<section id="H9DB8C69A96EC44478735A32DBBC52DD2"><enum>101.</enum><header>General definition of Institution of higher education</header>
<subsection id="H844F52C8D6964056B251986C1DE119E2"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 101 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>) is amended—</text>
<paragraph display-inline="no-display-inline" id="H259D94B437784823A89DEFDC8FAF4113"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
<subparagraph display-inline="no-display-inline" id="HA8AFFD9CDD6944A496AF7D51421E7A3"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting before the semicolon the following: <quote>, or persons who meet the requirements of section 484(d)(3)</quote>; and</text></subparagraph>

<section commented="no" display-inline="no-display-inline" id="H68770E24214C4A138EE6A67704598515" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Definition of institution of higher education for purposes of title <enum-in-header>IV</enum-in-header> programs</header>
<subsection commented="no" display-inline="no-display-inline" id="H62A0B866F1214EF499DD657F23F8E00"><enum>(a)</enum><header>International medical schools and nursing schools</header><text>Section 102(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(a)(2)</external-xref>) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H1F4D86EDC4CD41B59C0710C970F3AFE4"><enum>(1)</enum><text>in subparagraph (A)—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H5EB432E5EFD34F8DBE008C1C014DFFCE"><enum>(A)</enum><text>in the first sentence of the matter preceding clause (i), by inserting <quote>nursing school,</quote> after <quote>graduate medical school,</quote>;</text></subparagraph>

<item commented="no" display-inline="no-display-inline" id="H78782F7E0FCE4403A9459E12EFD692E6"><enum>(bb)</enum><text>continues to operate a clinical training program in at least one State that is approved by that State;</text></item></subclause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HC7DDA6221DC54C47929D451DAB5B42EA"><enum>(C)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H0E051391351141D78314EFDE8900CD80"><enum>(D)</enum><text>by adding at the end the following:</text>

<clause commented="no" display-inline="no-display-inline" id="HA320CBC0900D43869937D0A8724CB660"><enum>(iii)</enum><text>in the case of a nursing school located outside of the United States—</text>
<subclause commented="no" display-inline="no-display-inline" id="H1D444D55BEA64C07AA26613C238B6F57"><enum>(I)</enum><text>the nursing school has an agreement with a hospital, or accredited school of nursing (as such terms are defined in section 801 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/296">42 U.S.C. 296</external-xref>)), located in the United States that requires the students of the nursing school to complete the students' clinical training at such hospital or accredited school of nursing;</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H7DF5CA82AF4546169F301D9DFA427631"><enum>(II)</enum><text>the nursing school has an agreement with an accredited school of nursing located in the United States providing that the students graduating from the nursing school located outside of the United States also receive a degree from the accredited school of nursing located in the United States;</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H96B5CE404B184F4E889977D5AF75A56F"><enum>(III)</enum><text>the nursing school certifies only Federal Stafford Loans under section 428, unsubsidized Federal Stafford Loans under section 428H, or Federal PLUS loans under section 428B for students attending the institution;</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H89C812CBC512452CB2A202007E00228E"><enum>(IV)</enum><text>the nursing school reimburses the Secretary for the cost of any loan defaults for current and former students included in the calculation of the institution's cohort default rate during the previous fiscal year; and</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="HA5937E2E82B448C8B063851721CC35C5"><enum>(V)</enum><text>not less than 75 percent of the individuals who were students or graduates of the nursing school, and who took the National Council Licensure Examination for Registered Nurses in the year preceding the year for which the institution is certifying a Federal Stafford Loan under section 428, an unsubsidized Federal Stafford Loan under section 428H, or a Federal PLUS loan under section 428B, received a passing score on such examination.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H190B9D722C404D27BD8182BB03211905"><enum>(2)</enum><text>in subparagraph (B), by adding at the end the following:</text>

<clause id="HD2DACF17C3E94E5BA452056281D0F0A5"><enum>(iii)</enum><header>Report</header>
<subclause id="HEC4D26A2AA1D4432A0E90631D552824B"><enum>(I)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Higher Education Opportunity Act</short-title>, the advisory panel described in clause (i) shall submit a report to the Secretary and to the authorizing committees recommending eligibility criteria for participation in the loan programs under part B of title IV for graduate medical schools that—</text>
<item id="H34151FA63EC34F46B78ED92829E27455"><enum>(aa)</enum><text>are located outside of the United States;</text></item>
<item id="HD2BECD5218C04D72982E980014C511D1"><enum>(bb)</enum><text>do not meet the requirements of subparagraph (A)(i); and</text></item>
<item id="H29D9E91BEAC24ED6B6AD4F20DBBB22FF"><enum>(cc)</enum><text>have a clinical training program approved by a State prior to January 1, 2008.</text></item></subclause>
<subclause id="HDA3E0E1E088F48119740B3F72D60407C"><enum>(II)</enum><header>Recommendations</header><text>In the report described in subclause (I), the advisory panel's eligibility criteria shall include recommendations regarding the appropriate levels of performance for graduate medical schools described in such subclause in the following areas:</text>
<item id="HCA026B714CEA41DB98A2DEB1CD2F1B05"><enum>(aa)</enum><text>Entrance requirements.</text></item>
<item id="HD5CD56EB80264B46B1E402FE4EBFBC72"><enum>(bb)</enum><text>Retention and graduation rates.</text></item>
<item id="H0910349153BB433F9F967C9F780419FE"><enum>(cc)</enum><text>Successful placement of students in United States medical residency programs.</text></item>
<item id="H33A9C554402340998B49C41D1C9954A9"><enum>(dd)</enum><text>Passage rate of students on the United States Medical Licensing Examination.</text></item>
<item id="H7029B647F5B24610A7297C24C63673B5"><enum>(ee)</enum><text>The extent to which State medical boards have assessed the quality of such school's program of instruction, including through on-site reviews.</text></item>
<item id="H6B0A555ED6BB47B2B5143E168E792DF2"><enum>(ff)</enum><text>The extent to which graduates of such schools would be unable to practice medicine in 1 or more States, based on the judgment of a State medical board.</text></item>
<item id="H1BDE9D951DFE47D8B9650019606868E8"><enum>(gg)</enum><text>Any areas recommended by the Comptroller General of the United States under section 1101 of the <short-title>Higher Education Opportunity Act</short-title>.</text></item>
<item id="H32A15CBB345E469A84C3F6F24C41DB13"><enum>(hh)</enum><text>Any additional areas the Secretary may require.</text></item></subclause>
<subclause commented="no" id="H358EE869C97E4E6485AF6D40E3EE84AB"><enum>(III)</enum><header>Minimum eligibility requirement</header><text>In the recommendations described in subclause (II), the criteria described in subparagraph (A)(i)(I)(bb), as amended by section 102(b) of the <short-title>Higher Education Opportunity Act</short-title>, shall be a minimum eligibility requirement for a graduate medical school described in subclause (I) to participate in the loan programs under part B of title IV.</text></subclause>
<subclause id="H0D0C35EB67DA4199B3B3DBFEBEDA555D"><enum>(IV)</enum><header>Authority</header><text>The Secretary may—</text>
<item id="H977FC952539241B4BC096BE82D23F1EB"><enum>(aa)</enum><text>not earlier than 180 days after the submission of the report described in subclause (I), issue proposed regulations establishing criteria for the eligibility of graduate medical schools described in such subclause to participate in the loan programs under part B of title IV based on the recommendations of such report; and</text></item>
