible to receive funds under a covered
				grant from the State or States within the boundaries of which any part of such
				tribe is located, consistent with the homeland security plan of the State as
				described in subsection (c). If a State fails to comply with section
				2006(g)(1), the tribe may request payment under section 2006(h)(3) in the same
				manner as a local government.</text>
											</subparagraph></paragraph><paragraph id="H276C363487014BB6BDB3B5C4C14E417E"><enum>(7)</enum><header>Equipment
				standards</header><text>If an applicant for a covered grant proposes to upgrade
				or purchase, with assistance provided under the grant, new equipment or systems
				that do not meet or exceed any applicable national voluntary consensus
				standards established by the Secretary, the applicant shall include in the
				application an explanation of why such equipment or systems will serve the
				needs of the applicant better than equipment or systems that meet or exceed
				such standards.</text>
										</paragraph></subsection></section><section id="H7E57A16BC84D463AA0209CF6ED52559F"><enum>2004.</enum><header>Risk-based
				evaluation and prioritization</header>
									<subsection id="H476F09A8FC3F4C0EA9E9AB46CFD2AD7B"><enum>(a)</enum><header>Prioritization
				of Grant Applications</header>
										<paragraph id="H53EF2B622DAE421A859116B950D210C0"><enum>(1)</enum><header>Factors to be
				considered</header><text>The Secretary shall evaluate and annually prioritize
				all pending applications for covered grants based upon the degree to which they
				would, by achieving, maintaining, or enhancing the capabilities of the
				applicants on a nationwide basis, lessen the threat to, vulnerability of, and
				consequences for persons (including transient commuting and tourist
				populations) and critical infrastructure. Such evaluation and prioritization
				shall be based upon the most current risk assessment available by the Office of
				Intelligence Analysis and the Office of Infrastructure Protection of the
				threats of terrorism against the United States. In establishing criteria for
				evaluating and prioritizing applications for covered grants, the Secretary
				shall coordinate with the National Advisory Council established under section
				508, the Director of the Federal Emergency Management Agency, the United States
				Fire Administrator, the Chief Intelligence Officer of the Department, the
				Assistant Secretary for Infrastructure Protection, and other Department
				officials as determined by the Secretary.</text>
										</paragraph><paragraph id="H43D076FD13904BCBBE1876D73CC819AC"><enum>(2)</enum><header>Critical
				infrastructure sectors</header><text>The Secretary specifically shall consider
				threats of terrorism against the following critical infrastructure sectors in
				all areas of the United States, urban and rural:</text>
											<subparagraph id="H0C4DF8F4830F499C96A86F9B7D68F388"><enum>(A)</enum><text>Agriculture and
				food.</text>
											</subparagraph><subparagraph id="H201F7A27C7C54051A7062E31ADE279FF"><enum>(B)</enum><text>Banking and
				finance.</text>
											</subparagraph><subparagraph id="H79A2C963F91D4964BCA107E072657234"><enum>(C)</enum><text>Chemical
				industries.</text>
											</subparagraph><subparagraph id="H72321456FC78405EAD705F8DE9801D2F"><enum>(D)</enum><text>The defense
				industrial base.</text>
											</subparagraph><subparagraph id="H5C7C90906DDD444CB43F66E3B2FC32E8"><enum>(E)</enum><text>Emergency
				services.</text>
											</subparagraph><subparagraph id="H159819B50D4B4438A72E3610ADD33FA"><enum>(F)</enum><text>Energy.</text>

											</subparagraph><continuation-text continuation-text-level="paragraph">The order
				in which the critical infrastructure sectors are listed in this paragraph shall
				not be construed as an order of priority for consideration of the importance of
				such sectors.</continuation-text></paragraph><paragraph id="H5CD54BEA421744A591FE00936B00531C"><enum>(3)</enum><header>Types of
				threat</header><text>The Secretary specifically shall consider the following
				types of threat to the critical infrastructure sectors described in paragraph
				(2), and to populations in all areas of the United States, urban and
				rural:</text>
											<subparagraph id="H0354B81B1E7944B6AF1E8E1FEB07D1C5"><enum>(A)</enum><text>Biological
				threats.</text>
											</subparagraph><subparagraph id="H4B6524E6F9044963AD53F96969CB1EB"><enum>(B)</enum><text>Nuclear
				threats.</text>
											</subparagraph><subparagraph id="H331C84A7113D4E7F84E80861CD992C57"><enum>(C)</enum><text>Radiological
				threats.</text>
											</subparagraph><subparagraph id="H19F2966A6D35454D8F01D9E7EA0233D3"><enum>(D)</enum><text>Incendiary
				threats.</text>
											</subparagraph><subparagraph id="H520343B79083484C85B79FA27B50FE00"><enum>(E)</enum><text>Chemical
				threats.</text>
											</subparagraph><subparagraph id="H1036CC61DCEA412BB469FFAFA21CD1FD"><enum>(F)</enum><text>Explosives.</text>
											</subparagraph><subparagraph id="H0A8DB1F42B7C4991B3F0E57185495B67"><enum>(G)</enum><text>Suicide
				bombers.</text>
											</subparagraph><subparagraph id="HC8AB6425404746CDBC29C04D6B31E6C3"><enum>(H)</enum><text>Cyber
				threats.</text>
											</subparagraph><subparagraph id="H57CD93C5476942D7AC43AD5F008CD4E1"><enum>(I)</enum><text>Any other threats
				based on proximity to specific past acts of terrorism or the known activity of
				any terrorist group.</text>
											</subparagraph><continuation-text continuation-text-level="paragraph">The order
				in which the types of threat are listed in this paragraph shall not be
				construed as an order of priority for consideration of the importance of such
				threats.</continuation-text></paragraph><paragraph id="HC413B82C6E7A41F2A5271FCAD27F263"><enum>(4)</enum><header>Consideration of
				additional factors</header><text>The Secretary shall take into account any
				other specific threat to a population (including a transient commuting or
				tourist population) or critical infrastructure sector that the Board has
				determined to exist. In evaluating the threat to a population or critical
				infrastructure sector, the Secretary shall give greater weight to threats of
				terrorism based upon their specificity and credibility, including any pattern
				of repetition.</text>
										</paragraph><paragraph id="H7FF05209A81049B3B3C9AB3302585F77"><enum>(5)</enum><header>Minimum
				amounts</header><text>After evaluating and prioritizing grant applications
				under paragraph (1), the Department shall ensure that, for each fiscal
				year—</text>
											<subparagraph id="H841DC374F4B74757BAD88F3936F314BB"><enum>(A)</enum><text>each of the
				States, other than the Virgin Islands, American Samoa, Guam, and the Northern
				Mariana Islands, that has an approved State homeland security plan receives no
				less than 0.25 percent of the funds available for covered grants for that
				fiscal year for purposes of implementing its homeland security plan;</text>
											</subparagraph><subparagraph id="HD0425DD85DC04EF9BEABF4885D0076DD"><enum>(B)</enum><text>each of the
				States, other than the Virgin Islands, American Samoa, Guam, and the Northern
				Mariana Islands, that has an approved State homeland security plan and that
				meets one or both of the additional high-risk qualifying criteria under
				paragraph (6) receives no less than 0.45 percent of the funds available for
				covered grants for that fiscal year for purposes of implementing its homeland
				security plan;</text>
											</subparagraph><subparagraph id="H78A5B9EBD91B4A5CAF1C415C36A2EE1B"><enum>(C)</enum><text>the Virgin
