		<official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/9/1">chapter 1</external-xref> of title 9 of the United States Code
		  with respect to arbitration of certain controversies.</official-title>

		<section id="H1B2CFB64333D4ED89647E75C53C66C19" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Automobile Arbitration Fairness Act of
			 2008</short-title></quote>.</text>
		</section><section id="H54DC5C7A4A864749A6007B8D07221E51"><enum>2.</enum><header>Amendments</header>
			<subsection id="H8A94752A6CDA48D2BC7BF6B3E693BF5"><enum>(a)</enum><header>Requirements for
			 arbitration of certain controversies</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/9/1">Chapter 1</external-xref> of title 9, United States Code,
			 is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HA3B342993D49480486D24030843FB427" style="USC">
					<section id="H29875A0CDD5E41FDA2C8631137578FB0"><enum>17.</enum><header>Requirements
				applicable to certain controversies</header>
						<subsection id="H4B609E36574B4644A7E5C48D1197440"><enum>(a)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
							<paragraph id="H89A2E6C01D8C4027B4F1C7CF222013A7"><enum>(1)</enum><text>the term
				<term>motor vehicle</term> has the meaning given such term in section 30102 of
				title 49; and</text>
							</paragraph><paragraph id="H82593CD58E2546FEAE4CF4EEBC59B7DC"><enum>(2)</enum><text>the term
				<term>motor vehicle consumer sales or lease contract</term> means a contract
				under which a person regularly engaged in the business of selling motor
				vehicles sells or leases a motor vehicle to an individual.</text>
							</paragraph></subsection><subsection id="HA13C491944F540EFBD6570C5B1455407"><enum>(b)</enum><header>Requirements</header>
							<paragraph id="HAA2CD0C00AD647E29FF47DA79EF62975"><enum>(1)</enum><header>Required
				consent</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of this chapter or of any other law (excluding chapters 2 and 3
				of this title), a controversy described in subsection (c) may not be settled by
				arbitration unless, after such controversy arises, all the parties to such
				controversy agree in writing to settle such controversy by arbitration.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H76A99EDE9FA34FC0BFD4B2B611D4635"><enum>(2)</enum><header>Required
				explanation of arbitration award</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				chapter or of any other law (excluding chapters 2 and 3 of this title), at the
				request of any of such parties made after such controversy arises and before an
				award is made in an arbitration agreed to in accordance with paragraph (1),
				such award shall include a brief, informal discussion of the factual and legal
				basis for the award, but formal findings of fact or conclusions of law shall
				not be required.</text>
							</paragraph></subsection><subsection display-inline="no-display-inline" id="H58AE1EB140524F2E888D68B2EF3E93A3"><enum>(c)</enum><header> Controversy
				described</header><text display-inline="yes-display-inline">Subsection (b)
				shall apply with respect to a controversy arising out of a motor vehicle
				consumer sales or lease contract as entered into, amended, altered, modified,
				renewed, or extended on or after the date of the enactment of the
				<short-title>Automobile Arbitration Fairness Act of
				2008</short-title>, or out of a refusal to perform the whole or any part of
				such
				contract.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H39BC789646CB4D5C9690A8A7E5BA3C35"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/9/1">chapter 1</external-xref> of title 9, United States Code, is amended by adding at
			 the end the following:</text>
