<legis-type>A BILL</legis-type> 
<official-title>To prohibit the provision of Federal economic development assistance for any State or locality that uses the power of eminent domain power to obtain property for private commercial development or that fails to pay relocation costs to persons displaced by use of the power of eminent domain for economic development purposes.</official-title>

<section id="H9010A8F88C16445A9152A010B924DE92" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening the Ownership of Private Property Act of 2007</short-title></quote> or the <quote><short-title>STOPP Act of 2007</short-title></quote>.</text></section> 
<section id="H9EA7F9BC1EAC4981B2BF1E181D94E15"><enum>2.</enum><header>Conditions of financial assistance under Federal economic development programs</header> 
<subsection id="HA9766C28999F4B8082693E925F931D86"><enum>(a)</enum><header>Prohibition of assistance</header> 
<paragraph id="H369BE30E98794F1997C19FE3AC205477"><enum>(1)</enum><header>Prohibition</header><text>If, after the date of the enactment of this Act, an entity using the power of a State engages in any conduct described in subsection (b), no officer or employee of the Federal Government having responsibility over Federal financial assistance under any Federal economic development program shall make such assistance available to the relevant entity during the period described in paragraph (3).</text></paragraph> 
<paragraph id="H9282262074A448B0A59EA7DDF99FD064"><enum>(2)</enum><header>Entity to which assistance is prohibited</header><text>In this subsection, the term <quote>relevant entity</quote> means—</text> 
<subparagraph id="HA3BBBDC309B041F3A94BB388227982B8"><enum>(A)</enum><text>the entity engaging in the conduct described in subsection (b), if that entity is a State or a unit of general local government of a State; and</text></subparagraph> 
<subparagraph id="H21B4F684ADD1414A8D093282003EC790"><enum>(B)</enum><text>the State or unit of general local government that gave authority for the entity to engage in that conduct, in any other case.</text></subparagraph></paragraph> 
<paragraph id="HF4B62ED264BE4ACABA6CF5DFCF09F7F2"><enum>(3)</enum><header>Duration of prohibition</header><text>The period referred to in paragraph (1) is the period that begins on the date the officer or employee of the Federal Government having responsibility over Federal financial assistance under the Federal economic development program determines that the relevant entity has engaged in the conduct described in subsection (b) and ends with the earlier of—</text> 
<subparagraph id="HC0303737A8374B6888A566B95547DBF4"><enum>(A)</enum><text>the day that is two years after the date the period began; or</text></subparagraph> 
<subparagraph id="H64E7C09B76F148CA825236B9B400CC15"><enum>(B)</enum><text>the day that the property is returned to the entity from whom the property was taken.</text></subparagraph></paragraph></subsection> 
<subsection id="H8492D0ECC74A419184A938007FF53919"><enum>(b)</enum><header>Conduct resulting in prohibition of assistance</header><text>The conduct referred to in subsection (a) is the following:</text> 
<paragraph id="H6B3BC9E0E05048DDBBC04CDA53626B97"><enum>(1)</enum><header>Use of eminent domain to take private property and transfer to a private entity</header><text>Any use of the power of eminent domain to take property from a private entity and transfer the ownership of, or a leasehold interest, in the property (or a portion thereof) to another private entity, except for a transfer—</text> 
<subparagraph id="H4CCD1A4DF9354BCA942656A540EE0C9" display-inline="no-display-inline"><enum>(A)</enum><text>for use by a public utility;</text></subparagraph> 
<subparagraph id="H75D973362F66412B84C031B900187CAD"><enum>(B)</enum><text>for a road or other right of way or means, open to the public or common carriers, for transportation;</text></subparagraph> 
<subparagraph id="HB913C22F4C6F4EAA9502571FB451A47C"><enum>(C)</enum><text>for an aqueduct, pipeline, or similar use;</text></subparagraph> 
<subparagraph id="H35006FC225E54A59B3D2BCEF4242B484"><enum>(D)</enum><text>for a prison or hospital; or</text></subparagraph> 
<subparagraph id="H339954205AA14C81A65760F9F7646C70"><enum>(E)</enum><text>for any use during and in relation to a national emergency or national disaster declared by the President under other law.</text></subparagraph></paragraph> 
<paragraph id="HB0F7649D5C7044D7A3CEE677FBD4F723"><enum>(2)</enum><header>Failure to provide relocation assistance for persons displaced by use of eminent domain for economic development</header><text display-inline="yes-display-inline">Failing to provide, to any person displaced from property by the use of the power of eminent domain for any economic development purpose, relocation assistance under the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/42/4601">42 U.S.C. 4601 et seq.</external-xref>) in the same manner and to the same extent as relocation assistance would be required under such Act to be provided by a Federal agency that undertakes a program or project that results in displacement of the person.</text></paragraph></subsection></section> 