<item id="HE7AC86ECC115449D9EB326B59B0020CE"><enum>(bb)</enum><text>not earlier than one year after the issuance of proposed regulations under item (aa), issue final regulations establishing such criteria for eligibility.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H23CFBD7436B04A9682FDD5DAB00B74B"><enum>(b)</enum><header>Percentage pass rate</header><text>Section 102(a)(2)(A)(i)(I)(bb) (20 U.S.C. 1002(a)(2)(A)(i)(I)(bb)) is amended by striking <quote>60</quote> and inserting <quote>75</quote>.</text></subsection>
<subsection display-inline="no-display-inline" id="HEF2F9AEB5CF34D8BBE7011CD43C8FDCF"><enum>(c)</enum><header>Conforming amendment concerning 90/10 enforcement</header><text display-inline="yes-display-inline">Section 102(b)(1) (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(b)(1)</external-xref>) is amended—</text>

<paragraph id="HF75C5F3CCC6A48339EFF82EFFC072EEF"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in the amendment made by paragraph (1)(A)(i) to section 102(b)(1)(A) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(b)(1)(A)</external-xref>) shall be construed to negate or supercede any State laws governing proprietary institutions of higher education.</text></paragraph></subsection>

Reg. 31412; promulgated under the authority of section 212(d) of the Education for Economic Security Act (repealed by section 2303 of the Augustus F. Hawkins-Robert T. Stafford Elementary and Secondary School Improvement Amendments of 1988)), as updated by the Secretary from time to time and published in the Federal Register, except that in the implementation of this definition with respect to a specific title, the Secretary may set priorities according to the purposes of such title and the national security, economic competitiveness, and educational needs of the United States.</text></paragraph>

<subparagraph commented="no" display-inline="no-display-inline" id="H052E47A52703407F8D77BD832052C718"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as otherwise provided, the term <term>distance education</term> means education that uses one or more of the technologies described in subparagraph (B)—</text>
<clause commented="no" display-inline="no-display-inline" id="H0717D9AB9BC2453485D3890A3F29D07"><enum>(i)</enum><text display-inline="yes-display-inline">to deliver instruction to students who are separated from the instructor; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H94505D65EB5D44B6B2C06659CD8D214"><enum>(ii)</enum><text display-inline="yes-display-inline">to support regular and substantive interaction between the students and the instructor, synchronously or asynchronously.</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H4D7068A9ACE84A4F879CDD7B02E677EB"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">For the purposes of subparagraph (A), the technologies used may include—</text>
<clause commented="no" display-inline="no-display-inline" id="H47ACB24E32DF422BB03CF9B8DEEF0569"><enum>(i)</enum><text display-inline="yes-display-inline">the Internet;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H9F2814657D9F43729D217D0401226ED0"><enum>(ii)</enum><text display-inline="yes-display-inline">one-way and two-way transmissions through open broadcast, closed circuit, cable, microwave, broadband lines, fiber optics, satellite, or wireless communications devices;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HF09C7B2A696D4AB7B3621595C5F1CF2F"><enum>(iii)</enum><text display-inline="yes-display-inline">audio conferencing; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HFF72221E03B4428C916D1C1E073858D1"><enum>(iv)</enum><text display-inline="yes-display-inline">video cassettes, DVDs, and CD–ROMs, if the cassettes, DVDs, or CD–ROMs are used in a course in conjunction with any of the technologies listed in clauses (i) through (iii).</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HE175504B1DCB44B59113C7D83719365C"><enum>(20)</enum><header>Diploma mill</header><text>The term <quote>diploma mill</quote> means an entity that—</text>
<subparagraph id="H215BA406027C4F7CA5EF67EEDD664462"><enum>(A)</enum>
<clause commented="no" display-inline="yes-display-inline" id="HBDFBD49B643B4F90A3F649F9802346AD"><enum>(i)</enum><text>offers, for a fee, degrees, diplomas, or certificates, that may be used to represent to the general public that the individual possessing such a degree, diploma, or certificate has completed a program of postsecondary education or training; and</text></clause>
<clause id="H74264792A7EC488B93AD3D100ED7B40" indent="up1"><enum>(ii)</enum><text>requires such individual to complete little or no education or coursework to obtain such degree, diploma, or certificate; and</text></clause></subparagraph>
<subparagraph id="H1C138150BF9D4E88006800116F644256"><enum>(B)</enum><text>lacks accreditation by an accrediting agency or association that is recognized as an accrediting agency or association of institutions of higher education (as such term is defined in section 102) by—</text>
<clause id="H7E4F02554E7A4B21B4AFA1797007581"><enum>(i)</enum><text>the Secretary pursuant to subpart 2 of part H of title IV; or</text></clause>
<clause id="HA133F67456A74742B7DB67BEB0973BA4"><enum>(ii)</enum><text>a Federal agency, State government, or other organization or association that recognizes accrediting agencies or associations.</text></clause></subparagraph></paragraph>
<paragraph id="H65F02B2AAC05474297FD007323E3FC35"><enum>(21)</enum><header>Early childhood education program</header><text>The term <term>early childhood education program</term> means—</text>
<subparagraph id="H705C07FFE5844209994F3200D6C37D97"><enum>(A)</enum><text>a Head Start program or an Early Head Start program carried out under the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>), including a migrant or seasonal Head Start program, an Indian Head Start program, or a Head Start program or an Early Head Start program that also receives State funding;</text></subparagraph>
<subparagraph id="H296BD3812CCF4D5EA23067D13D8D8F9"><enum>(B)</enum><text>a State licensed or regulated child care program; or</text></subparagraph>
<subparagraph id="HA399ED69381D48F48BE9E6293C22AE6D"><enum>(C)</enum><text>a program that—</text>
<clause id="H6CD84B389A6840CDA21724A6F6AF4087"><enum>(i)</enum><text>serves children from birth through age six that addresses the children’s cognitive (including language, early literacy, and early mathematics), social, emotional, and physical development; and</text></clause>
<clause id="H158B351E00F1476093A99D3B82B58343"><enum>(ii)</enum><text>is—</text>
<subclause id="H4170116596FF49D9904B18CE2C96FC98"><enum>(I)</enum><text>a State prekindergarten program;</text></subclause>
<subclause id="HA4B3794464A149868FFA16E33250CF48"><enum>(II)</enum><text>a program authorized under section 619 or part C of the Individuals with Disabilities Education Act; or</text></subclause>
<subclause id="H14C199C770C74AC800D8173F25D1F121"><enum>(III)</enum><text>a program operated by a local educational agency.</text></subclause></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4A434876ED9E4C1CB1F297B0A582CC7B"><enum>(22)</enum><header>Poverty line</header><text>The term <term>poverty line</term> means the poverty line (as defined in section 673(2) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902(2)</external-xref>) applicable to a family of the size involved.</text></paragraph>

<subsection commented="no" display-inline="no-display-inline" id="H805F3E1D26804891B3DD428B2C164C74"><enum>(b)</enum><header display-inline="yes-display-inline">Membership</header>
<paragraph commented="no" display-inline="no-display-inline" id="H155F1FB7375442EEAE6EF9AC25DC78E6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Committee shall have 18 members, of which—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H010C3993B38C49B7AA8EB0B693C362D0"><enum>(A)</enum><text display-inline="yes-display-inline">six members shall be appointed by the Secretary;</text></subparagraph>
