<official-title display="yes">To improve teleworking in executive agencies by developing a telework program that allows employees to telework at least 20 percent of the hours worked in every 2 administrative workweeks, and for other purposes.</official-title>

<section id="HA2C49E9B114F4EA893A2DDBA3124F00" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Telework Improvements Act of 2008</short-title></quote>.</text></section> 
<section id="H513B83C0A5D0430F8175DE3B396BEE21"><enum>2.</enum><header>Telework</header> 
<subsection id="H2CD56D9BE6354B2C00F621DBC0001B19"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part III of title 5, United States Code, is amended by inserting after chapter 63 the following:</text>

<section id="HDE3700C066E344EEAEF404C100383C7F"><enum>6501.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this chapter—</text> 
<paragraph id="H537394D57EDD4C9DB7D70055D218A769"><enum>(1)</enum><text>the term <term>agency</term> means an Executive agency (as defined by section 105), except as provided in section 6506(c); </text></paragraph> 
<paragraph id="HA56D97D561FF4B79AFA40504B938A789"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>telework</term> or <term>teleworking</term> refers to a work arrangement under which an employee regularly performs the duties and responsibilities of such employee’s position, and other authorized activities, from home or another worksite removed from the employee’s regular place of employment; and</text></paragraph> 
<paragraph id="HCBDC9CD44C9443F187D9AA007BEC64F"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>continuity of operations</term> refers to an effort within individual executive departments and agencies to ensure that primary mission essential functions continue to be performed during a wide range of emergencies, including localized acts of nature, accidents, public health emergencies, and technological or attack-related emergencies.</text></paragraph></section> 
<section id="HBC921917C77E47A083304790B8A4ECBF"><enum>6502.</enum><header>Governmentwide telework requirement</header> 
<subsection id="H47F76CCA50DE46E6B337DDFEB97B53BA"><enum>(a)</enum><header>Telework requirement</header> 
<paragraph id="H454554FCC8BA48B09989D3E38800AD9F"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this chapter, the head of each agency shall establish a policy under which employees shall be authorized to telework, subject to paragraph (2) and subsection (b).</text></paragraph> 
<paragraph id="HC11190FAC87048509900979CC3E4ED2B"><enum>(2)</enum><header>Regulations</header><text>The policy of each agency under this subsection—</text> 
<subparagraph id="H99B57AAE78394A408656D3B097C98F59"><enum>(A)</enum><text>shall be in conformance with regulations which the Administrator of General Services shall, within 120 days after the date of the enactment of this chapter and in coordination with the Office of Personnel Management, prescribe for purposes of this subsection; and</text></subparagraph> 
<subparagraph id="HB16CB0E951FF4D2F97B88001BF2C0700"><enum>(B)</enum><text>shall ensure that employees are authorized to telework—</text> 
<clause id="HB0557A86F123441BA1A0E594E20014B1"><enum>(i)</enum><text>to the maximum extent possible; and</text></clause> 
<clause id="H1D47BF0A51114F3FB882C84EF88E5C1"><enum>(ii)</enum><text>without diminishing employee performance or agency operations.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HC8A8350B11CB4D149FD878EC5D1C5266" display-inline="no-display-inline"><enum>(b)</enum><header>Treatment of certain circumstances</header><text display-inline="yes-display-inline">Nothing in subsection (a) shall be considered—</text> 
<paragraph id="HF8D54DA575134D1B98E8567848610454"><enum>(1)</enum><text>to require the head of an agency to authorize teleworking in the case of an employee whose duties and responsibilities—</text> 
<subparagraph id="HDC49C2057327470D906E5DFF603FF093"><enum>(A)</enum><text display-inline="yes-display-inline">require daily access to classified information; </text></subparagraph> 
<subparagraph id="H33366EC7C3BE4472B774919FA5EEF55"><enum>(B)</enum><text>require daily face-to-face contact with members of the public or other persons, or the use of equipment, at the employee’s regular place of employment; or</text></subparagraph> 
<subparagraph id="HF52BB83033F64A8196CA34CAEF7B132C"><enum>(C)</enum><text>are such that their performance from a site removed from the employee’s regular place of employment is not feasible; or</text></subparagraph></paragraph> 