				Islands, American Samoa, Guam, and the Northern Mariana Islands each receives
				no less than 0.08 percent of the funds available for covered grants for that
				fiscal year for purposes of implementing its approved State plan; and</text>
											</subparagraph><subparagraph id="H329634BA829A42B7BFF3E7F1720027CB"><enum>(D)</enum><text>directly eligible
				tribes collectively receive no less than 0.08 percent of the funds available
				for covered grants for such fiscal year for purposes of addressing the needs
				identified in the applications of such tribes, consistent with the homeland
				security plan of each State within the boundaries of which any part of any such
				tribe is located, except that this clause shall not apply with respect to funds
				available for a fiscal year if the Secretary receives less than 5 applications
				for such fiscal year from such tribes or does not approve at least one such
				application.</text>
											</subparagraph></paragraph><paragraph id="HAE9172A267784B9480E2B243BA7ADC5"><enum>(6)</enum><header>Additional
				high-risk qualifying criteria</header><text>For purposes of paragraph (5)(B),
				additional high-risk qualifying criteria consist of—</text>
											<subparagraph id="H28DB40618923449484B0580279A54EF6"><enum>(A)</enum><text>having a
				significant international land border; or</text>
											</subparagraph><subparagraph id="HAFC4F28D388F494C88159553953C4348"><enum>(B)</enum><text>adjoining a body
				of water within North America through which an international boundary line
				extends.</text>
											</subparagraph></paragraph></subsection><subsection id="HD752BC08DEE64F6793DB82FA001C81FE"><enum>(b)</enum><header>Effect of
				Regional Awards on State Minimum</header><text>Any regional award, or portion
				thereof, provided to a State under section 2003(e)(5)(C) shall not be
				considered in calculating the minimum State award under subsection (a)(5) of
				this section.</text>
									</subsection><subsection id="H44EFD2CDA6A04FE0AE7142DB004E4334"><enum>(c)</enum><header>Relationship to
				other programs</header><text display-inline="yes-display-inline">This section
				shall be carried out in consultation with the Secretary of Health and Human
				Services. Nothing in this section affects the scope of authority of the
				Secretary of Health and Human Services, including such authority under the
				Public Health Service Act.</text>
									</subsection></section><section id="HE2A2CE217EBB46F7B8193B6CC851F824"><enum>2005.</enum><header>Use of funds
				and accountability requirements</header>
									<subsection id="H248EF4B924664A29936244143992E7F"><enum>(a)</enum><header>In
				General</header><text>A covered grant may be used for—</text>
										<paragraph id="H9D5CE6C6F88340F68E35EA235A3794E"><enum>(1)</enum><text>purchasing or
				upgrading equipment, including computer hardware and software, to enhance
				terrorism preparedness;</text>
										</paragraph><paragraph id="HF6C516007CB24401B2DA6C231649DA5B"><enum>(2)</enum><text>exercises to
				strengthen terrorism preparedness;</text>
										</paragraph><paragraph id="H2D80A9AC38CC40C400D79795E4D42E46"><enum>(3)</enum><text>training for
				prevention (including detection) of, preparedness for, response to, or recovery
				from attacks involving weapons of mass destruction, including training in the
				use of equipment and computer software;</text>
										</paragraph><paragraph id="HDD97EE0AF380440692E5BA74B4081035"><enum>(4)</enum><text>developing or
				updating State homeland security plans, risk assessments, mutual aid
				agreements, and emergency management plans to enhance terrorism
				preparedness;</text>
										</paragraph><paragraph id="HFEE6474324E045E19702DADEA4DFBCD2"><enum>(5)</enum><text>establishing or
				enhancing mechanisms for sharing terrorism threat information;</text>
										</paragraph><paragraph id="H884686128A244B13A5D796A4485FC416"><enum>(6)</enum><text>systems
				architecture and engineering, program planning and management, strategy
				formulation and strategic planning, life-cycle systems design, product and
				technology evaluation, and prototype development for terrorism preparedness
				purposes;</text>
										</paragraph><paragraph id="H3D16EE17DBAA4745002907E16FFC75FD"><enum>(7)</enum><text>additional
				personnel costs resulting from—</text>
											<subparagraph id="H29369847CB88415786EE15105CCA4978"><enum>(A)</enum><text>elevations in the
				threat alert level of the Homeland Security Advisory System by the Secretary,
				or a similar elevation in threat alert level issued by a State, region, or
				local government with the approval of the Secretary;</text>
											</subparagraph><subparagraph id="HDF540ADE6D6E4AF200289C2C3EEB6E25"><enum>(B)</enum><text>travel to and
				participation in exercises and training in the use of equipment and on
				prevention activities;</text>
											</subparagraph><subparagraph id="HD43664EC70CE4521A545AC25FCDC042B"><enum>(C)</enum><text>the temporary
				replacement of personnel during any period of travel to and participation in
				exercises and training in the use of equipment and on prevention activities;
				and</text>
											</subparagraph><subparagraph id="H18EBD939267F49D8003DB44B48512870"><enum>(D)</enum><text display-inline="yes-display-inline">the hiring of staff to serve as
				intelligence analysts to strengthen information and intelligence sharing
				capabilities;</text>
											</subparagraph></paragraph><paragraph id="H11F1C8BE51B6426FA09E80D47DBD7240"><enum>(8)</enum><text>the costs of
				equipment (including software) required to receive, transmit, handle, and store
				classified information;</text>
										</paragraph><paragraph id="HF61ADB192A68494F83C95DE778B710C1"><enum>(9)</enum><text>protecting
				critical infrastructure against potential attack by the addition of barriers,
				fences, gates, and other such devices that are constructed consistent with the
				requirements of section 6(j)(9) of the Robert T. Stafford Disaster Relief and
				Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5196">42 U.S.C. 5196(j)(9)</external-xref>, except that the cost of such
				measures may not exceed the greater of—</text>
											<subparagraph id="HE409236CC717416F98006871309B10E9"><enum>(A)</enum><text>$1,000,000 per
				project; or</text>
											</subparagraph><subparagraph id="HE44EA81EC2E6454386397DDC0958C1F5"><enum>(B)</enum><text>such greater
				amount as may be approved by the Secretary, which may not exceed 10 percent of
				the total amount of the covered grant;</text>
											</subparagraph></paragraph><paragraph id="H3C6DF981555E42B09CE22D8CBE66BFD8"><enum>(10)</enum><text>the costs of
				commercially available interoperable communications equipment (that, where
				applicable, is based on national, voluntary consensus standards) that the
				Secretary, in consultation with the Assistant Secretary for Emergency
				Communications, deems best suited to facilitate interoperability, coordination,
				and integration between and among emergency communications systems, and that
				complies with prevailing grant guidance of the Department for interoperable
				communications;</text>
										</paragraph><paragraph id="H1D8999E94EFD45818DCA996EA446A2AE"><enum>(11)</enum><text>educational
				curricula development for first responders to ensure that they are prepared for
				terrorist attacks;</text>
										</paragraph><paragraph id="HD658A7BD297F4BDB8E47EBE40888C1B1"><enum>(12)</enum><text>training and
				exercises to assist public elementary and secondary schools in developing and