<subparagraph display-inline="no-display-inline" id="H3CF9099F78CE437EA97DA70000008B1E"><enum>(B)</enum><text display-inline="yes-display-inline">six members shall be appointed by the Speaker of the House of Representatives, three of whom shall be appointed on the recommendation of the majority leader of the House of Representatives, and three of whom shall be appointed on the recommendation of the minority leader of the House of Representatives; and</text></subparagraph>
<subparagraph id="H35BBACCBBFA44F16B89025DEAED75E44"><enum>(C)</enum><text display-inline="yes-display-inline">six members shall be appointed by the President pro tempore of the Senate, three of whom shall be appointed on the recommendation of the majority leader of the Senate, and three of whom shall be appointed on the recommendation of the minority leader of the Senate.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3AA0A6A6C5D14124B297B4955400F1DE"><enum>(2)</enum><header display-inline="yes-display-inline">Qualifications</header><text display-inline="yes-display-inline">Individuals shall be appointed as members of the Committee—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H84C34A5358B44559BDE0404C315D99F1"><enum>(A)</enum><text display-inline="yes-display-inline">on the basis of the individuals' experience, integrity, impartiality, and good judgment;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HD5A81E8359194C9CA5710069C8C7A507"><enum>(B)</enum><text display-inline="yes-display-inline">from among individuals who are representatives of, or knowledgeable concerning, education and training beyond secondary education, representing all sectors and types of institutions of higher education (as defined in section 102); and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HC1141D659B134B30808274642E13EEE5"><enum>(C)</enum><text display-inline="yes-display-inline">on the basis of the individuals’ technical qualifications, professional standing, and demonstrated knowledge in the fields of accreditation and administration in higher education.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H00622622301743C7BDCFF78FABB341BB"><enum>(3)</enum><header display-inline="yes-display-inline">Terms of members</header><text display-inline="yes-display-inline">Except as provided in paragraph (5), the term of office of each member of the Committee shall be for six years, except that any member appointed to fill a vacancy occurring prior to the expiration of the term for which the member’s predecessor was appointed shall be appointed for the remainder of such term.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H2AB3FE69560E43A3AE18527D724113C"><enum>(4)</enum><header display-inline="yes-display-inline">Vacancy</header><text display-inline="yes-display-inline">A vacancy on the Committee shall be filled in the same manner as the original appointment was made not later than 90 days after the vacancy occurs. If a vacancy occurs in a position to be filled by the Secretary, the Secretary shall publish a Federal Register notice soliciting nominations for the position not later than 30 days after being notified of the vacancy.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H83595F31C56A4BD7AE46C28F80000928"><enum>(5)</enum><header display-inline="yes-display-inline">Initial terms</header><text display-inline="yes-display-inline">The terms of office for the initial members of the Committee shall be—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H4E901CFC706A408BA345BE5BB865CCF6"><enum>(A)</enum><text display-inline="yes-display-inline">three years for members appointed under paragraph (1)(A);</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HC30AFBA3ED124FFDA883226E58CA43CD"><enum>(B)</enum><text display-inline="yes-display-inline">four years for members appointed under paragraph (1)(B); and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HF73B19EF78EE496C9381B48F60B60798"><enum>(C)</enum><text display-inline="yes-display-inline">six years for members appointed under paragraph (1)(C).</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HFFDF47DAE0464FBCB46543E7AE886B51"><enum>(6)</enum><header display-inline="yes-display-inline">Chairperson</header><text display-inline="yes-display-inline">The members of the Committee shall select a chairperson from among the members.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H08ACF8FFD20F40E4A5A69D00342D5717"><enum>(c)</enum><header display-inline="yes-display-inline">Functions</header><text display-inline="yes-display-inline">The Committee shall—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HEFC52B7550524D77A999E69B9F93AD07"><enum>(1)</enum><text display-inline="yes-display-inline">advise the Secretary with respect to establishment and enforcement of the standards of accrediting agencies or associations under subpart 2 of part H of title IV;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H5E49754D2A574620A3D25D37A41B7B21"><enum>(2)</enum><text display-inline="yes-display-inline">advise the Secretary with respect to the recognition of a specific accrediting agency or association;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3651FFFFF10F44659800B081ACB5E789"><enum>(3)</enum><text display-inline="yes-display-inline">advise the Secretary with respect to the preparation and publication of the list of nationally recognized accrediting agencies and associations;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7D2DEFAE411049759BF6E6E69C8E2D7F"><enum>(4)</enum><text display-inline="yes-display-inline">advise the Secretary with respect to the eligibility and certification process for institutions of higher education under title IV, together with recommendations for improvements in such process;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3F43C05CDA804B8CA7D8B60691BF2B80"><enum>(5)</enum><text display-inline="yes-display-inline">advise the Secretary with respect to the relationship between—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H767AF534D78C4D99A9B600AB58159B4"><enum>(A)</enum><text display-inline="yes-display-inline">accreditation of institutions of higher education and the certification and eligibility of such institutions; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HDBA4D44A76EA4CF9BA4C40D1471D003C"><enum>(B)</enum><text display-inline="yes-display-inline">State licensing responsibilities with respect to such institutions; and</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H551CB28CED65429DBDBC42701CDE4B86"><enum>(6)</enum><text display-inline="yes-display-inline">carry out such other advisory functions relating to accreditation and institutional eligibility as the Secretary may prescribe by regulation.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H362D37BFF0C9400A957879C811D4B2CB"><enum>(d)</enum><header display-inline="yes-display-inline">Meeting procedures</header>
<paragraph commented="no" display-inline="no-display-inline" id="H9683BD8D06BD489C94CFA58D003513D0"><enum>(1)</enum><header display-inline="yes-display-inline">Schedule</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H02DDA1641B0F484793CEAEFC84E9449B"><enum>(A)</enum><header display-inline="yes-display-inline">Biannual meetings</header><text display-inline="yes-display-inline">The Committee shall meet not less often than twice each year, at the call of the Chairperson.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H99FBBF5152974B9197C2F7A67700A33E"><enum>(B)</enum><header display-inline="yes-display-inline">Publication of Date</header><text display-inline="yes-display-inline">The Committee shall submit the date and location of each meeting in advance to the Secretary, and the Secretary shall publish such information in the Federal Register not later than 30 days before the meeting.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H228E601D05F4400FA576C5C5417EC19"><enum>(2)</enum><header display-inline="yes-display-inline">Agenda</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H3A4886C2327842089EDB9DF6213A99F"><enum>(A)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The agenda for a meeting of the Committee shall be established by the Chairperson and shall be submitted to the members of the Committee upon notification of the meeting.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HB992AB06E87B4D7B9B6EBF944365A8F4"><enum>(B)</enum><header display-inline="yes-display-inline">Opportunity for public comment</header><text display-inline="yes-display-inline">The agenda shall include, at a minimum, opportunity for public comment during the Committee’s deliberations.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HA2103D8C543F44EA003EA54E2C1F811C"><enum>(3)</enum><header>Secretary's designee</header><text>The Secretary shall designate an employee of the Department to serve as the Secretary's designee to the Committee, and the Chairperson shall invite the Secretary's designee to attend all meetings of the Committee.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H228A1A69C06B4F879344E0B7921495AF"><enum>(4)</enum><header display-inline="yes-display-inline">Federal Advisory Committee Act</header><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5 U.S.C. App.) shall apply to the Committee, except that section 14 of such Act shall not apply.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H411425D18A124ACA87DD6FE3094E7B4"><enum>(e)</enum><header display-inline="yes-display-inline">Report and notice</header>
