		  Act of 1974 with respect to juveniles who have committed offenses, and for

		<section id="H5EC41D9A7CD24FC98B00C9FAC5F175DC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Juvenile Justice Improvement Act of
			 2008</short-title></quote>.</text>
		</section><section id="H244F36E2C2A145AFB9DAC4EAB07B5031"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 103 of the Juvenile Justice and
			 Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5603">42 U.S.C. 5603</external-xref>) is amended—</text>
			<paragraph id="HBFE242DE92CC4DBC99ED51690737EBF9"><enum>(1)</enum><text>in paragraph (25)
			 by inserting <quote>, including sight or sound,</quote> after
			 <quote>incarceration</quote>,</text>
			</paragraph><paragraph id="HEE60055D473D4B539DAC725725831D79"><enum>(2)</enum><text>by amending
			 paragraph (26) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H0883730C8CEE43E094DA1F9900B351FA" style="traditional">
					<paragraph id="H68DDAD93F3F949B69D72815CC7A6B7F3"><enum>(26)</enum><text>the term
				<quote>adult inmate</quote> means an individual who—</text>
						<subparagraph id="HB87CFDF63FED41CF8940FD29CE5B000"><enum>(A)</enum><text display-inline="yes-display-inline">has reached the age of full criminal
				responsibility under applicable State law; and</text>
						</subparagraph><subparagraph id="H4212D81B004444F494FBE8B94EB6AEF6"><enum>(B)</enum><text>has been arrested
				and is in custody for or awaiting trial on a criminal charge, or is convicted
				of a criminal charge offense; excluding individuals who are—</text>
							<clause id="H1E847FAB131E44EBB25534003BD25819"><enum>(i)</enum><text>younger than the
				age of full criminal responsibility under applicable State law at the time of
				the criminal charge offense; or</text>
							</clause><clause id="HF6B9AFBC6C914D37A656FBBD48037B4D"><enum>(ii)</enum><text>younger than the
				maximum age of extended juvenile jurisdiction applicable under State law;
				and</text>
							</clause><clause id="HA17D6683157946819381CC89541570E3"><enum>(iii)</enum><text>have been
				committed to the care and custody of a juvenile correctional facility by a
				court of competent jurisdiction or by operation of State
				law.</text>
							</clause></subparagraph></paragraph><after-quoted-block>,</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H4E240AD3EF484091ABE622A7A7A92E13"><enum>(3)</enum><text>in paragraph (28)
			 by striking <quote>; and</quote> at the end,</text>
			</paragraph><paragraph id="HAC53C831A05E42E1BBEC9ED69437CAB8"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (29) by striking the period at
			 the end and inserting a semicolon, and</text>
			</paragraph><paragraph id="HB71D875A263C43D99DA5446D9ED885AA"><enum>(5)</enum><text>by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HECFD7C7477514CFD00892FCC63473138" style="traditional">
					<paragraph id="H1B0BA3E39AE04423B4318DDB071812A5"><enum>(30)</enum><text>the term
				<quote>restraint</quote> means a chemical or medical agent, physical force
				technique, or mechanical device that restricts movement;</text>
					</paragraph><paragraph id="H0B36F19083E843069CD2B8C69400B191"><enum>(31)</enum><text>the term
				<quote>chemical agent</quote> means a spray used to temporarily incapacitate a
				person, such as oleoresin capsicum spray, tear gas, or
				2-chlorobenzalmalononitrile gas (CS gas);</text>
					</paragraph><paragraph id="H1EC879400CB24E3184DEFC0051B97655"><enum>(32)</enum><text>the term
				<quote>seclusion</quote> means any instance in which a youth is confined alone
				for more than 15 minutes, including in an unlocked or locked room, specialized
				unit or other area of isolation, segregation, or room time;</text>
					</paragraph><paragraph id="HA3495DA8376B485700B6B0034F24513"><enum>(33)</enum><text display-inline="yes-display-inline">the term <quote>evidence based</quote>
				means a program that is demonstrated with relative evidence, normed and
				validated for a diverse population, to be either—</text>
						<subparagraph id="HC9D3B7346FB84387859EAA70F118DC5D"><enum>(A)</enum><text>exemplary, such
				that it is implemented with a high degree of fidelity and demonstrates robust
				empirical findings using a reputable conceptual framework and an experimental
				evaluation design of the highest quality (a random assignment control trial);
				or</text>
						</subparagraph><subparagraph id="HCA749FEE9F5E4BC2BA962960C8071320"><enum>(B)</enum><text display-inline="yes-display-inline">effective, such that it is implemented with
				sufficient fidelity that it demonstrates adequate empirical findings using a
				sound conceptual framework and a quasi-experimental evaluation design of high
				quality (comparison group without random assignment control group);</text>
						</subparagraph></paragraph><paragraph id="H054B70F6F5A44D529BCF858023E80000"><enum>(34)</enum><text>the term
				<quote>promising</quote> means a program that demonstrates effectiveness using
				reasonable, limited findings, and that has underway a more appropriate