<paragraph id="H010072FD772A433DA86FC05A2D42E3"><enum>(2)</enum><text>to prevent the temporary denial of permission for an employee to telework if, in the judgment of the agency head—</text> 
<subparagraph id="H21E31751FE994741BBC36707290074C0"><enum>(A)</enum><text>the employee is needed to respond to an emergency;</text></subparagraph> 
<subparagraph id="H2E8010DA01E2447D9FEF578E2825B8F"><enum>(B)</enum><text>the employee requires additional training; or</text></subparagraph> 
<subparagraph id="H4A27456FDC4E4565835858EF04B95E7E"><enum>(C)</enum><text>the denial is necessary, for a specific or ascertainable period of time, to achieve goals and objectives of programs administered by the agency.</text></subparagraph></paragraph></subsection> 
<subsection id="H08BC03F394D64EA098CAD7B900DCD951"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this chapter shall—</text> 
<paragraph id="HFCE80BE74D1D4538AF564F96CA004C1C"><enum>(1)</enum><text>be considered to require any employee to telework; or</text></paragraph> 
<paragraph id="HCFDAC2B164E4457DB56EE389AED87B7F"><enum>(2)</enum><text display-inline="yes-display-inline">prevent an agency from permitting an employee to telework as part of a continuity of operations plan.</text></paragraph></subsection></section> 
<section id="H36BC7570DE4F431181EFAF5F80D3C303"><enum>6503.</enum><header>Implementation</header><text display-inline="no-display-inline">In order to carry out the purposes of this chapter—</text> 
<paragraph id="HD446DA52FBE84EE2A56F54CD2803A1DA"><enum>(1)</enum><text>the head of each agency shall ensure that—</text> 
<subparagraph id="H9E2300BFC66C4CA0984DEBFF23D639"><enum>(A)</enum><text>appropriate training is provided to supervisors and managers and to all employees who are authorized to telework; and</text></subparagraph> 
<subparagraph id="HEF34D84FCF964F80813C9682F0F5F800"><enum>(B)</enum><text>no distinction is made between teleworkers and nonteleworkers for purposes of performance appraisals; </text></subparagraph></paragraph> 
<paragraph id="HE99E5EA1D15F44F7A700349C7423EA7E" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the General Services Administration, in coordination with the Office of Personnel Management, shall provide advice, assistance, and, to the extent necessary, training to agencies, including with respect to—</text> 
<subparagraph id="H0FC3C1C488334A2A890255A0672125D2"><enum>(A)</enum><text>questions of eligibility to telework, including considerations relating to employee performance; and</text></subparagraph> 
<subparagraph id="H1B4BD228A9394826830782FCF0650437"><enum>(B)</enum><text>making telework part of the agency’s goals, including those of individual supervisors and managers;</text></subparagraph></paragraph> 
<paragraph id="HD7421601ABD945CD87BBA57D3A295D5"><enum>(3)</enum><text>the General Services Administration, in coordination with the Office of Management and Budget and the National Institute of Standards and Technology, shall prescribe regulations, within 120 days after the date of the enactment of this chapter, to ensure the adequacy of information and security protections for information and information systems used in, or otherwise affected by, teleworking; such regulations shall be consistent with information security policies and guidance issued by the Office of Management and Budget and the National Institute of Standards and Technology, and shall, at a minimum, include requirements necessary—</text> 
<subparagraph id="HD18D61990E734EEDA8DAD7B1AA00DA"><enum>(A)</enum><text>to control access to agency information and information systems;</text></subparagraph> 
<subparagraph id="H3912E5F07A194D94B053DFB4D0348D2"><enum>(B)</enum><text>to protect agency information (including personally identifiable information) and information systems;</text></subparagraph> 
<subparagraph id="H27159F54F2D248E28895AFAB64C5A00"><enum>(C)</enum><text>to limit the introduction of vulnerabilities;</text></subparagraph> 
<subparagraph id="HDC0CCC15BBEA476B8376746DB73C8F4F"><enum>(D)</enum><text>to protect information systems not under the control of the agency that are used for teleworking; and</text></subparagraph> 
<subparagraph id="H59B803F963DB4195ABD7A173668B995B"><enum>(E)</enum><text display-inline="yes-display-inline">to safeguard the use of wireless and other telecommunications capabilities used for telework purposes; and</text></subparagraph></paragraph> 