				implementing programs to instruct students regarding age-appropriate skills to
				prevent, prepare for, respond to, mitigate against, or recover from an act of
				terrorism;</text>
										</paragraph><paragraph id="H75BC0494927146319F9D7DE1867BC574"><enum>(13)</enum><text>paying of
				administrative expenses directly related to administration of the grant, except
				that such expenses may not exceed 3 percent of the amount of the grant;</text>
										</paragraph><paragraph id="H9668C1EE340746070005ED78C34375A9"><enum>(14)</enum><text>Public safety
				answering points;</text>
										</paragraph><paragraph id="H4DA66C68D12E46129200E0EDDEF8DF64"><enum>(15)</enum><text>paying for the
				conduct of any activity permitted under the Law Enforcement Terrorism
				Prevention Program, or any such successor to such program; and</text>
										</paragraph><paragraph id="HD1F4EB77EF614CACB35584029F2FDE79"><enum>(16)</enum><text>other appropriate
				activities as determined by the Secretary.</text>
										</paragraph></subsection><subsection id="HA16F0CDA246A471EB67F7FF6CCF183B"><enum>(b)</enum><header>Prohibited
				Uses</header><text>Funds provided as a covered grant may not be used—</text>
										<paragraph id="HF1CC70DE275841AC8D635C99349138FE"><enum>(1)</enum><text>to supplant State
				or local funds;</text>
										</paragraph><paragraph id="HA1B0831DB9B34ED29F60749472C2008B"><enum>(2)</enum><text>to construct
				buildings or other physical facilities;</text>
										</paragraph><paragraph id="HA7E0C37820414FC6BCD1B3F0039552E"><enum>(3)</enum><text>to acquire land;
				or</text>
										</paragraph><paragraph id="H592A1020CCC04B0BB4756CE2F58B00FA"><enum>(4)</enum><text>for any State or
				local government cost-sharing contribution.</text>
										</paragraph></subsection><subsection id="HFA821D40939E4C559CA9CB336E67B1D1"><enum>(c)</enum><header>Intelligence
				analysts</header><text display-inline="yes-display-inline">An individual hired
				to serve as an intelligence analyst under subsection (a)(7)(D) must meet at
				least one of the following criteria:</text>
										<paragraph id="H521737306B90444B87600024218897A8"><enum>(1)</enum><text>The individual has
				successfully completed training that meets the standards of the International
				Association of Law Enforcement Intelligence Analysts to ensure baseline
				proficiency in intelligence analysis and production.</text>
										</paragraph><paragraph id="H1553F0D8D8A1487EA8D8D3997FDC935B"><enum>(2)</enum><text>The individual has
				previously served in a Federal intelligence agency as an intelligence analyst
				for at least two years.</text>
										</paragraph></subsection><subsection id="HF9BD40E08A754C58A7D92BE121C4AA21"><enum>(d)</enum><header>Multiple-Purpose
				Funds</header><text>Nothing in this section shall be construed to preclude
				State and local governments from using covered grant funds in a manner that
				also enhances first responder preparedness for emergencies and disasters
				unrelated to acts of terrorism, if such use assists such governments in
				achieving capabilities for terrorism preparedness established by the
				Secretary.</text>
									</subsection><subsection id="HDC947DE4ACDC46378203620000B6A7BD"><enum>(e)</enum><header>Reimbursement of
				Costs</header>
										<paragraph display-inline="no-display-inline" id="HF8ECC20639C54CDFBCD2ADF24D6F007D"><enum>(1)</enum><header>Paid-on-call or
				volunteer reimbursement</header><text>In addition to the activities described
				in subsection (a), a covered grant may be used to provide a reasonable stipend
				to paid-on-call or volunteer first responders who are not otherwise compensated
				for travel to or participation in training covered by this section. Any such
				reimbursement shall not be considered compensation for purposes of rendering
				such a first responder an employee under the Fair Labor Standards Act of 1938
				(<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>).</text>
										</paragraph><paragraph id="H2937A321156744EF9C927E98EE00C36"><enum>(2)</enum><header>Performance of
				Federal duty</header><text>An applicant for a covered grant may petition the
				Secretary for the reimbursement of the cost of any activity relating to
				prevention (including detection) of, preparedness for, response to, or recovery
				from acts of terrorism that is a Federal duty and usually performed by a
				Federal agency, and that is being performed by a State or local government (or
				both) under agreement with a Federal agency.</text>
										</paragraph></subsection><subsection id="H6DC76AE5E4714E71B5F73F846B372B2E"><enum>(f)</enum><header>Assistance
				Requirement</header><text>The Secretary may not require that equipment paid
				for, wholly or in part, with funds provided as a covered grant be made
				available for responding to emergencies in surrounding States, regions, and
				localities, unless the Secretary undertakes to pay the costs directly
				attributable to transporting and operating such equipment during such
				response.</text>
									</subsection><subsection id="H763CAFF2E70E4C899FC5BA698EC9D991"><enum>(g)</enum><header>Flexibility in
				Unspent Homeland Security Grant Funds</header><text>Upon request by the
				recipient of a covered grant, the Secretary may authorize the grantee to
				transfer all or part of funds provided as the covered grant from uses specified
				in the grant agreement to other uses authorized under this section, if the
				Secretary determines that such transfer is in the interests of homeland
				security.</text>
									</subsection><subsection id="HB85EA5CD9E8A49908C1828CE5C916040"><enum>(h)</enum><header>State, Regional,
				and Tribal Responsibilities</header>
										<paragraph id="H13703AED236845DD8D90F12C2865BB2D"><enum>(1)</enum><header>Pass-through</header><text>The
				Secretary shall require a recipient of a covered grant that is a State to
				obligate or otherwise make available to local governments, first responders,
				and other local groups, to the extent required under the State homeland
				security plan or plans specified in the application for the grant, not less
				than 80 percent of the grant funds, resources purchased with the grant funds
				having a value equal to at least 80 percent of the amount of the grant, or a
				combination thereof, by not later than the end of the 45-day period beginning
				on the date the grant recipient receives the grant funds.</text>
										</paragraph><paragraph id="H45A0C7907AC74FE28C90804506831B3D"><enum>(2)</enum><header>Cost
				sharing</header>
											<subparagraph id="HC000B718D3F8404DA4D8763F4C5E900"><enum>(A)</enum><header>In
				general</header><text>The Federal share of the costs of an activity carried out
				with a covered grant to a State, region, or directly eligible tribe awarded
				after the 2-year period beginning on the date of the enactment of this section
				shall not exceed 75 percent.</text>
											</subparagraph><subparagraph id="H892F11CD07C744E78B3C6B8886E243FF"><enum>(B)</enum><header>Interim
				rule</header><text>The Federal share of the costs of an activity carried out
				with a covered grant awarded before the end of the 2-year period beginning on
				the date of the enactment of this section shall be 100 percent.</text>
											</subparagraph><subparagraph id="H3703C41B45F84D6F96A61505129C3052"><enum>(C)</enum><header>In-kind
				matching</header><text>Each recipient of a covered grant may meet the matching
				requirement under subparagraph (A) by making in-kind contributions of goods or
				services that are directly linked with the purpose for which the grant is made,
				including, but not limited to, any necessary personnel overtime, contractor
