		  penalties for child pornography offenses, child sex trafficking offenses, and
		  other sexual offenses committed against children.</official-title>

		<section id="H075D8F3C53B945D590EB1B8487FC5B62" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Prevention and Deterrence of Crimes
			 Against Children Act of 2008</short-title></quote>.</text>
		</section><section id="H2413445A05694677A033281250F4FF75"><enum>2.</enum><header>Increased
			 penalties for child pornography offenses</header>
			<subsection id="H46414908BD6D4C4EA785B4F8B8F6EDB5"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2251">Section 2251(e)</external-xref> of title 18, United States Code, is
			 amended—</text>
				<paragraph id="H78A71D62CC674170A6E2F9FF002F904F"><enum>(1)</enum><text>by striking
			 <quote>15 years nor more than 30 years</quote> and inserting <quote>20 years or
			 for life</quote>; and</text>
				</paragraph><paragraph id="H96D3717E30D5459080EDB1F48E851A6"><enum>(2)</enum><text>by
			 striking <quote>not less than 25 years nor more than 50 years,</quote> and all
			 that follows through <quote>not less than 35 years nor more
			 than</quote>.</text>
				</paragraph></subsection><subsection id="H767423D1185540DDA1D43310F73EDF08"><enum>(b)</enum><header>Other
			 offenses</header><text>Sections <external-xref legal-doc="usc" parsable-cite="usc/18/2252">2252(b)</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/18/2252">2252A(b)</external-xref> of title 18, United States
			 Code, are each amended—</text>
				<paragraph id="H439950A601E443BF98B11442F9610271"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="H0C01DEA1E1D9449C93BFC5A0D5D8FCE"><enum>(A)</enum><text>by striking
			 <quote>5 years and not more than 20 years</quote> and inserting <quote>15 years
			 or for life</quote>; and</text>
					</subparagraph><subparagraph id="HCFF9F5A4157147A3B7EF004F2FC35BE3"><enum>(B)</enum><text>by striking
			 <quote>not less than 15 years nor more than 40 years.</quote> and inserting
			 <quote>life.</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H22C421BCD9F04FBB8CE166D5F3CA0321"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="H8252115E0A9447AE985346C68C5B23C6"><enum>(A)</enum><text>by striking
			 <quote>or imprisoned not more than 10 years, or both</quote> and inserting
			 <quote>and imprisoned for not less than 3 years nor more than 20
			 years</quote>;</text>
					</subparagraph><subparagraph id="H18C5B67C845F4686005E24EA55475B15"><enum>(B)</enum><text>by inserting
			 <quote>section 1591,</quote> after <quote>this chapter,</quote>; and</text>
					</subparagraph><subparagraph id="HCC8498A32E7245568743F490C1942CCC"><enum>(C)</enum><text>by striking
			 <quote>10 years nor more than 20 years.</quote> and inserting <quote>20 years
			 or for life.</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="HF565BD1D05C14DF19E4DFE00A4826CE3"><enum>(c)</enum><header>Domain
			 names</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2252B">Section 2252B(b)</external-xref> of title 18, United States Code, is
			 amended by striking <quote>10 years</quote> and inserting <quote>20
			 years</quote>.</text>
			</subsection><subsection id="H722D5D88ADDF40B7A934C9A00007F268"><enum>(d)</enum><header>Transportation
			 of minors</header><text display-inline="yes-display-inline">Section 2423(f) of
			 title 18, United States Code, is amended—</text>
				<paragraph id="HA85500C8AC394BD28166B82ED78668E0"><enum>(1)</enum><text>by striking
			 <quote>means (1) a</quote> and inserting the following: “means—</text>
					<quoted-block display-inline="no-display-inline" id="HE4817E2A83564CEEAC4238587049656E" style="OLC">
						<paragraph id="H29BA671F765D465388D0E9D733002883"><enum>(1)</enum><text>a</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HAB05B300CC4E4C12905ECDC484D36FD"><enum>(2)</enum><text>by
			 striking <quote>; or (2) any</quote> and inserting the following: “;</text>

			 end the following:</text>

				child pornography, as that term is defined in section
				2256(8).</text>

				</paragraph></subsection></section><section id="H6BDBE54A63A946748E7FCEC7B6D8EB00"><enum>3.</enum><header>Increased
			 penalties for child sex trafficking and child prostitution offenses</header>
			<subsection id="HA7AF86ECCE6649B29987531B55044C62"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1591(b) of
			 title 18, United States Code, is amended—</text>
				<paragraph id="H1F913EDE7B164A8DA3C1C4D90C71D51"><enum>(1)</enum><text>in
			 paragraph (1), by striking <quote>not less than 15</quote> and inserting
			 <quote>not less than 30</quote>; and</text>
				</paragraph><paragraph id="H2C8BAE4C195840E4A439A6CE8E2FB200"><enum>(2)</enum><text>in paragraph (2),
			 by striking <quote>not less than 10</quote> and inserting <quote>not less than
			 15</quote>.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H35B75EE235D7413CAA9C7B3300775320"><enum>(b)</enum><header>Coercion</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2422">Section 2422</external-xref> of title 18, United States