<paragraph id="H2F3088D9C7B6484DA0BA789176E8F9D8" display-inline="no-display-inline"><enum>(4)</enum><text>the General Services Administration shall—</text> 
<subparagraph id="HE530DDF7E5184A9A91B12D9E99F2B82"><enum>(A)</enum><text>maintain a central, publicly available telework website to be jointly controlled and funded by the General Services Administration and the Office of Personnel Management; and</text></subparagraph> 
<subparagraph id="H71260200465348959044392055310115"><enum>(B)</enum><text>include on that website any regulations relating to telework and any other information the General Services Administration and the Office of Personnel Management consider appropriate.</text></subparagraph></paragraph></section> 
<section id="H4025D7BD53614EAEA400AFE2E6E2DD70"><enum>6504.</enum><header>Telework Managing Officer</header> 
<subsection id="HCAB04326739749E4B7F7FBE0DF24C07"><enum>(a)</enum><header>Appointment and compensation</header> 
<paragraph id="H1CD2552B1FB54139BE83ED4B618B5031"><enum>(1)</enum><header>In general</header><text>Each agency may appoint an officer to be known as the <quote>Telework Managing Officer</quote>. If an agency appoints a Telework Managing Officer, such Officer—</text> 
<subparagraph id="HBA9EAEA34F934B65BF3C47219254C505"><enum>(A)</enum><text>shall be appointed—</text> 
<clause id="H99E9AC570EC640E100DA50428271C565"><enum>(i)</enum><text>by the Chief Human Capital Officer of such agency; or</text></clause> 
<clause id="H85F9113F5FCE4C88862FAC339EC3DD2C"><enum>(ii)</enum><text>if none, by the head of such agency; and</text></clause></subparagraph> 
<subparagraph id="HDFA23B0DF4A04A7DBC2D851F56C82657"><enum>(B)</enum><text>shall be compensated at a rate not less than the minimum rate of basic pay for grade GS–15 of the General Schedule.</text></subparagraph></paragraph> 
<paragraph id="H22A2C361795A4F41B23634F57DF252D7"><enum>(2)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Administrator of General Services may waive the minimum rate requirement under paragraph (1)(B) with respect to an agency if such agency has fewer than 100 employees (determined on a full-time equivalent basis) and the head of such agency certifies that being required to comply with paragraph (1)(B) would adversely impact agency operations.</text></paragraph></subsection> 
<subsection id="H39FDA44094AB402F88786E7703750093"><enum>(b)</enum><header>Limitations</header><text display-inline="yes-display-inline">An individual may not hold the position of Telework Managing Officer as a noncareer appointee (as defined in section 3132(a)(7)), and such position may not be considered or determined to be of a confidential, policy-determining, policy-making, or policy-advocating character.</text></subsection> 
<subsection id="HBFC1067B3700405C82B8637BB4B8E5C7" commented="no"><enum>(c)</enum><header>Duties and responsibilities</header><text>The duties and responsibilities of the Telework Managing Officer of an agency shall be as follows:</text> 
<paragraph id="HC1A756BB91A94FADAEFD2CA5BD40D57C" commented="no"><enum>(1)</enum><text>Serving as—</text> 
<subparagraph id="HE19DA6F4C1D54BFC815C325C7BE4355E" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">an advisor on teleworking to the head of such agency and to the Chief Human Capital Officer of such agency (if any);</text></subparagraph> 
<subparagraph id="HA59AA24AB4314101AD729E8F5525B997" commented="no"><enum>(B)</enum><text>a resource on teleworking for supervisors, managers, and employees of such agency; and</text></subparagraph> 
<subparagraph id="H346E4261984241E3BBB93CC3DF92E31E" commented="no"><enum>(C)</enum><text>the agency’s primary point of contact on teleworking matters for employees of such agency, Congress, and other agencies.</text></subparagraph></paragraph> 
<paragraph id="H11BF10A16BC840DB882C384661F84FC" commented="no"><enum>(2)</enum><text>Ensuring that the agency’s teleworking policy is communicated effectively to employees.</text></paragraph> 
<paragraph id="H18D01824449745AAB964E64436B77700" commented="no"><enum>(3)</enum><text>Ensuring that electronic or written notification is provided to each employee of specific telework programs and the agency’s teleworking policy, including authorization criteria and application procedures.</text></paragraph> 