				evaluation that meets the criteria set forth in paragraph (33)(A) for
				determining evidence-based programs; and</text>
					</paragraph><paragraph id="HC63DF31FF74D43219749B1E9DC7F362"><enum>(35)</enum><text>the term
				<quote>dangerous practice</quote> means an act, procedure, or program that
				creates an unreasonable risk of physical injury, pain, or psychological harm to
				a juvenile subjected to the act, and it includes the use of chemical agents;
				choking; blows to the head; twisting body parts against joints or other
				techniques that rely on infliction of pain to secure compliance; restraint to
				fixed objects; restraint in any manner that creates risk of asphyxiation; use
				of belly belts or chains on pregnant girls; use of four-point or five-point
				restraints, straightjackets or restraint chairs, except for medical or mental
				health purposes specifically related to the safety of the youth, and under the
				direct supervision of medical or mental health personnel, use of psychotropic
				medication without adherence to professional standards regarding dosage, or for
				purposes of coercion, punishment, or convenience of staff; and use of physical
				force, chemical agents, or mechanical restraints for purposes of coercion,
				retaliation, punishment, or convenience of staff; and prolonged, forced
				physical
				exercise.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H2E9C3284BDD447769D853857F7CB10AC"><enum>3.</enum><header>State
			 plan</header><text display-inline="no-display-inline">Section 223(a) of the
			 Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5633">42 U.S.C. 5633(a)</external-xref>) is
			 amended—</text>
			<paragraph id="H900291A1E4A84CBFB6941C6BEE29CA73"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (8) by striking
			 <quote>existing</quote> and inserting <quote>proven effective</quote>,</text>
			</paragraph><paragraph id="H8D095D92953E4B22A0733D45D24062C"><enum>(2)</enum><text>in
			 paragraph (9)(L)(i) by striking <quote>restraints</quote> and inserting
			 <quote>requirements</quote>,</text>
			</paragraph><paragraph id="HBD92E2A401DA49829D79AF5DDB98637B"><enum>(3)</enum><text>in paragraph (27)
			 by striking <quote>and</quote> at the end,</text>
			</paragraph><paragraph id="HE84625A15906470EA0EC9EBF8CBCE700"><enum>(4)</enum><text>in paragraph (28)
			 by striking the period at the end and inserting a semicolon, and</text>
			</paragraph><paragraph id="H4678303F91B04E36B681A09D4BFD8C17"><enum>(5)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H95C1CC99EBD046FEA527BD007FF31161" style="traditional">
					<paragraph id="H13CB9BE7FC144678A635E0A594F25EAE"><enum>(29)</enum><text>provide that,
				within 4 years of the date of enactment of this paragraph, juveniles treated as
				adults for purposes of prosecution in criminal court and juveniles prosecuted
				as adults in criminal court may not be held in a jail or lockup for adults
				while such juveniles are awaiting trial on a criminal charge;</text>
					</paragraph><paragraph id="HE48B76FE1B61466BBC30A161243C815B"><enum>(30)</enum><text>provide that,
				within 4 years of the date of enactment of this paragraph, juveniles treated as
				adults for purposes of prosecution in criminal court and juveniles prosecuted
				as adults in criminal court may not be within sight or sound contact of adult
				inmates when held in the custody of the criminal court awaiting trial or other
				legal process; and</text>
					</paragraph><paragraph id="HE5E070826A63400CA34D48181EFC35B4"><enum>(31)</enum><text>provide that the
				State will—</text>
						<subparagraph id="H508B8D7B7F8F4ADDB1BAC3D3A420A19C"><enum>(A)</enum><text>develop policies
				and procedures to eliminate the State-supported use of dangerous practices with
				juveniles in the custody of State or local secure detention and correctional
				facilities and residential treatment centers;</text>
						</subparagraph><subparagraph id="HCBBA1F4C7E8C4399B62C3289739D56E3"><enum>(B)</enum><text>increase the
				State’s efforts to operate facilities and programs that are safe for youth and
				staff, through effective behavior management systems that clearly communicate
				incentives and sanctions to increase appropriate behavior and decrease
				inappropriate behavior, and which are implemented through a continuum of
				responses that begin with verbal de-escalation and that only allow for use of
				the most punitive responses as a last resort;</text>
						</subparagraph><subparagraph id="HB1697B94808D4B4B84D4626DEA93B485"><enum>(C)</enum><text>increase the
				State’s efforts to provide training for facility staff on effective techniques
				for effective behavior management, de-escalation and crisis intervention,
				adolescent development, safe physical control techniques, developmental
				disabilities, mental health disorders, and cultural competence; and</text>
						</subparagraph><subparagraph id="HF8F49A92C0364BF2B6AC96D22C4588FC"><enum>(D)</enum><text>increase the
				State’s efforts to develop engaging, effective programming, and establish safe