			 Code, is amended—</text>
				<paragraph id="H402EF7FBC596412489BB18205DDED3C0"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote>20 years</quote> and inserting <quote>30 years</quote>;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEE4BE05F614C44EFB538F9C100A372ED"><enum>(2)</enum><text>in subsection (b),
			 by striking <quote>10 years</quote> and inserting <quote>15
			 years</quote>.</text>
				</paragraph></subsection><subsection id="H8976AFF9C61F4A1B8C25F872E7D00F3"><enum>(c)</enum><header>Transportation of
			 minors</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2423">Section 2423</external-xref> of title 18, United States Code, is
			 amended—</text>
				<paragraph id="HC94BCFC73BBF4C3A953884199CFE122F"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote>10 years</quote> and inserting <quote>15
			 years</quote>;</text>
				</paragraph><paragraph id="HCDA08D3853BD44E2A882FFEF0066B224"><enum>(2)</enum><text>in subsections (b)
			 and (c), by striking <quote>or imprisoned not more than 30 years, or
			 both.</quote> and inserting <quote>and imprisoned for not less than 10 years
			 (unless the offense is based only on conduct that would be in violation of
			 sections 2243 or 2244) nor more than 30 years.</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF261E035A8724EC891DC13AD9632DBF"><enum>(3)</enum><text>in subsection (d),
			 by striking <quote>, imprisoned not more than 30 years, or both</quote> and
			 inserting <quote>and imprisoned for not less than 10 years nor more than 30
			 years</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA9FA54818F0F476086007D69A9398D68"><enum>(d)</enum><header>General
			 provisions</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1594">Section 1594(a)</external-xref> of title 18, United States Code, is
			 amended by inserting <quote>or conspires</quote> after
			 <quote>attempts</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H832DBFF570A24B6D972F367578C519B9"><enum>(e)</enum><header>Release and
			 detention</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3156">Section 3156(a)(4)(C)</external-xref> of title 18, United States Code,
			 is amended by inserting <quote>, or section 1591</quote> after
			 <quote>117</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H01CBEE50A3024CED864E8311C447DEC8"><enum>(f)</enum><header>Subpoenas</header><text>Section
			 3486(a)(1)(D) of title 18, United States Code, is amended by inserting
			 <quote>1591,</quote> after <quote>1201,</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H0FE2A4A5CEC348F9815C93BDB31FD0B2"><enum>4.</enum><header>Increased
			 penalties for child sex offenses resulting in death, repeated child sex crimes,
			 and forcible rape</header>
			<subsection id="HA9B9303204CB4E6A98013294397C8885"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2245">Section 2245</external-xref> of title 18, United States Code, is amended
			 by adding at the end the following:</text>
				<quoted-block id="H36DFA7AA78D7454C80DB64E5EBE8900" style="OLC">
					<subsection id="H4347A17E07E94A118F58DED4A21008C9"><enum>(b)</enum><header>Offenses
				Involving Children</header><text>A person who, in the course of an offense
				under this chapter, chapter 110, chapter 117, or section 1591 engages in
				conduct that results in the death of a person who has not attained the age of
				18 years, shall be punished by death or imprisoned for not less than 30 years
				or for
				life.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H925CD7DCEECF4B60B332D2A2007918B"><enum>(b)</enum><header>Classification of
			 offenses</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3559">Section 3559(e)(2)(A)</external-xref> of title 18, United States Code,
			 is amended by striking <quote>2423(a)</quote> and inserting
			 <quote>2423</quote>.</text>
			</subsection><subsection id="HE39A84F0E9A74C5FB000BE34FF621F87"><enum>(c)</enum><header>Repeat
			 offenders</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2426">Section 2426(b)(1)(A)</external-xref> of title 18, United States Code,
			 is amended—</text>
				<paragraph id="H678C5EE9A83A423FB8B6280510B77915"><enum>(1)</enum><text>by striking
			 <quote>or</quote> the first place it appears; and</text>
				</paragraph><paragraph id="H7E28C00405654A2388C9BA591BB60024"><enum>(2)</enum><text>by inserting
			 before the semicolon <quote>, or section 1591</quote>.</text>
				</paragraph></subsection><subsection id="H2CE495F52DB441EEBB00742D5DA74443"><enum>(d)</enum><header>Sexual
			 abuse</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2241">Section 2241</external-xref> of title 18, United States Code, is
			 amended—</text>
				<paragraph id="H519B2BD4DC47491C006E5C39BEBBC94"><enum>(1)</enum><text>in
			 subsection (a), by striking <quote>, imprisoned for any term of years or life,