<section id="H3F77785377CF41FB87DAB2950314F192"><enum>3.</enum><header>Private right of action</header><text display-inline="no-display-inline">The owner of any real property taken by conduct resulting in the prohibition by this Act of assistance may, in a civil action, obtain injunctive and declaratory relief to require the enforcement of that prohibition.</text></section> 
<section id="H0E53D34C603C4002B648DD888399C67D"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H15817E72A0ED4F3E83DE641490A3B47D" commented="no"><enum>(1)</enum><header>Federal economic development program</header><text>The term <term>Federal economic development program</term> means any of the following programs:</text> 
<subparagraph id="H1C5DBE0EBF4846798CC6D1B5483D09D"><enum>(A)</enum><header>Department of Agriculture</header> 
<clause id="H4A83AC7C474C4393B07BAFA25BC23CAC"><enum>(i)</enum><header>Forest service</header> 
<subclause id="H29B4CF87D8AB4B8481396CAA51647E00" display-inline="no-display-inline" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">Programs under the National Forest-Dependent Rural Communities Economic Diversification Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6611">7 U.S.C. 6611 et seq.</external-xref>). </text></subclause> 
<subclause id="H4D57177690AD45F1A3106400F86BA8DB" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">The rural development through forestry program authorized by the Department of the Interior and Related Agencies Appropriations Act, 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/54">Public Law 109–54</external-xref>; 119 Stat. 538), and subsequent appropriations laws.</text></subclause></clause> 
<clause id="H77CAE34D2E6E47E88B1E26450654BFE7"><enum>(ii)</enum><header>Rural business—cooperative service</header> 
<subclause id="H3BC8F8C359B8450481FDC0CDCFC1AC36" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">The intermediary relending program under section 1323 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/7/1932">7 U.S.C. 1932</external-xref> note).</text></subclause> 
<subclause id="H900DC17EB32F4B9E8501D574D0D8B464"><enum>(II)</enum><text>The rural business opportunities grant program under section 306(a)(11) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926">7 U.S.C. 1926(a)(11)</external-xref>).</text></subclause> 
<subclause id="H0AC088CCD944460BA80479D23CF76D"><enum>(III)</enum><text>The program for assistance to cooperatives for economic development under the Act of July 2, 1926 (<external-xref legal-doc="usc" parsable-cite="usc/7/451">7 U.S.C. 451 et seq.</external-xref>) and subtitle A of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621 et seq.</external-xref>).</text></subclause> 
<subclause id="H844F87DFD96B4AA6833B9E0079E01F62"><enum>(IV)</enum><text display-inline="yes-display-inline">The rural business enterprise grants program under section 310B(c) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1932">7 U.S.C. 1932(c)</external-xref>).</text></subclause> 
<subclause id="H7AB6F66B192B4D58B3008B804D3CB542"><enum>(V)</enum><text>The rural economic development loans and grants program under title III of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/930">7 U.S.C. 930 et seq.</external-xref>).</text></subclause></clause> 
<clause id="H737BB3B041164CDDBD81DA6CAC3E25D6"><enum>(iii)</enum><header>Rural utilities service</header> 
<subclause id="HA044BAB6655D4076B6E9B3CABD5DC39"><enum>(I)</enum><text display-inline="yes-display-inline">The program for grants, direct loans, and guaranteed loans for water and waste disposal systems for rural communities under paragraphs (1) and (2) of section 306(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926">7 U.S.C. 1926(a)</external-xref>).</text></subclause> 
<subclause id="H158CEA593AF84B9B8C9F167D019D9B7D"><enum>(II)</enum><text display-inline="yes-display-inline">The Rural Utilities Service program for grants and loans to the Denali Commission under section 19(a)(2) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/918a">7 U.S.C. 918a(a)(2)</external-xref>).</text></subclause></clause> 
<clause id="HE3577ED5A31744F7007375B845DE41A6"><enum>(iv)</enum><header>Rural housing service</header> 
<subclause id="H7333DAF5C2824404BF4EB1F969BA3D6"><enum>(I)</enum><text display-inline="yes-display-inline">The rural community development initiative pursuant to the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/106/387">Public Law 106–387</external-xref>; 114 Stat. 1549A–17) and the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/97">Public Law 109–97</external-xref>; 119 Stat. 2136).</text></subclause> 