<paragraph id="HBAE5E461729B403182705F316C7CCA49" commented="no"><enum>(4)</enum><text>Developing and administering a tracking system for compliance with Governmentwide telework reporting requirements.</text></paragraph> 
<paragraph id="H30DCE9FE88324746AC37ECB89FB7993F"><enum>(5)</enum><text>Providing to the Comptroller General and to the Administrator of General Services such information as the Comptroller General may require to prepare the annual reports under section 6505(b).</text></paragraph> 
<paragraph id="H8F299D71B3164CD788D71D3880762EAB"><enum>(6)</enum><text>Establishing a system for receiving feedback from agency employees on the agency’s telework policy.</text></paragraph> 
<paragraph id="H6CBF12B2F9FF4F4B0056EB05BA80FCA7"><enum>(7)</enum><text>Developing and implementing a program to identify and remove barriers to telework and to maximize telework opportunities in the agency.</text></paragraph> 
<paragraph id="H565C9ACACEB84279AC31CB216230BEF3"><enum>(8)</enum><text>Ensuring that employees are notified of grievance procedures available to them (if any) with respect to any disputes that relate to telework.</text></paragraph> 
<paragraph id="H3EB4ECCA827C4D2EBDBFAC89C8DD08CE"><enum>(9)</enum><text>Performing such other duties and responsibilities relating to telework as the head of the agency may require.</text></paragraph></subsection> 
<subsection id="H7948A669EF3140C600702538CFADA00"><enum>(d)</enum><header>Alternative to Telework Managing Officer</header><text display-inline="yes-display-inline">If no Telework Managing Officer is appointed under subsection (a) with respect to an agency, the duties and responsibilities of a Telework Managing Officer shall be carried out by the Chief Human Capital Officer of, or a career employee in, such agency, as determined by the agency head.</text></subsection></section> 
<section id="H75A63A87B21340AF00E7033C36EE8B00"><enum>6505.</enum><header>Evaluating telework in agencies</header> 
<subsection id="HD6E7D975287240D28292D02729E51831"><enum>(a)</enum><header>In general</header><text>The Comptroller General shall establish a system for evaluating—</text> 
<paragraph id="HB06DDE3CB6A24A0AA27764016ED165B3"><enum>(1)</enum><text>the telework policy of each agency; and</text></paragraph> 
<paragraph id="HA632387EAA3642F8B7F1E992259C7BCF"><enum>(2)</enum><text>employee participation in telework programs at each agency.</text></paragraph></subsection> 
<subsection id="H9AC4018419EA495D9306B25C4146476F" commented="no"><enum>(b)</enum><header>Annual report</header><text display-inline="yes-display-inline">The Comptroller General shall, based on the system established under subsection (a), submit an annual report to the Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate. Each report under this subsection shall, with respect to the period covered by such report—</text> 
<paragraph id="H1771415B3DC447F587532DD3D4526143" commented="no"><enum>(1)</enum><text>evaluate the telework policy of each agency; </text></paragraph> 
<paragraph id="HB7236DD4811B461A8C6DD9CE85F68100" commented="no"><enum>(2)</enum><text>for each agency, indicate the total number of employees in such agency and identify—</text> 
<subparagraph id="H67D55DA32EC84325B700BFA6FC946C9C" commented="no"><enum>(A)</enum><text>the number and percentage of employees who were eligible to telework;</text></subparagraph> 
<subparagraph id="HEAEFF0087C3C43AFBF8735D2EB163E16" commented="no"><enum>(B)</enum><text>the number and percentage of employees who teleworked an average of at least once a week on a regular basis, determined based on time spent actually teleworking;</text></subparagraph> 
<subparagraph id="HB4BAA815D4124366AF4BF98DD82871D"><enum>(C)</enum><text>the number and percentage of employees who teleworked an average of at least 20 percent of the hours that they worked in every 2 administrative workweeks, determined based on time spent actually teleworking;</text></subparagraph> 
<subparagraph id="H759A7944B16047A2BD7355AC7EECC6A1" commented="no"><enum>(D)</enum><text>the number and percentage of employees who teleworked at least once a month on a regular basis, determined based on time spent actually teleworking;</text></subparagraph> 
<subparagraph id="H5390BD40B22E40CF989138B7D4270141" commented="no"><enum>(E)</enum><text>the number and percentage of employees who were not authorized to telework and the reasons why they were not so authorized;</text></subparagraph> 