				services, administrative costs, equipment fuel and maintenance, and rental
				space.</text>
											</subparagraph></paragraph><paragraph id="H73ABCD8282B343098DF25EA4B7974E6B"><enum>(3)</enum><header>Certifications
				regarding distribution of grant funds to local governments</header><text>Any
				State that receives a covered grant shall certify to the Secretary, by not
				later than 30 days after the expiration of the period described in paragraph
				(1) with respect to the grant, that the State has made available for
				expenditure by local governments, first responders, and other local groups the
				required amount of grant funds pursuant to paragraph (1).</text>
										</paragraph><paragraph id="H3E561AE2651F419A9E034983D2805C58"><enum>(4)</enum><header>Quarterly report
				on homeland security spending</header><text>The Federal share described in
				paragraph (2)(A) may be increased by up to 2 percent for any State, region, or
				directly eligible tribe that, not later than 30 days after the end of each
				fiscal quarter, submits to the Secretary a report on that fiscal quarter. Each
				such report must include, for each recipient of a covered grant or a
				pass-through under paragraph (1)—</text>
											<subparagraph id="H0F9CAD2BC22F442F8C059552F2316BBE"><enum>(A)</enum><text>the amount
				obligated to that recipient in that quarter;</text>
											</subparagraph><subparagraph id="H3072D9462FAE417D93D4DAC06C402B00"><enum>(B)</enum><text>the amount
				expended by that recipient in that quarter; and</text>
											</subparagraph><subparagraph id="HC0530A58EC834299B6E8A2498B9D46B4"><enum>(C)</enum><text>a summary
				description of the items purchased by such recipient with such amount.</text>
											</subparagraph></paragraph><paragraph id="H12356C02F60747339BE2FFD566C8529D"><enum>(5)</enum><header>Annual report on
				homeland security spending</header><text>Each recipient of a covered grant
				shall submit an annual report to the Secretary not later than 60 days after the
				end of each Federal fiscal year. Each recipient of a covered grant that is a
				region must simultaneously submit its report to each State of which any part is
				included in the region. Each recipient of a covered grant that is a directly
				eligible tribe must simultaneously submit its report to each State within the
				boundaries of which any part of such tribe is located. Each report must include
				the following:</text>
											<subparagraph id="HE94B9A16D86B4717B7361C1BACF33B"><enum>(A)</enum><text>The amount, ultimate
				recipients, and dates of receipt of all funds received under the grant during
				the previous fiscal year.</text>
											</subparagraph><subparagraph id="H187F51867651478C8988B344A8C7FC74"><enum>(B)</enum><text>The amount and the
				dates of disbursements of all such funds expended in compliance with paragraph
				(1) or pursuant to mutual aid agreements or other sharing arrangements that
				apply within the State, region, or directly eligible tribe, as applicable,
				during the previous fiscal year.</text>
											</subparagraph><subparagraph id="H36763A5E5BE14578BCEA3DF3438634EC"><enum>(C)</enum><text>How the funds were
				utilized by each ultimate recipient or beneficiary during the preceding fiscal
				year.</text>
											</subparagraph><subparagraph id="H229D154CAF4341539EDAB9A9592B01F1"><enum>(D)</enum><text>The extent to
				which capabilities identified in the applicable State homeland security plan or
				plans were achieved, maintained, or enhanced as the result of the expenditure
				of grant funds during the preceding fiscal year.</text>
											</subparagraph><subparagraph id="HE34827A059A940DCAE7B27335CBFEA18"><enum>(E)</enum><text>The extent to
				which capabilities identified in the applicable State homeland security plan or
				plans remain unmet.</text>
											</subparagraph></paragraph><paragraph id="HC03783466CAB4ED4A4C4CADC1429F777"><enum>(6)</enum><header>Inclusion of
				restricted annexes</header><text>A recipient of a covered grant may submit to
				the Secretary an annex to the annual report under paragraph (5) that is subject
				to appropriate handling restrictions, if the recipient believes that discussion
				in the report of unmet needs would reveal sensitive but unclassified
				information.</text>
										</paragraph></subsection><subsection id="H2C31359F66744FF58FE6B48CBD7677B0"><enum>(i)</enum><header>Incentives to
				Efficient Administration of Homeland Security Grants</header>
										<paragraph id="HC300E6BCA6BD4D8D886F7C9895D04710"><enum>(1)</enum><header>Penalties for
				delay in passing through local share</header><text>If a recipient of a covered
				grant that is a State fails to pass through to local governments, first
				responders, and other local groups funds or resources required by subsection
				(g)(1) within 45 days after receiving funds under the grant, the Secretary
				may—</text>
											<subparagraph id="H81636706FAFD46CCBFDC8300DF92E802"><enum>(A)</enum><text>reduce grant
				payments to the grant recipient from the portion of grant funds that is not
				required to be passed through under subsection (g)(1);</text>
											</subparagraph><subparagraph id="H0999AE6F7FCE4472A5D3AF7026F05844"><enum>(B)</enum><text>terminate payment
				of funds under the grant to the recipient, and transfer the appropriate portion
				of those funds directly to local first responders that were intended to receive
				funding under that grant; or</text>
											</subparagraph><subparagraph id="HAE3B63530B6C49BDBBAC04000028C220"><enum>(C)</enum><text>impose additional
				restrictions or burdens on the recipient’s use of funds under the grant, which
				may include—</text>
												<clause id="H35D9EFD5DAFB464385E8B9E2102DBA4C"><enum>(i)</enum><text>prohibiting use of
				such funds to pay the grant recipient’s grant-related overtime or other
				expenses;</text>
												</clause><clause id="HCB21A82941DC41198E57AF3E01FFEC5D"><enum>(ii)</enum><text>requiring the
				grant recipient to distribute to local government beneficiaries all or a
				portion of grant funds that are not required to be passed through under
				subsection (g)(1); or</text>
												</clause><clause id="H4BA3C3CEA79744DF00645952D96B8D22"><enum>(iii)</enum><text>for each day
				that the grant recipient fails to pass through funds or resources in accordance
				with subsection (g)(1), reducing grant payments to the grant recipient from the
				portion of grant funds that is not required to be passed through under
				subsection (g)(1), except that the total amount of such reduction may not
				exceed 20 percent of the total amount of the grant.</text>
												</clause></subparagraph></paragraph><paragraph id="HD6FBF2EA52D9490280A58F609BC59000"><enum>(2)</enum><header>Extension of
				period</header><text>The Governor of a State may request in writing that the
				Secretary extend the 45-day period under section 2003(e)(5)(E) or paragraph (1)
				for an additional 15-day period. The Secretary may approve such a request, and
				may extend such period for additional 15-day periods, if the Secretary
				determines that the resulting delay in providing grant funding to the local
				government entities that will receive funding under the grant will not have a
				significant detrimental impact on such entities’ terrorism preparedness
				efforts.</text>
										</paragraph><paragraph id="HC0913407F56B434FB79079CFCAB7A125"><enum>(3)</enum><header>Provision of
				non-local share to local government</header>
											<subparagraph id="H4A12C1F09EEF46EE005473CC164CC630"><enum>(A)</enum><header>In