<paragraph commented="no" display-inline="no-display-inline" id="HE56D1DCBBB6A41DDB44F9200372BEAB9"><enum>(1)</enum><header display-inline="yes-display-inline">Notice</header><text display-inline="yes-display-inline">The Secretary shall annually publish in the Federal Register—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HEFFAE9009FB543D6BAC9C7A617180615"><enum>(A)</enum><text display-inline="yes-display-inline">a list containing, for each member of the Committee—</text>
<clause commented="no" display-inline="no-display-inline" id="H3032AF251B564EC48EB7B8E48F3EA71B"><enum>(i)</enum><text display-inline="yes-display-inline">the member’s name;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H4FAF607DC0B84CE59EDE4976ACF983F6"><enum>(ii)</enum><text display-inline="yes-display-inline">the date of the expiration of the member’s term of office; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HA01F0C0FBE4D4B3B9B2DBBC988F9DA9"><enum>(iii)</enum><text display-inline="yes-display-inline">the name of the individual described in subsection (b)(1) who appointed the member; and</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HB257FFE2C3F54003823CDC028E023034"><enum>(B)</enum><text display-inline="yes-display-inline">a solicitation of nominations for each expiring term of office on the Committee of a member appointed by the Secretary.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HCECE6118626943EC8B14817C6900D71F"><enum>(2)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than the last day of each fiscal year, the Committee shall make available an annual report to the Secretary, the authorizing committees, and the public. The annual report shall contain—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HF2A4E02578824EEFBA41D8BEAA90CCEF"><enum>(A)</enum><text display-inline="yes-display-inline">a detailed summary of the agenda and activities of, and the findings and recommendations made by, the Committee during the fiscal year preceding the fiscal year in which the report is made;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H6F0C52B950EB4C6DAD75B0EC5E0000FD"><enum>(B)</enum><text display-inline="yes-display-inline">a list of the date and location of each meeting during the fiscal year preceding the fiscal year in which the report is made;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H2A1DD5388E014C308FE3EA1F3B758237"><enum>(C)</enum><text>a list of the members of the Committee; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H9655F1D0C9A246FB91B100D16B5CB115"><enum>(D)</enum><text display-inline="yes-display-inline">a list of the functions of the Committee, including any additional functions established by the Secretary through regulation.</text></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H95E16F40718C4E8ABBEFC1DD688153F"><enum>(f)</enum><header display-inline="yes-display-inline">Termination</header><text display-inline="yes-display-inline">The Committee shall terminate on September 30, 2014.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HC065D333F4754109908205613DE49649"><enum>(b)</enum><header>Transition</header><text>Notwithstanding section 114 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011c">20 U.S.C. 1011c</external-xref>) (as in effect before, during, and after the date of enactment of this Act)—</text>
<paragraph id="H8052EECA48C3454285758BD7D9E14DAC"><enum>(1)</enum><text>the term of each member appointed to the National Advisory Committee on Institutional Quality and Integrity before the date of enactment of this Act shall expire on the date of enactment of this Act;</text></paragraph>
<paragraph id="HA215909DBD6245BA00B88036CDA4B625"><enum>(2)</enum><text>no new members shall be appointed to the National Advisory Committee on Institutional Quality and Integrity during the period beginning on the date of enactment of this Act and ending on January 31, 2009; and</text></paragraph>
<paragraph id="HF25D8CBDDA4B442C8DF299FA59CFE90"><enum>(3)</enum><text>no meeting of the National Advisory Committee on Institutional Quality and Integrity shall be convened during such period.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H4808E6F1EE48494987768BD0A5A571BB"><enum>(c)</enum><header>Effective Date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall take effect on January 1, 2009.</text></subsection></section>
<section commented="no" display-inline="no-display-inline" id="H31B8B831CF49469F85F15C5C96427F73" section-type="subsequent-section"><enum>107.</enum><header display-inline="yes-display-inline">Drug and alcohol abuse prevention</header><text display-inline="no-display-inline">Section 120 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011i">20 U.S.C. 1011i</external-xref>) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H11806081CE4B493ABC408483A16CC854"><enum>(1)</enum><text>in subsection (a)(2)—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H694CA66412594B30AC8B59E3FF99BEB2"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>and</quote> after the semicolon;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HEE76BBCC97604813A5B0B66A1C0334C"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (B) as subparagraph (D); and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HE6CB08A08F7F451494CF501CF95434F"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (A) the following:</text>

<subparagraph commented="no" display-inline="no-display-inline" id="HB3536A6772A34A8FB2EFF318D7C82EB"><enum>(B)</enum><text display-inline="yes-display-inline">determine the number of drug and alcohol-related violations and fatalities that—</text>
<clause commented="no" display-inline="no-display-inline" id="H55AE420D6DA046BEB8E2DB2C8592622B"><enum>(i)</enum><text display-inline="yes-display-inline">occur on the institution's campus (as defined in section 485(f)(6)), or as part of any of the institution's activities; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HE8CA3C25F0724095A7137CDB009EC6A2"><enum>(ii)</enum><text display-inline="yes-display-inline">are reported to campus officials;</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H761D97768AD3494DB1DC06CAE3BA366"><enum>(C)</enum><text display-inline="yes-display-inline">determine the number and type of sanctions described in paragraph (1)(E) that are imposed by the institution as a result of drug and alcohol-related violations and fatalities on the institution's campus or as part of any of the institution's activities; and</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HE03FA4C2EFA2442FABCB014D4C91BE31"><enum>(2)</enum><text>in subsection (e)(5), by striking <quote>$5,000,000</quote> and all that follows through the period at the end and inserting <quote>such sums as may be necessary for fiscal year 2009 and each of the five succeeding fiscal years.</quote>; and</text></paragraph>
<paragraph id="H4130E7210FC8431B867801F3A0DBD6CD"><enum>(3)</enum><text>by striking subsection (f).</text></paragraph></section>