				staffing levels in secure detention and correctional
				facilities.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H4670557143B345E100A0B3E494BF57CA"><enum>4.</enum><header>Promoting
			 alternatives to incarceration</header><text display-inline="no-display-inline">Section 222 of the Juvenile Justice and
			 Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5632">42 U.S.C. 5632</external-xref>) is amended by adding at the
			 end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H2A5A777C17F14E3E980093C361C900DA" style="OLC">
				<subsection id="H9988BA1DBB374349BCB716BC468052A7"><enum>(e)</enum><header>Incentive
				Grants</header>
					<paragraph id="HD067DC473BD44B0A80983EEE4EAF00D8"><enum>(1)</enum><header>Incentive grants
				funds</header><text>The Administrator shall make grants totaling at least 5
				percent of the funds appropriated for this part in each fiscal year as
				incentive grants to States. The Administrator shall make such incentive grants
				consistent with the provisions of subsection (a), and shall condition such
				grants upon—</text>
						<subparagraph id="HFBA07460C1E74299B714CBD9357629CA"><enum>(A)</enum><text display-inline="yes-display-inline">the State’s support for evidence-based or
				promising programs, prioritizing programs that address the mental health
				treatment needs of juveniles;</text>
						</subparagraph><subparagraph id="HBB112A19B42742A08C2415D46076AAE3"><enum>(B)</enum><text display-inline="yes-display-inline">the State’s support of reforms that reduce
				or eliminate the State-supported use of dangerous practices;</text>
						</subparagraph><subparagraph id="H69AE2600260F4C0AB700F97B99B9A8E0"><enum>(C)</enum><text display-inline="yes-display-inline">the State’s support for reforms that ensure
				that seclusion in secure detention or correctional facilities is limited to
				situations in which seclusion is the least restrictive measure sufficient to
				address a youth’s danger to self or others, used only for the amount of time
				necessary and is terminated when there is no longer an immediate danger to the
				youth or others, or imposed only after applicable due process; and</text>
						</subparagraph><subparagraph id="HFE31AC3E2A46433F8F55DD4909C3006C"><enum>(D)</enum><text display-inline="yes-display-inline">the demonstration by the State of an
				improvement of public safety and rehabilitation of delinquent and at-risk
				youths.</text>
						</subparagraph></paragraph><paragraph id="HFFDBB2EFB8CE450481B2416FFA139669"><enum>(2)</enum><text display-inline="yes-display-inline">The State shall make the demonstration
				required by paragraph (1)(D) by using accurate and reliable data reported
				annually showing both—</text>
						<subparagraph id="H1BF0310F47904D85B1AF4B9B05DC6F9E"><enum>(A)</enum><text display-inline="yes-display-inline">a reduction in either recidivism or
				offenses by youths under age 18, using arrest data; and</text>
						</subparagraph><subparagraph id="H0BA6B78CC78A4E25A6322BA3573E24B2"><enum>(B)</enum><text display-inline="yes-display-inline">either—</text>
							<clause id="H7DDFE16B21B34F9FBC7976ABB36FAF18"><enum>(i)</enum><text display-inline="yes-display-inline">an increase in the use of least restrictive
				placement for juveniles as appropriate for community safety;</text>
							</clause><clause id="H8235E4FC79B84AE5BBF5DD8B1EAE1042"><enum>(ii)</enum><text display-inline="yes-display-inline">an increase in the safety of youths in the
				delinquency or criminal justice system; or</text>
							</clause><clause id="HBB7A6B1FE4F0421C9EE26F4505E346BE"><enum>(iii)</enum><text display-inline="yes-display-inline">a decrease in racial and ethnic disparities
				in the delinquency
				system.</text>
							</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H377D76801DC346D89FE487BFFB29773B"><enum>5.</enum><header>Removing the
			 valid court order exception for status offenders</header><text display-inline="no-display-inline">Section 223(a)(11) of the Juvenile Justice
			 and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5633">42 U.S.C. 5633(a)(11)</external-xref>) is
			 amended—</text>
			<paragraph id="H12575E6023974EFCB33D5185B99E42F"><enum>(1)</enum><text>by
			 striking <quote>shall</quote>, and</text>
			</paragraph><paragraph id="HC49D95F16DC74963905F80D815D7A96F"><enum>(2)</enum><text>by amending
			 subparagraph (A) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H4D2468683B06423FA2CB93614576F8BE" style="OLC">
					<subparagraph id="H9632743153F04394BC2D5BAC15F3F524"><enum>(A)</enum><text display-inline="yes-display-inline">juveniles who are charged with or who have
				committed an offense that would not be criminal if committed by an adult,
				excluding juveniles who are charged with or who have committed a violation of
				<external-xref legal-doc="usc" parsable-cite="usc/18/922">section 922(x)(2)</external-xref> of title 18, United States Code, or of a similar State law,
				shall not be placed in secure detention facilities or secure correctional
				facilities;
				and</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