				general</header><text>The Secretary may upon request by a local government pay
				to the local government a portion of the amount of a covered grant awarded to a
				State in which the local government is located, if—</text>
												<clause id="H916CF234083A4ADD82E39DEF2D5CFB"><enum>(i)</enum><text>the
				local government will use the amount paid to expedite planned enhancements to
				its terrorism preparedness as described in any applicable State homeland
				security plan or plans;</text>
												</clause><clause id="HC8857A2E7965403AABE7A9C07FCAB997"><enum>(ii)</enum><text>the State has
				failed to pass through funds or resources in accordance with subsection (g)(1);
				and</text>
												</clause><clause id="H21027E516B0040508EF02F688C6E4300"><enum>(iii)</enum><text>the local
				government complies with subparagraphs (B) and (C).</text>
												</clause></subparagraph><subparagraph id="HD8F9C0B94D504782AD7C660627C76BB3"><enum>(B)</enum><header>Showing
				required</header><text>To receive a payment under this paragraph, a local
				government must demonstrate that—</text>
												<clause id="HA93112EDB3BC42D79C7CB87F1E500071"><enum>(i)</enum><text>it
				is identified explicitly as an ultimate recipient or intended beneficiary in
				the approved grant application;</text>
												</clause><clause id="H5558036D93284A56BD3EA9E09FD2EEED"><enum>(ii)</enum><text>it was intended
				by the grantee to receive a severable portion of the overall grant for a
				specific purpose that is identified in the grant application;</text>
												</clause><clause id="H6FC1B7198E9747019DD1DAB540BCA170"><enum>(iii)</enum><text>it petitioned
				the grantee for the funds or resources after expiration of the period within
				which the funds or resources were required to be passed through under
				subsection (g)(1); and</text>
												</clause><clause id="H0A196D6812174C8BA9E46F5DB33A496"><enum>(iv)</enum><text>it
				did not receive the portion of the overall grant that was earmarked or
				designated for its use or benefit.</text>
												</clause></subparagraph><subparagraph id="H1011D0EA26FF4E48B94595FA634B71C9"><enum>(C)</enum><header>Effect of
				payment</header><text>Payment of grant funds to a local government under this
				paragraph—</text>
												<clause id="H9F1A000B43D24C33B8197D00E58DB9BC"><enum>(i)</enum><text>shall not affect
				any payment to another local government under this paragraph; and</text>
												</clause><clause id="H96C5FDCCB58E4CECA7FE66544305D750"><enum>(ii)</enum><text>shall not
				prejudice consideration of a request for payment under this paragraph that is
				submitted by another local government.</text>
												</clause></subparagraph><subparagraph id="HC52124F8F6AE40A499AAFC00CA8FF38"><enum>(D)</enum><header>Deadline for
				action by secretary</header><text>The Secretary shall approve or disapprove
				each request for payment under this paragraph by not later than 15 days after
				the date the request is received by the Department.</text>
											</subparagraph></paragraph></subsection><subsection id="H63A8F93C58EB41D18F6FF4FFE1D6538B"><enum>(j)</enum><header>Reports to
				Congress</header><text>The Secretary shall submit an annual report to Congress
				by January 31 of each year covering the preceding fiscal year—</text>
										<paragraph id="HC7DDC5BF548A4EB4913999BB3CFAFFFA"><enum>(1)</enum><text>describing in
				detail the amount of Federal funds provided as covered grants that were
				directed to each State, region, and directly eligible tribe in the preceding
				fiscal year;</text>
										</paragraph><paragraph id="H049A32151DE14847BE378E576013F9F"><enum>(2)</enum><text>containing
				information on the use of such grant funds by grantees; and</text>
										</paragraph><paragraph id="H4E8EBD3E4883453DBFDDA048C659DCA"><enum>(3)</enum><text>describing—</text>
											<subparagraph id="HA6EB84EDCFB3420091688EC07C1475D2"><enum>(A)</enum><text>the Nation’s
				progress in achieving, maintaining, and enhancing the capabilities established
				by the Secretary as a result of the expenditure of covered grant funds during
				the preceding fiscal year; and</text>
											</subparagraph><subparagraph id="H61ED0D25267B45B7B0096D6D158618D6"><enum>(B)</enum><text>an estimate of the
				amount of expenditures required to attain across the United States the
				essential capabilities established by the
				Secretary.</text>
											</subparagraph></paragraph></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section></title><title id="H54D9FC9A90144D55B9CA08C38F4407E"><enum>II</enum><header>Ensuring
			 Communications Interoperability for First Responders</header>
			<section display-inline="no-display-inline" id="HE46244676D4042B2991E46FCF9AF3869" section-type="subsequent-section"><enum>201.</enum><header>Improve
			 Communications for Emergency Response Grant Program</header>
				<subsection id="HB5FD0D23F3B54175A3A89E1FB4103699"><enum>(a)</enum><header>Establishment</header><text>Title
			 V of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/311">6 U.S.C. 311 et seq.</external-xref>) is amended by
			 adding at the end the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H610B21B61B3F444EB50154875B493052" style="OLC">
						<section id="H13D9CC303DFA4F498DB3943CAF4B4103"><enum>522.</enum><header>Improve
				Communications for Emergency Response Grant Program</header>
							<subsection id="H66D4E3DD9E724110AF6F5FD5C7068C33"><enum>(a)</enum><header>Establishment</header><text>The
				Secretary, acting through the Director of the Office of Grants and Training and
				in coordination with the Director for Emergency Communications, shall establish
				the Improve Communications for Emergency Response Grant Program to make grants
				to States and regions to carry out initiatives to improve interoperable
				emergency communications, including initiatives to achieve solutions to
				statewide, regional, national, and, where appropriate, international
				interoperability.</text>
							</subsection><subsection id="HFA57C400302448D0AE67AC6915FEE292"><enum>(b)</enum><header>Use of grant
				funds</header><text>A State or region receiving a grant under this section may
				use the grant for short-term or long-term goals for improving interoperable
				emergency communications, including interoperability within that State or
				region, and to assist with—</text>
								<paragraph id="HFC346630B4EA4E49BE9B7509A4652EF7"><enum>(1)</enum><text>statewide or
				regional communications planning;</text>
								</paragraph><paragraph id="HDD0758B0313E4D0EA9EDBC720263739F"><enum>(2)</enum><text>design and
				engineering for interoperable emergency communications systems;</text>
								</paragraph><paragraph id="HD03D669276244F45BB83D18E7C09F2EE"><enum>(3)</enum><text>procurement and
				installation of interoperable emergency communications equipment;</text>
								</paragraph><paragraph id="H4FB3175223EC46E8B46B721B56041F91"><enum>(4)</enum><text>interoperable
				emergency communications exercises;</text>
								</paragraph><paragraph id="HE20A18D7602543CFB575CF8798471D"><enum>(5)</enum><text>modeling and
				simulation exercises for operational command and control functions;</text>
								</paragraph><paragraph id="H5454BECDA41642EE00832B867C82BDD7"><enum>(6)</enum><text>technical
				assistance and training for interoperable emergency communications; and</text>
								</paragraph><paragraph id="H313C6F03ED584F68B48DA8239BA4DDFF"><enum>(7)</enum><text>other activities
				determined by the Secretary to be integral to interoperable emergency
				communications.</text>
								</paragraph></subsection><subsection id="H8738621303C646BE9889CEDEF28D9BA"><enum>(c)</enum><header>Region