<subsection commented="no" display-inline="no-display-inline" id="H47BEF6728AF94191B1A2EC0064B257BC"><enum>(a)</enum><header>Information to the public</header><text display-inline="yes-display-inline">The Secretary shall maintain information and resources on the Department's website to assist students, families, and employers in understanding what a diploma mill is and how to identify and avoid diploma mills.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H498BBA25779F459398A3B4002B3CB87F"><enum>(b)</enum><header>Collaboration</header><text display-inline="yes-display-inline">The Secretary shall continue to collaborate with the United States Postal Service, the Federal Trade Commission, the Department of Justice (including the Federal Bureau of Investigation), the Internal Revenue Service, and the Office of Personnel Management to maximize Federal efforts to—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HE197F153FFBF4CF9B5AE19873BB07EA"><enum>(1)</enum><text display-inline="yes-display-inline">prevent, identify, and prosecute diploma mills; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HE0D8092EDD3942738F6686DFFFB10870"><enum>(2)</enum><text display-inline="yes-display-inline">broadly disseminate to the public information about diploma mills, and resources to identify diploma mills.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section commented="no" display-inline="no-display-inline" id="HB9FD71198E2F4F45B474D2C847E0759C" section-type="subsequent-section"><enum>110.</enum><header>Improved information concerning the Federal student financial aid website</header>
<subsection commented="no" display-inline="no-display-inline" id="HD3199E7BF97A47B2A8233FA3E8B03899"><enum>(a)</enum><header>Promotion of Federal student financial aid website</header><text display-inline="yes-display-inline">Section 131 (<external-xref legal-doc="usc" parsable-cite="usc/20/1015">20 U.S.C. 1015</external-xref>) is amended by striking subsection (d) and inserting the following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="HC94F7AACA1934EF6B794CDC9F2CB2ED1"><enum>(1)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">The Secretary shall continue to improve the usefulness and accessibility of the information provided by the Department on college planning and student financial aid.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC5BC4A80784B4C7CA0F2F4EF5E1F8BD"><enum>(2)</enum><header>Dissemination</header><text display-inline="yes-display-inline">The Secretary shall continue to make the availability of the information on the Federal student financial aid website of the Department widely known, through a major media campaign and other forms of communication.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7DA68B48E7014F038700FF83E36C69AC"><enum>(3)</enum><header>Coordination</header><text display-inline="yes-display-inline">As a part of the efforts required under this subsection, the Secretary shall create one website accessible from the Department's website that fulfills the requirements under subsections (b), (f), and (g).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HF06763D58E0C435AB66170908BF34800"><enum>(b)</enum><header>Improved information concerning financial aid for military members and veterans</header><text display-inline="yes-display-inline">Section 131 (as amended by subsection (a)) (<external-xref legal-doc="usc" parsable-cite="usc/20/1015">20 U.S.C. 1015</external-xref>) is further amended by adding at the end the following:</text>

<paragraph id="H12B3440AFA5945F8AE6251615CD262C0"><enum>(1)</enum><header>Coordination</header><text>The Secretary, in coordination with the Secretary of Defense and the Secretary of Veterans Affairs, shall create a searchable website that—</text>
<subparagraph id="HAE2AFE5793EE42138FD3CCC761E0BDFF"><enum>(A)</enum><text>contains information, in simple and understandable terms, about all Federal and State student financial assistance, readmission requirements under section 484C, and other student services, for which members of the Armed Forces (including members of the National Guard and Reserves), veterans, and the dependents of such members or veterans may be eligible; and</text></subparagraph>
<subparagraph commented="no" id="H5378C181269A42728C59F61D397E48A6"><enum>(B)</enum><text>is easily accessible through the website described in subsection (e)(3).</text></subparagraph></paragraph>
<paragraph id="H754216E09DAA4C36BB5F6933AC93D53F"><enum>(2)</enum><header>Implementation</header><text>Not later than one year after the date of enactment of the <short-title>Higher Education Opportunity Act</short-title>, the Secretary shall make publicly available the Armed Forces information website described in paragraph (1).</text></paragraph>
<paragraph id="H3621421F5B834DE9A964E524C3D61C87"><enum>(3)</enum><header>Dissemination</header><text>The Secretary, in coordination with the Secretary of Defense and the Secretary of Veterans Affairs, shall make the availability of the Armed Forces information website described in paragraph (1) widely known to members of the Armed Forces (including members of the National Guard and Reserves), veterans, the dependents of such members or veterans, States, institutions of higher education, and the general public.</text></paragraph>
<paragraph id="H7F75BAA066234B8496476D1BFE12A0A3"><enum>(4)</enum><header>Definition</header><text>In this subsection, the term <term>Federal and State student financial assistance</term> means any grant, loan, work assistance, tuition assistance, scholarship, fellowship, or other form of financial aid for pursuing a postsecondary education that is—</text>
<subparagraph id="HB2C1CFB183A340C2AB345712CF9C10ED"><enum>(A)</enum><text>administered, sponsored, or supported by the Department of Education, the Department of Defense, the Department of Veterans Affairs, or a State; and</text></subparagraph>
<subparagraph id="H89BBA13C6BD54B1700E168D4E05308CE"><enum>(B)</enum><text>available to members of the Armed Forces (including members of the National Guard and Reserves), veterans, or the dependents of such members or veterans.</text></subparagraph></paragraph></subsection>
<subsection id="H1C5AB3158ED942FE00F75946BA6E13"><enum>(g)</enum><header>Promotion of availability of information concerning other student financial aid programs</header>
<paragraph id="H0023612338074AAD89DA666200328115"><enum>(1)</enum><header>Definition</header><text>For purposes of this subsection, the term <quote>nondepartmental student financial assistance program</quote> means any grant, loan, scholarship, fellowship, or other form of financial aid for students pursuing a postsecondary education that is—</text>
<subparagraph id="H882DF5DDAE954A02A7CB4F42CADAF4C"><enum>(A)</enum><text>distributed directly to the student or to the student’s account at an institution of higher education; and</text></subparagraph>
<subparagraph id="H2AB7916DC6AF4E929F38DE58B5280186"><enum>(B)</enum><text>operated, sponsored, or supported by a Federal department or agency other than the Department of Education.</text></subparagraph></paragraph>
<paragraph id="H9E0186C1DB1045B9B74607C41E620043"><enum>(2)</enum><header>Availability of other student financial aid information</header><text>The Secretary shall ensure that—</text>
<subparagraph id="HB07E88526D8B4C34A11DE8D648CD261D"><enum>(A)</enum><text>not later than 90 days after the Secretary receives the information required under paragraph (3), the eligibility requirements, application procedures, financial terms and conditions, and other relevant information for each nondepartmental student financial assistance program are searchable and accessible through the Federal student financial aid website in a manner that is simple and understandable for students and the students' families; and</text></subparagraph>
<subparagraph id="HD6271F9C32E7431EAFBE6958735FF25"><enum>(B)</enum><text>the website displaying the information described in subparagraph (A) includes a link to the National Database on Financial Assistance for the Study of Science, Technology, Engineering, and Mathematics pursuant to paragraph (4), and the information on military benefits under subsection (f), once such Database and information are available.</text></subparagraph></paragraph>