<subparagraph id="HDFC7FCF6152A45AC9513A3EF4100A41D"><enum>(F)</enum><text>the number and percentage of employees who were authorized to telework and then later stopped teleworking, the reasons why those employees stopped teleworking, and whether their stopping was voluntary or due to other factors, such as office coverage needs or productivity; </text></subparagraph> 
<subparagraph id="H5D02FC01BE084827ACCDC8E0038134C" commented="no"><enum>(G)</enum><text>the extent to which barriers to maximizing teleworking opportunities have been identified and eliminated;</text></subparagraph> 
<subparagraph id="HE1B22F5C7F444E9A00D54379008D003C"><enum>(H)</enum><text>the impact (if any) of the agency’s telework policy on the recruitment and retention of employees;</text></subparagraph> 
<subparagraph id="H2F74B82157CC4689B700D2C630C42CC"><enum>(I)</enum><text>the impact (if any) of the agency’s telework policy on the performance of agency employees; and</text></subparagraph> 
<subparagraph id="HEF8210580DCA48F084CD3F9978766D4B"><enum>(J)</enum><text>the level of employee satisfaction with the agency’s telework policy, determined based on employee feedback;</text></subparagraph></paragraph> 
<paragraph id="H56DE21DC979F4246807D4362D1EBF22" commented="no"><enum>(3)</enum><text>evaluate the compliance of each agency with the requirements of this chapter; and</text></paragraph> 
<paragraph id="H020B8D055F4E4628B8522E4619C6D7C2" commented="no"><enum>(4)</enum><text>identify best practices in agency telework programs.</text></paragraph><continuation-text continuation-text-level="subsection">A report under this subsection shall be submitted for the year in which the regulations under section 6502(a)(2)(A) take effect and for each of the 4 succeeding years. Each such report shall be submitted within 6 months after the end of the year to which it relates.</continuation-text></subsection> 
<subsection id="HAD89C3BEC4074D899021005BC4DA5E"><enum>(c)</enum><header>Minimum requirement for compliance</header><text>For purposes of subsection (b)(3), an agency shall not be considered to be in compliance with the requirements of this chapter unless the employees of such agency who were authorized to telework were permitted to telework for at least 20 percent of the hours that they worked in every 2 administrative workweeks (disregarding any workweeks for which such employees did not submit a request or for which they were otherwise ineligible to telework).</text></subsection></section> 
<section id="H808B46B6D2A94F7BAEF0A6B3BF54385F"><enum>6506.</enum><header>Continuity of operations</header> 
<subsection id="HB618D100F9B94E6AA43E84AFF93F72BC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The head of each agency shall ensure that—</text> 
<paragraph id="HD8E5B3896C314285A2FA9568206BF85B"><enum>(1)</enum><text>to the maximum extent practicable, telework is incorporated into the continuity of operations planning of such agency; and</text></paragraph> 
<paragraph id="HB8646AA2F93F4C1CBCFCFFBCF7004B34"><enum>(2)</enum><text>mission critical personnel, as determined by the head of such agency, are equipped to telework in time of a catastrophe.</text></paragraph></subsection> 
<subsection id="HB8C31C10796747F392A81BEEC61F97B8"><enum>(b)</enum><header>Coordination rule</header><text>The continuity of operations plan of an agency shall supersede any telework policy of such agency to the extent that they are inconsistent with one another.</text></subsection> 
<subsection id="H14635F9DBD0744519D17A81459771CFC"><enum>(c)</enum><header>Agency defined</header><text>For purposes of carrying out subsection (a)(2), the term <term>agency</term> means an agency named in paragraph (1) or (2) of <external-xref legal-doc="usc" parsable-cite="usc/31/901">section 901(b)</external-xref> of title 31. </text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0C357AF0A5754679BA9D1087B1C47AD"><enum>(b)</enum><header>Technical and conforming amendments</header>

<subsection id="H2D97CD439D26444E972680BC5382AE12"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/14">Chapter 14</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>

<section id="HCAFECE55F6CB419BABDA001CC9CB27EF"><enum>1421.</enum><header>Chief Human Capital Officers Council</header> 
<subsection id="HE65A1FC3D8F34168B8FACD8E4E981136"><enum>(a)</enum><header>Establishment</header><text>There is established a Chief Human Capital Officers Council, consisting of—</text> 