				defined</header><text>For the purposes of this section, the term
				<quote>region</quote> means any combination of contiguous local government
				units, including such a combination established by law or mutual aid agreement
				between two or more local governments or governmental
				agencies.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HBB81277653FD4F1A94B8C9DCCF35BFE0"><enum>(b)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to the
			 Secretary of Homeland Security for grants under section 522 of the Homeland
			 Security Act of 2002, as added by subsection (a)—</text>
					<paragraph id="HEDC50CB44DA94CF6B5A78D1C02CCDB68"><enum>(1)</enum><text>such sums as may
			 be necessary for the first fiscal year that begins after the later of—</text>
						<subparagraph id="H06EF9F22D2A648C8A67B8E74EC8DA102"><enum>(A)</enum><text>the date on which
			 the Secretary of Homeland Security completes and submits to Congress the
			 National Emergency Communications Plan required under section 1802 of the
			 Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/572">6 U.S.C. 572</external-xref>);</text>
						</subparagraph><subparagraph id="H944F7886C7764289B9A22EFDE6F3F219"><enum>(B)</enum><text>the date on which
			 the Secretary of Homeland Security completes and submits to Congress the first
			 baseline interoperability assessment required under section 1803 of such Act (6
			 U.S.C. 573); or</text>
						</subparagraph><subparagraph id="H786F5221A7964E7980AC155307FD377C"><enum>(C)</enum><text>the date on which
			 the Secretary of Homeland Security, after consultation with the Director of
			 Emergency Communications, determines and notifies Congress that substantial
			 progress has been made towards the development and promulgation of voluntary
			 consensus-based interoperable communications standards pursuant to section
			 1801(c)(11) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/571">6 U.S.C. 571(c)(11)</external-xref>); and</text>
						</subparagraph></paragraph><paragraph id="H6A713F4FE3A9480195D15D972DA2B259"><enum>(2)</enum><text>such sums as may
			 be necessary for each subsequent fiscal year.</text>
					</paragraph></subsection><subsection id="HE67DBB5A9FFB4AD68ECD65728CA652A8"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of contents in section 1(b) of that Act is
			 amended by inserting after the item relating to section 521 the
			 following:</text>

			 Homeland Security Appropriations Act, 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/109/295">Public Law 109–295</external-xref>) is amended by
			 striking clauses (iv) and (v) and inserting the following:</text>

			 exercise program model exercises</header><text display-inline="no-display-inline">Section 648(b)(2)(B) of the Department of
			 Homeland Security Appropriations Act, 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/109/295">Public Law 109–295</external-xref>) is amended by
			 striking so much as precedes clause (i) and inserting the following:</text>

			 the Homeland Security Act of 2002 (enacted by section 611 of the Department of
			 Homeland Security Appropriations Act, 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/109/295">Public Law 109–295</external-xref>)) is amended by
			 striking <quote>and</quote> after the semicolon at the end of subparagraph (H),
			 by redesignating subparagraph (I) as subparagraph (J), and by inserting after
			 subparagraph (H) the following:</text>

			</section></title><title id="H39AE252FE2A447A80067145F5F5BE215"><enum>IV</enum><header>Strengthening
			 Aviation Security</header>
			<section display-inline="no-display-inline" id="H3066BB56A5F74FE0B1527B44F28F4153" section-type="subsequent-section"><enum>401.</enum><header>Installation of
			 in-line baggage screening equipment</header><text display-inline="no-display-inline">Not later than 30 days after the date of
			 enactment of this Act, the Secretary for Homeland Security shall submit to the
			 appropriate congressional committees the cost sharing study described in
			 section 4019(d) of the Intelligence Reform and Terrorism Prevention Act of 2004
			 (118 Stat. 3722), together with the Secretary’s analysis of the study, a list
			 of provisions of the study the Secretary intends to implement, and a plan and
			 schedule for implementation of such listed provisions.</text>
			</section><section display-inline="no-display-inline" id="HAA833425C3AE401D817944CDD2D6DDE" section-type="subsequent-section"><enum>402.</enum><header>Aviation security
			 capital fund</header>
				<subsection id="H68F9517988C44F66B7A846C0605E87F1"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/44923">Section 44923(h)(1)</external-xref> of title 49, United States Code, is
			 amended in the second sentence by striking <quote>2007</quote> and inserting
			 <quote>2011</quote>.</text>
				</subsection><subsection id="H856BD1E47B414F179613E0180061BCC"><enum>(b)</enum><header>Discretionary
			 grants</header><text>Section 44923(h)(3) of such title is amended by striking
			 <quote>for a fiscal year, $125,000,000</quote> and inserting <quote>,
			 $125,000,000 for each of fiscal years 2004, 2005, and 2006 and such sums as may
			 be necessary for each of fiscal years 2007 through 2011</quote>.</text>
				</subsection></section><section commented="no" id="H478CF75CD5234390B544EC7CA5E6AFBE"><enum>403.</enum><header>Airport
			 checkpoint screening explosive detection</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/44940">Section 44940</external-xref> of title 49, United States
			 Code, is amended—</text>
				<paragraph commented="no" id="H2370D5D8DEEE460DB64D59E59FF96120"><enum>(1)</enum><text>in subsection
			 (d)(4) by inserting <quote>, other than subsection (i),</quote> before
			 <quote>except to</quote>; and</text>
				</paragraph><paragraph commented="no" id="H49DF06CA3C454EAD9BD4401602A46EEC"><enum>(2)</enum><text>by adding at the
			 end the following:</text>

				is established in the Department of Homeland Security a fund to be known as the
				<quote>Checkpoint Screening Security Fund</quote>.</text>
							</paragraph><paragraph commented="no" id="H63DED763998C4F0694CD87955D9255FE"><enum>(2)</enum><header>Deposits</header><text>In
				fiscal year 2008, after amounts are made available under section 44923(h), the
				next $250,000,000 derived from fees received under subsection (a)(1) shall be
				available to be deposited in the Fund.</text>
							</paragraph><paragraph commented="no" id="H316E577BB909434B9CD76038003CC3DB"><enum>(3)</enum><header>Fees</header><text>The
				Secretary of Homeland Security shall impose the fee authorized by subsection
				(a)(1) so as to collect at least $250,000,000 in fiscal year 2008 for deposit
				into the Fund.</text>
							</paragraph><paragraph commented="no" id="H417E63430F644F1390EB115C798D9560"><enum>(4)</enum><header>Availability of
				amounts</header><text>Amounts in the Fund shall be available until expended for
				the research, development, purchase, deployment, and installation of equipment
				to improve the ability of security screening personnel at screening checkpoints
				to detect
				explosives.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H8B509B7495AD441FAE2E9E614756F7C1" section-type="subsequent-section"><enum>404.</enum><header>Strengthening
			 explosive detection at airport screening checkpoints</header><text display-inline="no-display-inline">Not later than 7 days after the date of
			 enactment of this Act, the Assistant Secretary for Homeland Security
			 (Transportation Security Administration) shall submit to the appropriate
			 congressional committees the strategic plan described in the section amended by
			 section 4013(a) of the Intelligence Reform and Terrorism Prevention Act of 2004