			 or both</quote> and inserting <quote>and imprisoned for any term of years not
			 less than 10 or for life</quote>; and</text>
				</paragraph><paragraph id="HF9E9A0D0A2A14358B42F9E72184776B1"><enum>(2)</enum><text>in subsection (b),
			 by striking <quote>, imprisoned for any term of years or life, or both</quote>
			 and inserting <quote>and imprisoned for any term of years not less than 5 or
			 for life</quote>.</text>
				</paragraph></subsection></section><section id="H0941A88D9A474B03B21565A9CB5EA566"><enum>5.</enum><header>Sex tourism and
			 removal of sex offenders</header>
			<subsection id="H0F065D66FB8B4E1DB95DA56EC53183CE"><enum>(a)</enum><header>In
			 general</header><text>The Attorney General shall notify—</text>
				<paragraph id="H6244BD807FCB44199E32A355427642E3"><enum>(1)</enum><text>the Secretary of
			 State in a timely manner regarding any conviction of an individual of a
			 violation of <external-xref legal-doc="usc" parsable-cite="usc/18/2423">section 2423</external-xref> of title 18, United States Code, for appropriate
			 action under subsection (b) of this section; and</text>
				</paragraph><paragraph id="H1DCED34ABCB64A85AA00C212F2CFC4D3"><enum>(2)</enum><text>the Secretary of
			 Homeland Security in a timely manner regarding any conviction of an alien of a
			 sex offense for appropriate action under subsection (c) of this section.</text>
				</paragraph></subsection><subsection id="H4397042F10674E6EBEEB84F57FE7789C"><enum>(b)</enum><header>Authority To
			 restrict passport</header><text>The Secretary of State—</text>
				<paragraph id="H100F640F40D94A62B52538B7D953B9D"><enum>(1)</enum><text>shall refuse to
			 issue a passport to an individual if the Secretary receives a notice under
			 subsection (a) that such individual was convicted of a violation of section
			 2423 of title 18, United States Code; and</text>
				</paragraph><paragraph id="HA9B39CD3E3CB4363A4AEC7C522CB4EF4"><enum>(2)</enum><text>may revoke,
			 restrict, or limit a passport issued to an individual convicted of a violation
			 of <external-xref legal-doc="usc" parsable-cite="usc/18/2423">section 2423</external-xref> of title 18, United States Code, if the passport was used in
			 furtherance of that violation.</text>
				</paragraph></subsection><subsection id="H86B4B0F7D67443899920916EF5105B2F"><enum>(c)</enum><header>Removal of
			 aliens</header><text>The Secretary of Homeland Security shall place an alien
			 convicted of a sex offense in removal proceedings under section 240 of the
			 Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a</external-xref>).</text>
			</subsection><subsection id="H4D72A4548B1E45FB9C09404B84A75C40"><enum>(d)</enum><header>Grounds of
			 inadmissibility and removability</header>
				<paragraph id="H45696C1674C94375BFD8F1A3EC40D4C7"><enum>(1)</enum><header>In
			 general</header><text>Section 212(a)(2) of the Immigration and Nationality Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(2)</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H771BA512C7AD4784ACC5649E497794D4" style="OLC">
						<subparagraph id="H324198477A734416BEB0303E00E2AAD4"><enum>(J)</enum><header>Sexual abuse of
				a minor</header>
							<clause id="H7EEF225CEE8F46FA9DB34D6F7403C400"><enum>(i)</enum><header>In
				general</header><text>An alien who is convicted of sexual abuse of a minor is
				inadmissible.</text>
							</clause><clause id="H83A8EB5A3CF7464C825071299BDED16D"><enum>(ii)</enum><header>Sex
				offenses</header><text>For purposes of this subparagraph, an alien who has been
				convicted of a sex offense (as that term is defined in section 111 of the Adam
				Walsh Child Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/16911">42 U.S.C. 16911</external-xref>)) shall be
				considered to have been convicted of sexual abuse of a minor. An alien
				convicted of a sex offense shall be ineligible for any discretionary relief
				under this
				Act.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HDC38C5E2999944CBB45DFCC059F8107B"><enum>(2)</enum><header>Deportable
			 aliens</header><text>Section 237(a)(2)(A)(iii) of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)(A)(iii)</external-xref>) is amended by adding at the end
			 the following <quote>For purposes of this clause, an alien who has been
			 convicted of a sex offense (as that term is defined in section 111 of the Adam
			 Walsh Child Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/16911">42 U.S.C. 16911</external-xref>)) shall be
			 considered to have been convicted of sexual abuse of a minor.</quote>.</text>
				</paragraph></subsection><subsection id="H63920C2CB06F4626A6BEC9E48CDB8D88"><enum>(e)</enum><header>Definition of
			 sex offense</header><text>In this section, the term <term>sex offense</term>
			 has the meaning given that term in section 111 of the Adam Walsh Child
			 Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/16911">42 U.S.C. 16911</external-xref>).</text>