<paragraph id="HC996310E4B2D441E89078FED1F5195FB"><enum>(1)</enum><text>the Director of the Office of Personnel Management, who shall act as chairperson of the Council;</text></paragraph> 
<paragraph id="HA4F519585E684C1786753B78D5B1D76C"><enum>(2)</enum><text>the Deputy Director for Management of the Office of Management and Budget, who shall act as vice chairperson of the Council;</text></paragraph> 
<paragraph id="H38CCA20903AE48DDBFE2CF005F96553E"><enum>(3)</enum><text>the Administrator of General Services; and</text></paragraph> 
<paragraph id="H5E73BD5F166C4B8EA4E9741A41406A6"><enum>(4)</enum><text>the Chief Human Capital Officers of Executive departments and any other members who are designated by the Director of the Office of Personnel Management.</text></paragraph></subsection> 
<subsection id="H297855886A3147999F96955500E24232"><enum>(b)</enum><header>Functions</header><text>The Chief Human Capital Officers Council shall meet periodically to advise and coordinate the activities of the agencies of its members on such matters as modernization of human resources systems, improved quality of human resources information, telework (as defined by section 6501), and legislation affecting human resources operations and organizations.</text></subsection> 
<subsection id="H2CF9921981394BF8848D67728E9699BF"><enum>(c)</enum><header>Employee labor organizations at meetings</header><text>The Chief Human Capital Officers Council shall ensure that representatives of Federal employee labor organizations are present at a minimum of 1 meeting of the Council each year. Such representatives shall not be members of the Council.</text></subsection> 
<subsection id="HB49DCB0908AD42D0B318003875BDBE19"><enum>(d)</enum><header>Annual report</header><text>Each year, the Chief Human Capital Officers Council shall submit a report to Congress on the activities of the Council.</text></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="HE04BED3C6F6F4562B389ED75769CADD"><enum>(a)</enum><header>Incorporation of telework into continuity of operations planning</header><text display-inline="yes-display-inline">Within 12 months after the effective date of the regulations under <external-xref legal-doc="usc" parsable-cite="usc/5/6502">section 6502(a)(2)(A)</external-xref> of title 5, United States Code (as amended by section 2), the General Services Administration, in coordination with the Office of Personnel Management, the Federal Emergency Management Agency, and the Chief Human Capital Officers Council, shall report to the appropriate committees of Congress on the incorporation of telework into agencies’ continuity of operations planning, including—</text> 
<paragraph id="H3F617EA39DAD4EE1ADEB00E149D82248"><enum>(1)</enum><text>the extent to which such incorporation has occurred within each of the respective agencies;</text></paragraph> 
<paragraph id="H3064E2AD66EA475AAD00BAD05E9C998"><enum>(2)</enum><text>the extent to which each agency has conducted continuity of operations tests and exercises incorporating telework for essential and non-essential personnel;</text></paragraph> 
<paragraph id="H27C3990024D74C25BD5D105D206647A5"><enum>(3)</enum><text>the extent to which agencies have used telework in response to emergencies; and </text></paragraph> 
<paragraph id="H00678087564D4D7D98162D69AA755EC2"><enum>(4)</enum><text>any recommendations the General Services Administration considers appropriate.</text></paragraph></subsection> 
<subsection id="H44D619336A824B4BAADA3D9E01947CA8"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section—</text> 
<paragraph id="H44E7561DA47548799B3D24CD4C84F466"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>appropriate committees of Congress</term> means the Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate;</text></paragraph> 
<paragraph id="HB092AA79288B4D4D93404B0560AC03A9"><enum>(2)</enum><text>the terms <term>telework</term> and <term>continuity of operations</term> have the meanings given those terms by <external-xref legal-doc="usc" parsable-cite="usc/5/6501">section 6501</external-xref> of title 5, United States Code (as amended by section 2); and</text></paragraph> 
<paragraph id="H7F033F8D20F34EE1906E9B9494627447"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>agency</term> means an agency named in paragraph (1) or (2) of <external-xref legal-doc="usc" parsable-cite="usc/31/901">section 901(b)</external-xref> of title 31, United States Code. </text></paragraph></subsection></section>