			 (118 Stat. 3719).</text>
			</section><section id="HD0760099B51040CF82EB57E22DE0E1ED"><enum>405.</enum><header>Extension of
			 authorization of aviation security funding</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/48301">Section 48301(a)</external-xref> of title 49, United States
			 Code, is amended by striking <quote>and 2006</quote> and inserting <quote>2006,
			 2007, 2008, 2009, 2010, and 2011</quote>.</text>
			</section><section id="HCCF33D92FA864EDE81E0BE5FD534BDFF" section-type="subsequent-section"><enum>406.</enum><header>Inspection of cargo
			 carried aboard passenger aircraft</header>
				<subsection id="H02DBF9E6DD21431C9600F6F803EB8C80"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/44901">Section 44901</external-xref> of title 49, United States Code, is
			 amended—</text>
					<paragraph id="H0AD0636B669A4387B452BCC431BFDEB"><enum>(1)</enum><text>by
			 redesignating subsections (g) and (h) as subsections (h) and (i), respectively;
			 and</text>
					</paragraph><paragraph id="H48514EC5CF8C448990393BEBB61EF442"><enum>(2)</enum><text>by inserting after
			 subsection (f) the following:</text>

				passenger aircraft</header>

				general</header><text>Not later than 3 years after the date of enactment of the
				<short-title>Implementing the 9/11 Commission
				Recommendations Act of 2007</short-title>, the Secretary of Homeland Security
				shall establish a system to inspect 100 percent of cargo transported on
				passenger aircraft operated by an air carrier or foreign air carrier in air
				transportation or intrastate air transportation to ensure the security of all
				such passenger aircraft carrying cargo.</text>
								</paragraph><paragraph commented="no" id="H7B183B8ADBD9469382B5EBD6F8D529C"><enum>(2)</enum><header>Minimum
				standards</header><text>The system referred to in paragraph (1) shall require,
				at a minimum, that equipment, technology, procedures, and personnel are used to
				inspect cargo carried on passenger aircraft to provide a level of security
				equivalent to the level of security for the inspection of passenger checked
				baggage as follows:</text>
									<subparagraph commented="no" id="HDD6B924890CD406F9F8E814BA1AB5D13"><enum>(A)</enum><text>35 percent of such
				cargo is so inspected by the end of fiscal year 2007.</text>
									</subparagraph><subparagraph commented="no" id="H994AB7CBF34E46D5862E8C704D82114D"><enum>(B)</enum><text>65 percent of such
				cargo is so inspected by the end of fiscal year 2008.</text>
									</subparagraph><subparagraph commented="no" id="H8B1FCB31B50140C3B7F197A55E75FBB"><enum>(C)</enum><text>100 percent of such
				cargo is so inspected by the end of fiscal year 2009.</text>
									</subparagraph></paragraph><paragraph id="HB4E9D1167A6C41F900C900D56D58D630"><enum>(3)</enum><header>Regulations</header><text display-inline="yes-display-inline"></text>
									<subparagraph id="H2E4D0B280AFE477A0094EDE08ADB21B"><enum>(A)</enum><header>Interim final
				rule</header><text>The Secretary of Homeland Security may issue an interim
				final rule as a temporary regulation to implement this subsection without
				regard to the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5.</text>
									</subparagraph><subparagraph id="H8C68BDBB2E9D499EA71441B60F09366"><enum>(B)</enum><header>Final
				rule</header>
										<clause id="H1707251A24684CB1A015D2B8824C6400"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">If the Secretary
				issues an interim final rule under subparagraph (A), the Secretary shall issue,
				not later than one year after the effective date of the interim final rule, a
				final rule as a permanent regulation to implement this subsection in accordance
				with the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5.</text>
										</clause><clause id="H6157C9307A5A48B5835D4BC07CA0FDC4"><enum>(ii)</enum><header>Failure to
				act</header><text>If the Secretary does not issue a final rule in accordance
				with clause (i) on or before the last day of the 1-year period referred to in
				clause (i), the interim final rule issued under subparagraph (A) shall not be
				effective after the last day of such period.</text>
										</clause><clause id="HEB33F4936E55405FB921E36186A2D9AF"><enum>(iii)</enum><header>Superceding of
				interim final rule</header><text>The final rule issued in accordance with this
				subparagraph shall supersede the interim final rule issued under subparagraph
				(A).</text>
										</clause></subparagraph></paragraph><paragraph commented="no" id="H08A66AE346574D7DBCB3192CB6716E8B"><enum>(4)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				establishment of the system under paragraph (1), the Secretary shall transmit
				to Congress a report that describes the
				system.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="H6CFA3488260B4C9BBAC6A781B0F03630"><enum>(b)</enum><header>Assessment of
			 exemptions</header>
					<paragraph id="H57D4A3B61F254EF5B4655642FF887207"><enum>(1)</enum><header>TSA assessment
			 of exemptions</header>
						<subparagraph display-inline="no-display-inline" id="H29B290D358724B02B8E3CF5F90B7248E"><enum>(A)</enum><header>In
			 general</header><text>Not later than 120 days after the date of enactment of
			 this Act, the Secretary of Homeland Security shall submit to the appropriate
			 committees of Congress and to the Comptroller General a report regarding an
			 assessment of each exemption granted for inspection of air cargo and an
			 analysis to assess the risk of maintaining such exemption.</text>
						</subparagraph><subparagraph id="H84DB73B2CDEB4F53A4C86445DA00089F"><enum>(B)</enum><header>Contents</header><text>The
			 report referred to in subparagraph (A) shall include—</text>
							<clause id="H3342BA39163C488C00850061002D73A"><enum>(i)</enum><text>the
			 rationale for each exemption;</text>
							</clause><clause id="HC3B7BFA2538247E59297AE43D123BED3"><enum>(ii)</enum><text>what percentage
			 of cargo is not screened as a result of each exemption;</text>
							</clause><clause id="H708ABC4FE403489A8FD72EA267D5201E"><enum>(iii)</enum><text>the impact of
			 each exemption on aviation security;</text>
							</clause><clause id="HFAFD760E30CB475B9C78BFB7511E946"><enum>(iv)</enum><text>the
			 projected impact on the flow of commerce of eliminating each exemption,
			 respectively, should the Secretary choose to take such action; and</text>
							</clause><clause id="H151540A4CF0B4C259FB680ADB54212C6"><enum>(v)</enum><text>plans and
			 rationale for maintaining, changing, or eliminating each exemption.</text>
							</clause></subparagraph></paragraph><paragraph id="HE4F6736D093F45A5A12597775000A463"><enum>(2)</enum><header>GAO
			 assessment</header><text>Not later than 120 days after the date on which the
			 report under paragraph (1) is submitted, the Comptroller General shall review
			 the report and provide to Congress an assessment of the methodology of
			 determinations made by the Secretary for maintaining, changing, or eliminating
			 an exemption.</text>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="H58CAA8D73C04474DA8B6E700C4088EC" section-type="subsequent-section"><enum>407.</enum><header>Appeal and redress
			 process for passengers wrongly delayed or prohibited from boarding a
			 flight</header>
				<subsection id="H7769C748D3D84CDD9BBBC3D859CE75FD"><enum>(a)</enum><header>In
			 general</header><text>Subtitle C of title IV of the Homeland Security Act of
			 2002 (6 U.S.C. 231 et. seq.) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H200061F23A65474990AE00FECDED7313" style="OLC">
						<section id="H4F8F6F168CC54A2A00C8BCBE97FB6849"><enum>432.</enum><header>Appeal and
