		<official-title>To amend the Immigration and Nationality Act to eliminate
		  the per country level for employment-based immigrants and to end the spill-over
		  of unused immigrant visa numbers between employment-based and family-sponsored
		  categories.</official-title>

		<section id="H2D3DA19927104A59AB859E26A09724E6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>High Skilled Per Country Level
			 Elimination Act</short-title></quote>.</text>
		</section><section id="H24FE0CA03FB040EBA717AF8F1B00D7C8"><enum>2.</enum><header>Elimination of
			 per country level for employment-based immigrants</header><text display-inline="no-display-inline">Section 202(a) of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1152">8 U.S.C. 1152(a)</external-xref>) is amended—</text>
			<paragraph id="H6885154968734155B7D15DA33E14EB84"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
				<subparagraph id="H90767B9BAF2745B6868169DBFA37E402"><enum>(A)</enum><text>by striking
			 <quote>, (4), and (5)</quote> and inserting <quote>and (4)</quote>; and</text>
				</subparagraph><subparagraph id="H0EA3596A38594B76BFFD2E35F7AD026F"><enum>(B)</enum><text>by striking
			 <quote>subsections (a) and (b) of section 203</quote> and inserting
			 <quote>section 203(a)</quote>;</text>
				</subparagraph><subparagraph id="H2A6C104D5DAE427C98600800F3001780"><enum>(C)</enum><text>by striking
			 <quote>7 percent (in the case of a single foreign state) or 2 percent</quote>
			 and inserting <quote>10 percent (in the case of a single foreign state) or 5
			 percent</quote>; and</text>
				</subparagraph><subparagraph id="H9F05ED7B61CA4DD5A42F3B339B97FE92"><enum>(D)</enum><text>by striking
			 <quote>such subsections</quote> and inserting <quote>such section</quote>; and</text>
				</subparagraph></paragraph><paragraph id="HC402AF70E3254F73AA7599AE5D661CBB"><enum>(2)</enum><text>by striking
			 paragraph (5).</text>
			</paragraph></section><section id="H9BB891C6EE6F498B92BEE6ECCA388C56"><enum>3.</enum><header>Worldwide levels
			 of employment-based and family-sponsored immigrants</header>
			<subsection id="H27F6D86266424910A74100F03E115BED"><enum>(a)</enum><header>Worldwide level
			 of employment-based immigrants</header><text>Section 201(d) of the Immigration
			 and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(d)</external-xref>) is amended to read as follows:</text>

					<subsection id="H5C9103FF653F4625ACDFEBEB86026836"><enum>(d)</enum><header>Worldwide level
				of employment-based immigrants</header>
						<paragraph id="HA93D7F99A0364E75B12FEF2625AC3C43"><enum>(1)</enum><header>In
				general</header><text>The worldwide level of employment-based immigrants under
				this subsection for a fiscal year is equal to the sum of—</text>
							<subparagraph id="H043B11BB699D48C885D7FDE3186F8D85"><enum>(A)</enum><text>140,000;
				and</text>
							</subparagraph><subparagraph id="H291D69A4F0884E51872C5471A7C7E4FE"><enum>(B)</enum><text>the number
				computed under paragraph (2).</text>
							</subparagraph></paragraph><paragraph id="H32E58D43D3EA4DDC9D70036B5D294FD9"><enum>(2)</enum><header>Unused visa
				numbers from previous fiscal year</header><text>The number computed under this
				paragraph for a fiscal year is the difference, if any, between—</text>
							<subparagraph id="H52D0A1912D35477499D296294BB4CEEE"><enum>(A)</enum><text>the worldwide
				level established under paragraph (1) for the previous fiscal year; and</text>
							</subparagraph><subparagraph id="H44162534C9C94B9FB839D04B629D4680"><enum>(B)</enum><text>the number of
				visas actually issued under section 203(b), subject to this subsection, during
				the previous fiscal
				year.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5CDC8F2AC11A41738B8F58AD57882F94"><enum>(b)</enum><header>Worldwide level
			 of family-sponsored immigrants</header><text>Section 201(c) of the Immigration
			 and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(c)</external-xref>) is amended to read as follows:</text>

					<subsection id="H5990780CE2694B649739EBDF49A37FF9"><enum>(c)</enum><header>Worldwide level
				of family-sponsored immigrants</header>
						<paragraph display-inline="no-display-inline" id="H760C66BBF13F4D02B28F98AEC33DA11"><enum>(1)</enum><header>In
				general</header>
							<subparagraph id="H4BB7B3BBDB244A1BABD7D3461834B2EB"><enum>(A)</enum><header>Base
				level</header><text>Subject to subparagraph (B), the worldwide level of
				family-sponsored immigrants under this subsection for a fiscal year is equal
				to—</text>
								<clause id="H4031ADE0545B4CB98C6BD70FFD57E1B"><enum>(i)</enum><text>480,000 minus the
				number computed under paragraph (2); plus</text>
								</clause><clause id="HB8D411F12118430B98C211AFAB8726C1"><enum>(ii)</enum><text>the number
				computed under paragraph (3).</text>
								</clause></subparagraph><subparagraph display-inline="no-display-inline" id="HA69DF4D4276E44DE94F7B0B856E1F6D3"><enum>(B)</enum><header>Minimum</header><text>In
				no case shall the number computed under subparagraph (A) be less than
				226,000.</text>
							</subparagraph></paragraph><paragraph id="H8127B91F04BC455687B7DBC9833BE91C"><enum>(2)</enum><header>Number of
				certain aliens not subject to direct numerical limitations</header><text>The
				number computed under this paragraph for a fiscal year is the number of aliens
				described in subparagraph (A) or (B) of subsection (b)(2) who were issued
				immigrant visas, or who otherwise acquired the status of an alien lawfully
				admitted to the United States for permanent residence, in the previous fiscal
				year.</text>
						</paragraph><paragraph display-inline="no-display-inline" id="HDDDF999207F04B539DE43C2137E487F"><enum>(3)</enum><header>Unused visa
				numbers from previous fiscal year</header><text>The number computed under this
				paragraph for a fiscal year is the difference, if any, between—</text>
							<subparagraph id="HEB50D4331B3A40209B114C08E3339299"><enum>(A)</enum><text display-inline="yes-display-inline">the worldwide level established under
				paragraph (1) for the previous fiscal year; and</text>
							</subparagraph><subparagraph id="H333D7FE0398947C8956043C46C1EDDF8"><enum>(B)</enum><text>the number of
				visas actually issued under section 203(a), subject to this subsection, during
				the previous fiscal
				year.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="HC20656C03DF34962897577E92CC8CAD"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect on the first day of the first fiscal year that
			 begins after the date of the enactment of this Act.</text>