<paragraph id="H8843F900675B40D38000C29124B6F378"><enum>(3)</enum><header>Nondepartmental student financial assistance programs</header><text>The Secretary shall request all Federal departments and agencies to provide the information described in paragraph (2)(A), and each Federal department or agency shall—</text>
<subparagraph id="HF484681040CC40709DE62110E674F787"><enum>(A)</enum><text>promptly respond to surveys or other requests from the Secretary for the information described in such paragraph; and</text></subparagraph>
<subparagraph id="HB26A336345A84A50A26F40CD3046A600"><enum>(B)</enum><text>identify for the Secretary any nondepartmental student financial assistance program operated, sponsored, or supported by such Federal department or agency.</text></subparagraph></paragraph>
<paragraph id="HD5BD79AF3A344482B242DA7145FF81DF"><enum>(4)</enum><header>National STEM Database</header>
<subparagraph id="H48EE822D4ACB41B2BD50A35B16A0DC4C"><enum>(A)</enum><header>In general</header><text>The Secretary shall establish and maintain, on the website described in subsection (e)(3), a National Database on Financial Assistance for the Study of Science, Technology, Engineering, and Mathematics (in this paragraph referred to as the <quote>STEM Database</quote>). The STEM Database shall consist of information on scholarships, fellowships, and other programs of Federal, State, local, and, to the maximum extent practicable, private financial assistance available for the study of science, technology, engineering, or mathematics at the postsecondary and postbaccalaureate levels.</text></subparagraph>
<subparagraph id="H2D56C8AABA4047869126E50088142500"><enum>(B)</enum><header>Database contents</header><text>The information maintained on the STEM Database shall be displayed on the website in the following manner:</text>
<clause id="H6C0AD5E38A2A4361985CD12775D699B9"><enum>(i)</enum><header>Separate information</header><text>The STEM Database shall provide separate information for each of the fields of science, technology, engineering, and mathematics, and for postsecondary and postbaccalaureate programs of financial assistance.</text></clause>
<clause id="H22749EA00A544C108D10C0F893E60628"><enum>(ii)</enum><header>Information on targeted assistance</header><text>The STEM Database shall provide specific information on any program of financial assistance that is targeted to individuals based on financial need, merit, or student characteristics.</text></clause>
<clause id="H8BEE0E8118F54848954B2614E000AA55"><enum>(iii)</enum><header>Contact and website information</header><text>The STEM Database shall provide—</text>
<subclause id="H9813B151A6C54209B25900DE69C9EF8"><enum>(I)</enum><text>standard contact information that an interested person may use to contact a sponsor of any program of financial assistance included in the STEM Database; and</text></subclause>
<subclause id="HDA9E1C3C57DF4600AEEA371F0647813B"><enum>(II)</enum><text>if such sponsor maintains a public website, a link to the website.</text></subclause></clause>
<clause id="H7DBCCE396A774B8C96E000FE26591850"><enum>(iv)</enum><header>Search and match capabilities</header><text>The STEM Database shall—</text>
<subclause id="H9360055AA3AD4EB6A3D6A1C2DD4A1A3"><enum>(I)</enum><text>have a search capability that permits an individual to search for information on the basis of each category of the information provided through the STEM Database and on the basis of combinations of categories of the information provided, including—</text>
<item id="H03FAF0ADE4E74F06BA49BF3652AD23A0"><enum>(aa)</enum><text>whether the financial assistance is need- or merit-based; and</text></item>
<item id="H1E4CB906FCA54F0F89D41E6EA4A29DAC"><enum>(bb)</enum><text>by relevant academic majors; and</text></item></subclause>
<subclause id="H93853D5271E34C19B8350414864C9075"><enum>(II)</enum><text>have a match capability that—</text>
<item id="H6B122E648870494A80B3C0F1096FF902"><enum>(aa)</enum><text>searches the STEM Database for all financial assistance opportunities for which an individual may be qualified to apply, based on the student characteristics provided by such individual; and</text></item>
<item id="H7981FBAB71E240D9BAD6B2912E8DC0F5"><enum>(bb)</enum><text>provides information to an individual for only those opportunities for which such individual is qualified, based on the student characteristics provided by such individual.</text></item></subclause></clause>
<clause id="H418FBA1D187D4F8D83A8DA268BF7C1F3"><enum>(v)</enum><header>Recommendation and disclaimer</header><text>The STEM Database shall provide, to the users of the STEM Database—</text>
<subclause id="HF419EF98835A4C948F0247DEB3B3002B"><enum>(I)</enum><text>a recommendation that students and families should carefully review all of the application requirements prior to applying for any aid or program of student financial assistance; and</text></subclause>
<subclause id="H1520F137EDE64A968EBE03C95E51315D"><enum>(II)</enum><text>a disclaimer that the non-Federal programs of student financial assistance presented in the STEM Database are not provided or endorsed by the Department or the Federal Government.</text></subclause></clause></subparagraph>
<subparagraph id="H068827839FAB465EAEBDE867CFE65DC1"><enum>(C)</enum><header>Compilation of financial assistance information</header><text>In carrying out this paragraph, the Secretary shall—</text>
<clause id="H3A96A56AB0BE4E1C80159D835430FDB1"><enum>(i)</enum><text>consult with public and private sources of scholarships, fellowships, and other programs of student financial assistance; and</text></clause>
<clause id="H990D485614F64A17B8F940946C68672C"><enum>(ii)</enum><text>make easily available a process for such entities to provide regular and updated information about the scholarships, fellowships, or other programs of student financial assistance.</text></clause></subparagraph>
<subparagraph id="HA33DB3C640684A168831DF9016A6D7D8"><enum>(D)</enum><header>Contract authorized</header><text>In carrying out the requirements of this paragraph, the Secretary is authorized to enter into a contract with a private entity with demonstrated expertise in creating and maintaining databases such as the one required under this paragraph, under which contract the entity shall furnish, and regularly update, all of the information required to be maintained on the STEM Database.</text></subparagraph></paragraph>
<paragraph id="HDD4E67F8BBE04647AD19B6A92B1510D2"><enum>(5)</enum><header>Dissemination of information</header><text>The Secretary shall take such actions, on an ongoing basis, as may be necessary to disseminate information under this subsection and to encourage the use of the information by interested parties, including sending notices to secondary schools and institutions of higher education.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H72AB055ACEB6400995BD2D6FD829A4BD"><enum>(c)</enum><header>No user fees for Department financial aid websites</header><text>Section 131 (as amended by subsection (b)) (<external-xref legal-doc="usc" parsable-cite="usc/20/1015">20 U.S.C. 1015</external-xref>) is further amended by adding at the end the following:</text>

<subsection commented="no" display-inline="no-display-inline" id="HA8F76D7ECAC841BABF06A4432BC02C00"><enum>(h)</enum><header>No user fees for Department financial aid websites</header><text>No fee shall be charged to any individual to access—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H921EDE6B55D54FE5B98F1E17AB9CD392"><enum>(1)</enum><text>a database or website of the Department that provides information about higher education programs or student financial assistance, including the College Navigator website (or successor website) and the websites and databases described in this section and section 132; or</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD98CB6859C9843EA8082754709A38589"><enum>(2)</enum><text>information about higher education programs or student financial assistance available through a database or website of the Department.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section commented="no" id="H130302295CC14741A0F9DA5EB81F1D08"><enum>111.</enum><header>Transparency in college tuition for consumers</header><text display-inline="no-display-inline">Part C of title I (<external-xref legal-doc="usc" parsable-cite="usc/20/1015">20 U.S.C. 1015</external-xref>) is amended by adding at the end the following:</text>