				redress process for passengers wrongly delayed or prohibited from boarding a
				flight</header>
							<subsection id="H75CA35D82F654F4289BD3DC7D5F5FCC6"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				establish a timely and fair process for individuals who believe they have been
				delayed or prohibited from boarding a commercial aircraft because they were
				wrongly identified as a threat under the regimes utilized by the Transportation
				Security Administration, the Bureau of Customs and Border Protection, or any
				other Department entity.</text>
							</subsection><subsection id="H17B34D863B5F4D1CA7BEE02500485532"><enum>(b)</enum><header>Office of
				appeals and redress</header>
								<paragraph id="HBFF798D7C05A4CB7BB5D89BA4238200"><enum>(1)</enum><header>Establishment</header><text>The
				Secretary shall establish an Office of Appeals and Redress to oversee the
				process established by the Secretary pursuant to subsection (a).</text>
								</paragraph><paragraph id="H2E8D78FC2B214598AD3D1BE8E133B695"><enum>(2)</enum><header>Records</header><text>The
				process established by the Secretary pursuant to subsection (a) shall include
				the establishment of a method by which the Office of Appeals and Redress, under
				the direction of the Secretary, will be able to maintain a record of air
				carrier passengers and other individuals who have been misidentified and have
				corrected erroneous information.</text>
								</paragraph><paragraph id="H783D6BAE58394688807881C85000E678"><enum>(3)</enum><header>Information</header><text>To
				prevent repeated delays of a misidentified passenger or other individual, the
				Office of Appeals and Redress shall—</text>
									<subparagraph id="HE757F7FFF67D4DAF9DA614D26900E1E6"><enum>(A)</enum><text>ensure that the
				records maintained under this subsection contain information determined by the
				Secretary to authenticate the identity of such a passenger or individual;
				and</text>
									</subparagraph><subparagraph id="H0301A2688EAF469EB0EE6E020700B222"><enum>(B)</enum><text>furnish to the
				Transportation Security Administration, the Bureau of Customs and Border
				Protection, or any other appropriate Department entity, upon request, such
				information as may be necessary to allow such agencies to assist air carriers
				in improving their administration of the advanced passenger prescreening system
				and reduce the number of false positives.</text>
									</subparagraph></paragraph><paragraph id="H896025AE15DB49C8B356EB837C63100"><enum>(4)</enum><header>Initiation of
				appeal and redress process at airports</header><text display-inline="yes-display-inline">The Office of Appeals and Redress shall
				establish at each airport at which the Department has a significant presence a
				process to allow air carrier passengers to begin the appeals process
				established pursuant to subsection (a) at the
				airport.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HCF7E61F756884D15AB533CACA1B4B4C5"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of contents in section 1(b) of such Act is
			 amended by inserting after the item relating to section 430 the
			 following:</text>

				</subsection></section><section display-inline="no-display-inline" id="H48D77DF0041A441B96ACE70037003D4C" section-type="subsequent-section"><enum>408.</enum><header>Transportation
			 Security Administration personnel management</header>
				<subsection id="H2B097F5E163B49C49DC1EE2F911C2034"><enum>(a)</enum><header>Elimination of
			 certain personnel management authorities</header><text>Effective 90 days after
			 the date of the enactment of this Act—</text>
					<paragraph id="H03797E2FF6C942A7886CBCAD001000D3"><enum>(1)</enum><text>section 111(d) of
			 the Aviation and Transportation Security Act (<external-xref legal-doc="usc" parsable-cite="usc/49/44935">49 U.S.C. 44935</external-xref> note) is repealed
			 and any authority of the Secretary of Homeland Security derived from such
			 section 111(d) shall terminate;</text>
					</paragraph><paragraph id="H2C8F6FB490E24ABDA54FEA5D303D838"><enum>(2)</enum><text>any personnel
			 management system, to the extent established or modified pursuant to such
			 section 111(d) (including by the Secretary through the exercise of any
			 authority derived from such section 111(d)) shall terminate; and</text>
					</paragraph><paragraph id="H6A244F96D9B14737801B1CB805C2A00"><enum>(3)</enum><text>the Secretary shall
			 ensure that all TSA employees are subject to the same personnel management
			 system as described in subsection (e)(1) or (e)(2).</text>
					</paragraph></subsection><subsection id="HBBE4B84B0A914748851728E9F400EB23"><enum>(b)</enum><header>Establishment of
			 certain uniformity requirements</header>
					<paragraph id="H6BDA756F915F40A1BFE833EF15007D9F"><enum>(1)</enum><header>System under
			 subsection <enum-in-header>(e)(1)</enum-in-header></header><text>The Secretary
			 shall, with respect to any personnel management system described in subsection
			 (e)(1), take any measures which may be necessary to provide for the uniform
			 treatment of all TSA employees under such system.</text>
					</paragraph><paragraph id="HDE843B89D79B4358A7EC704BAA000300"><enum>(2)</enum><header>System under
			 subsection <enum-in-header>(e)(1)</enum-in-header></header><text>Section
			 9701(b) of title 5, United States Code, is amended—</text>
						<subparagraph id="H5A50D97FF49F4919B0E5A92B721BE3FB"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (4);</text>
						</subparagraph><subparagraph id="H1D3467258825408C9DB0630008A12E4F"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (5) and inserting <quote>; and</quote>;
			 and</text>
						</subparagraph><subparagraph id="H03AF76B81DBA47749F8121879661E4DE"><enum>(C)</enum><text>by adding at the
			 end the following new paragraph:</text>
							<quoted-block display-inline="no-display-inline" id="HF5406BD9DB0D4BC39DF89B1152D0647B" style="USC">
								<paragraph id="H227F0382230742CC859ED900837BAD99"><enum>(6)
				</enum><text>provide for the uniform treatment of all TSA employees (as defined
				in section 408(d) of the <short-title>Implementing the
				9/11 Commission Recommendations Act of
				2007</short-title>).</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="HE6871A53F413498BAF00483B6F436C8D"><enum>(3)</enum><header>Effective
			 date</header>
						<subparagraph id="H5FCE316014DA4A4A8C52ECA33F4C11CE"><enum>(A)</enum><header>Provisions
			 relating to a system under subsection
			 <enum-in-header>(e)(1)</enum-in-header></header><text>Any measures necessary to
			 carry out paragraph (1) shall take effect 90 days after the date of the
			 enactment of this Act.</text>
						</subparagraph><subparagraph id="H5258211497B642BCB4DD8EE4D3C8B2C"><enum>(B)</enum><header>Provisions
			 relating to a system under subsection
			 <enum-in-header>(e)(2)</enum-in-header></header><text>Any measures necessary to
			 carry out the amendments made by paragraph (2) shall take effect 90 days after
			 the date of the enactment of this Act or, if later, the commencement date of
			 the system involved.</text>
						</subparagraph></paragraph></subsection><subsection id="H3C63AFB211014014B3A5C92E5E6363A0"><enum>(c)</enum><header>Report to
			 Congress</header>
					<paragraph id="HE749D45AFF504E4B894EC5BC1315CEB7"><enum>(1)</enum><header>Report
			 required</header><text>Not later than 6 months after the date of the enactment
			 of this Act, the Government Accountability Office shall submit to the Committee
			 on Homeland Security of the House of Representatives and the Committee on
			 Homeland Security and Governmental Affairs of the Senate a report on—</text>