<section id="HDBC402F327534FC48C1973C6E48ECC1B"><enum>132.</enum><header>Transparency in college tuition for consumers</header>
<subsection id="H57873A06133A460FAC22947BA1508BC2"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HB0848A50716A46BB96A26147D4B844D7"><enum>(1)</enum><header>College navigator website</header><text>The term <term>College Navigator website</term> means the College Navigator website operated by the Department and includes any successor website.</text></paragraph>
<paragraph id="HF8291CDF1CD542058CD100C56795C57B"><enum>(2)</enum><header>Cost of attendance</header><text>The term <term>cost of attendance</term> means the average annual cost of tuition and fees, room and board, books, supplies, and transportation for an institution of higher education for a first-time, full-time undergraduate student enrolled in the institution.</text></paragraph>
<paragraph id="H222197CD56244B0BA9BA86A7FE9CA999"><enum>(3)</enum><header>Net price</header><text>The term <term>net price</term> means the average yearly price actually charged to first-time, full-time undergraduate students receiving student aid at an institution of higher education after deducting such aid, which shall be determined by calculating the difference between—</text>
<subparagraph id="HF0267620E9A64579B2FC56F960A7957B"><enum>(A)</enum><text>the institution's cost of attendance for the year for which the determination is made; and</text></subparagraph>
<subparagraph id="HCF2F7404D94141C08B25ED283B56D88E"><enum>(B)</enum><text>the quotient of—</text>
<clause id="H41D095F61A734BBEA800E04D565CE87"><enum>(i)</enum><text>the total amount of need-based grant aid and merit-based grant aid, from Federal, State, and institutional sources, provided to such students enrolled in the institution for such year; and</text></clause>
<clause id="H3EAD811588704E418FCEB3AB814781BA"><enum>(ii)</enum><text>the total number of such students receiving such need-based grant aid or merit-based grant aid for such year.</text></clause></subparagraph></paragraph>
<paragraph id="H856C5498A76C4A3285F201197D06E2BF"><enum>(4)</enum><header>Tuition and fees</header><text>The term <term>tuition and fees</term> means the average annual cost of tuition and fees for an institution of higher education for first-time, full-time undergraduate students enrolled in the institution.</text></paragraph></subsection>
<subsection id="H97DE3B3BBA6A4BE9B421C0BBBF6E6048"><enum>(b)</enum><header>Calculations for public institutions</header><text>In making the calculations regarding cost of attendance, net price, and tuition and fees under this section with respect to a public institution of higher education, the Secretary shall calculate the cost of attendance, net price, and tuition and fees at such institution in the manner described in subsection (a), except that—</text>
<paragraph id="H5D694582F5EC41B3B46891CBF4006D56"><enum>(1)</enum><text>the cost of attendance, net price, and tuition and fees shall be calculated for first-time, full-time undergraduate students enrolled in the institution who are residents of the State in which such institution is located; and</text></paragraph>
<paragraph id="HD725EC29431A4B9FABB22DCDF4EAB2AB"><enum>(2)</enum><text>in determining the net price, the average need-based grant aid and merit-based grant aid described in subsection (a)(3)(B) shall be calculated based on the average total amount of such aid received by first-time, full-time undergraduate students who are residents of the State in which such institution is located, divided by the total number of such resident students receiving such need-based grant aid or merit-based grant aid at such institution.</text></paragraph></subsection>
<subsection id="HA04ABCBF8BA145F4AEF000ACF05DE11"><enum>(c)</enum><header>College affordability and transparency lists</header>
<paragraph id="H02406F3B782A4E56BFC5E480D4BE7F55"><enum>(1)</enum><header>Availability of lists</header><text>Beginning July 1, 2011, the Secretary shall make publicly available on the College Navigator website, in a manner that is sortable and searchable by State, the following:</text>
<subparagraph id="H64BDDE7261DC4586859F37E85859D7F2"><enum>(A)</enum><text>A list of the five percent of institutions in each category described in subsection (d) that have the highest tuition and fees for the most recent academic year for which data are available.</text></subparagraph>
<subparagraph id="HE84C703DA6784C4C9D6BF98891BEEE00"><enum>(B)</enum><text>A list of the five percent of institutions in each such category that have the highest net price for the most recent academic year for which data are available.</text></subparagraph>
<subparagraph id="HAFE6CFE9A2C841A9AE42D1C12F39A967"><enum>(C)</enum><text>A list of the five percent of institutions in each such category that have the largest increase, expressed as a percentage change, in tuition and fees over the most recent three academic years for which data are available, using the first academic year of the three-year period as the base year to compute such percentage change.</text></subparagraph>
<subparagraph id="HD72796CFA01A418DA63BA4BD1B257C6D"><enum>(D)</enum><text>A list of the five percent of institutions in each such category that have the largest increase, expressed as a percentage change, in net price over the most recent three academic years for which data are available, using the first academic year of the three-year period as the base year to compute such percentage change.</text></subparagraph>
<subparagraph id="HA96B996F42CD474D8C00A220EB16907F"><enum>(E)</enum><text>A list of the ten percent of institutions in each such category that have the lowest tuition and fees for the most recent academic year for which data are available.</text></subparagraph>
<subparagraph id="H48C8E1E37EF7484B91D2FBA45B4B5F32"><enum>(F)</enum><text>A list of the ten percent of institutions in each such category that have the lowest net price for the most recent academic year for which data are available.</text></subparagraph></paragraph>
<paragraph commented="no" id="H8DEB375C0254470DA5D78F7DF0F92049"><enum>(2)</enum><header>Annual updates</header><text>The Secretary shall annually update the lists described in paragraph (1) on the College Navigator website.</text></paragraph></subsection>
<subsection id="HDABA901AF73048A694C0E1600010A7E0"><enum>(d)</enum><header>Categories of institutions</header><text>The lists described in subsection (c)(1) shall be compiled according to the following categories of institutions that participate in programs under title IV:</text>
<paragraph id="HA6BE9C610CF6436A85F3D296F504FD38"><enum>(1)</enum><text>Four-year public institutions of higher education.</text></paragraph>
<paragraph id="H070659E5114B4106BDB87F1CC9FBF17E"><enum>(2)</enum><text>Four-year private, nonprofit institutions of higher education.</text></paragraph>
<paragraph id="HD707DCF4C0584157A10007132DF8DC39"><enum>(3)</enum><text>Four-year private, for-profit institutions of higher education.</text></paragraph>
<paragraph id="HDC7816D43B6F4FAEAD4C2F4C4C35D010"><enum>(4)</enum><text>Two-year public institutions of higher education.</text></paragraph>
<paragraph id="H13EA0549CB7E4AF4AA24007E25E68E12"><enum>(5)</enum><text>Two-year private, nonprofit institutions of higher education.</text></paragraph>
<paragraph id="H3CC4929A44F3401087955EA3C88BF76B"><enum>(6)</enum><text>Two-year private, for-profit institutions of higher education.</text></paragraph>
<paragraph id="H39701EF81D5B49E200574BC29859A09D"><enum>(7)</enum><text>Less than two-year public institutions of higher education.</text></paragraph>

<paragraph id="HCE2847BF91CB42D589EB1396BE0511C0"><enum>(9)</enum><text>Less than two-year private, for-profit institutions of higher education.</text></paragraph></subsection>
<subsection id="H560D435A9606471AA53FDDE67B5EA0"><enum>(e)</enum><header>Reports by institutions</header>
<paragraph id="H26532EDEE90C4C619E8E007E2B4EB14E"><enum>(1)</enum><header>Report to secretary</header><text>If an institution of higher education is included on a list described in subparagraph (C) or (D) of subsection (c)(1), the institution shall submit to the Secretary a report containing the following information:</text>
<subparagraph id="H0E500F3D4D3441AA86BB6495E8B5008C"><enum>(A)</enum><text>A description of the major areas in the institution’s budget with the greatest cost increases.</text></subparagraph>
<subparagraph id="HA4837AC78C3B4787B3902999B196A021"><enum>(B)</enum><text>An explanation of the cost increases described in subparagraph (A).</text></subparagraph>
<subparagraph id="H221DF2D5BBC848A8A3E38E657BC0DAA4"><enum>(C)</enum><text>A description of the steps the institution will take toward the goal of reducing costs in the areas described in subparagraph (A).</text></subparagraph>
<subparagraph id="H1348ACF1EEB64FFF93597F34D10AA3D"><enum>(D)</enum><text>In the case of an institution that is included on the same list under subparagraph (C) or (D) of subsection (c)(1) for two or more consecutive years, a description of the progress made on the steps described in subparagraph (C) of this paragraph that were included in the institution's report for the previous year.</text></subparagraph>
<subparagraph id="HC5B8565DE3D04FB1A752C2CFAA76025"><enum>(E)</enum><text>If the determination of any cost increase described in subparagraph (A) is not within the exclusive control of the institution—</text>
<clause id="H0DA807ABF02D4A9F8541DE91986E8CFE"><enum>(i)</enum><text>an explanation of the extent to which the institution participates in determining such cost increase;</text></clause>
<clause id="H11C1B96BBD524E68ABA1A22196A11134"><enum>(ii)</enum><text>the identification of the agency or instrumentality of State government responsible for determining such cost increase; and</text></clause>
<clause id="H6E1DB3EEB6FB4F33BCF01C36AFB23D89"><enum>(iii)</enum><text>any other information the institution considers relevant to the report.</text></clause></subparagraph></paragraph>
<paragraph id="H46528D03EEB04F6CB3B1626976A0056C"><enum>(2)</enum><header>Information to the public</header><text>The Secretary shall—</text>
<subparagraph id="HB23A0D8653654E50AECD139DA7D7D572"><enum>(A)</enum><text>issue an annual report that summarizes all of the reports by institutions required under paragraph (1) to the authorizing committees; and</text></subparagraph>
<subparagraph id="H397E639E5E9240B0AAEAE5504F007FA5"><enum>(B)</enum><text>publish such report on the College Navigator website.</text></subparagraph></paragraph></subsection>
<subsection id="HCA0398CE6A8740A8A9AD97234ED7628C"><enum>(f)</enum><header>Exemptions</header>
<paragraph commented="no" id="H6536CF6F51CD400FB6C0A267B603B29D"><enum>(1)</enum><header>In general</header><text>An institution shall not be placed on a list described in subparagraph (C) or (D) of subsection (c)(1), and shall not be subject to the reporting required under subsection (e), if the dollar amount of the institution's increase in tuition and fees, or net price, as applicable, is less than $600 for the three-year period described in such subparagraph.</text></paragraph>
<paragraph id="H57FAD4BF26CC4511A7620774961945F1"><enum>(2)</enum><header>Update</header><text>Beginning in 2014, and every three years thereafter, the Secretary shall update the dollar amount described in paragraph (1) based on annual increases in inflation, using the Consumer Price Index for each of the three most recent preceding years.</text></paragraph></subsection>
<subsection id="H14156DB5C80544A8A6CAA9AFA24881B8"><enum>(g)</enum><header>State higher education spending chart</header><text>The Secretary shall annually report on the College Navigator website, in charts for each State, comparisons of—</text>
<paragraph id="HFB2BF639C54041268CC55645FF6B4A"><enum>(1)</enum><text>the percentage change in spending by such State per full-time equivalent student at all public institutions of higher education in such State, for each of the five most recent preceding academic years;</text></paragraph>
<paragraph id="HFBC7F4A5C92A43338FE72C96A73EC400"><enum>(2)</enum><text>the percentage change in tuition and fees for such students for all public institutions of higher education in such State for each of the five most recent preceding academic years; and</text></paragraph>
<paragraph id="H7378F055B3204AFE96C01BF6628BEA1"><enum>(3)</enum><text>the percentage change in the total amount of need-based aid and merit-based aid provided by such State to full-time students enrolled in the public institutions of higher education in the State for each of the five most recent preceding academic years.</text></paragraph></subsection>
<subsection id="H48B4F340359942D3AF33547F38FE9F13"><enum>(h)</enum><header>Net price calculator</header>
<paragraph id="H9FDE5987DC7F43F69F4BD0CC0091AD87"><enum>(1)</enum><header>Development of net price calculator</header><text>Not later than one year after the date of enactment of the <short-title>Higher Education Opportunity Act</short-title>, the Secretary shall, in consultation with institutions of higher education and other appropriate experts, develop a net price calculator to help current and prospective students, families, and other consumers estimate the individual net price of an institution of higher education for a student. The calculator shall be developed in a manner that enables current and prospective students, families, and consumers to determine an estimate of a current or prospective student’s individual net price at a particular institution.</text></paragraph>
<paragraph commented="no" id="HA8316BA10613489F9EB30CB5C7EE9C7"><enum>(2)</enum><header>Calculation of individual net price</header><text>For purposes of this subsection, an individual net price of an institution of higher education shall be calculated in the same manner as the net price of such institution is calculated under subsection (a)(3), except that the cost of attendance and the amount of need-based and merit-based aid available shall be calculated for the individual student as much as practicable.</text></paragraph>
<paragraph id="H24EB0FC59B8B44568DE79191B04648EB"><enum>(3)</enum><header>Use of net price calculator by institutions</header><text>Not later than two years after the date on which the Secretary makes the calculator developed under paragraph (1) available to institutions of higher education, each institution of higher education that receives Federal funds under title IV shall make publicly available on the institution's website a net price calculator to help current and prospective students, families, and other consumers estimate a student's individual net price at such institution of higher education. Such calculator may be a net price calculator developed—</text>
<subparagraph id="H1C7DE5EAE90A42618432A26DAF40A117"><enum>(A)</enum><text>by the Department pursuant to paragraph (1); or</text></subparagraph>
<subparagraph id="H35BBEDE91248497283F59DCADB4D8EA1"><enum>(B)</enum><text>by the institution of higher education, if the institution’s calculator includes, at a minimum, the same data elements included in the calculator developed under paragraph (1).</text></subparagraph></paragraph>
<paragraph id="HD18E3086581F43DB9D0080185E2D4583"><enum>(4)</enum><header>Disclaimer</header><text>Estimates of an individual net price determined using a net price calculator required under paragraph (3) shall be accompanied by a clear and conspicuous notice—</text>
<subparagraph id="HF550E05A69664126A3E1C3DF00F3A165"><enum>(A)</enum><text>stating that the estimate—</text>
<clause id="H30145F56006D4E72BA8DE7570297A5DB"><enum>(i)</enum><text>does not represent a final determination, or actual award, of financial assistance;</text></clause>
<clause id="H35D5004D490143D7841C44A8F79E7BF8"><enum>(ii)</enum><text>shall not be binding on the Secretary, the institution of higher education, or the State; and</text></clause>
<clause id="H040A9566027946BAAE1182B0034C8235"><enum>(iii)</enum><text>may change;</text></clause></subparagraph>
<subparagraph id="HF2D955FBFE814043BDBD8F0013C931B6"><enum>(B)</enum><text>stating that the student must complete the Free Application for Feder