<subclause id="HB3018C352ABB4BAE9951F8DCC85E4FE0"><enum>(II)</enum><text display-inline="yes-display-inline">The program for loans and grants for essential community facilities under section 306(a)(1) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926">7 U.S.C. 1926(a)(1)</external-xref>).</text></subclause></clause> 
<clause id="H30C2EE52E58E4345996C07768E4F8FC4"><enum>(v)</enum><header>Farm service agency</header><text>The program for loans to Indian tribes and tribal corporations under the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1921">7 U.S.C. 1921 et seq.</external-xref>).</text></clause> 
<clause id="HA7B6C84B42C445128E474C8406E0E1D7"><enum>(vi)</enum><header>Rural business investment program</header><text display-inline="yes-display-inline">The rural business investment program under subtitle H of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2009cc">7 U.S.C. 2009cc et seq.</external-xref>).</text></clause></subparagraph> 
<subparagraph id="H8492A260B0F54CE1AD9167F31DED4420" commented="no"><enum>(B)</enum><header>Department of Commerce—Economic development administration</header><text>Any program for financial assistance under the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3121">42 U.S.C. 3121 et seq.</external-xref>).</text></subparagraph> 
<subparagraph id="H7955C63634FF46FFBA9587007BE3E29"><enum>(C)</enum><header>Department of housing and urban development</header> 
<clause id="H5E3F67DFFA8F4C86BEEC6D13FBAFC011" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">The community development block grant programs under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>), including the entitlement grants, small cities, special purpose and insular areas grants, States, Indian tribe grants, and loan guarantee programs.</text></clause> 
<clause id="H98FCD02D326E45ECB270FBF0365DB5C2" commented="no"><enum>(ii)</enum><text>The brownfields economic development initiative under section 108(q) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5308">42 U.S.C. 5308(q)</external-xref>).</text></clause> 
<clause id="H1D5546AE19D04449BFCD250285BCA3A4"><enum>(iii)</enum><text display-inline="yes-display-inline">The rural housing and economic development program of the Department of Housing and Urban Development pursuant to the Transportation, Treasury, Housing and Urban Development, the Judiciary, the District of Columbia, and Independent Agencies Appropriations Act, 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/115">Public Law 109–115</external-xref>; 119 Stat. 2446) and title II of the Departments of Veterans Affairs and Housing and Urban Development, and Independent Agencies Appropriations Act, 1999 (<external-xref legal-doc="public-law" parsable-cite="pl/105/276">Public Law 105–276</external-xref>; 112 Stat. 2475).</text></clause> 
<clause id="HB1A71CF1FEEB467B843B57CD5A2B2CE"><enum>(iv)</enum><text>The Indian housing block grant program under the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>).</text></clause></subparagraph> 
<subparagraph id="HA5BC95DF852E47E3B84DB94B2099378C"><enum>(D)</enum><header>Department of the Interior—Bureau of Indian Affairs</header><text>The programs for grants, loans, and loan guarantees for Indian economic development of the Office of Economic Development, Bureau of Indian Affairs of the Department of the Interior.</text></subparagraph> 
<subparagraph id="H38C631E520C24D31B9A9DAD000FE3D6F"><enum>(E)</enum><header>Department of the Treasury</header><text display-inline="yes-display-inline">The community development financial institutions fund program under subtitle A of title I of the Riegle Community Development and Regulatory Improvement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4701">12 U.S.C. 4701 et seq.</external-xref>).</text></subparagraph> 
<subparagraph id="H323F187D02554AA4AF622B8EF9E0AC00"><enum>(F)</enum><header>Appalachian regional commission</header><text>Any program for assistance for Appalachian regional development under subtitle IV of title 40, United States Code.</text></subparagraph> 
<subparagraph id="H5FB5D3A74D2B45BFB8FE0032DBBD22DE"><enum>(G)</enum><header>National credit union administration</header><text>The community development revolving loan fund program for credit unions under the Community Development Credit Union Revolving Loan Fund Transfer Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9822">42 U.S.C. 9822</external-xref> note).</text></subparagraph> 
<subparagraph id="HC90DB35FAC6D444180324BD148AC4C4"><enum>(H)</enum><header>Denali commission</header><text>The Denali Commission program under the Denali Commission Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/42/2131">42 U.S.C. 2131 et seq.</external-xref>).</text></subparagraph> 
<subparagraph id="H5D409104B4FC4B88A62645CD2BC171E7"><enum>(I)</enum><header>Delta regional authority</header><text>The program for Delta regional development under subtitle F of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2009aa">7 U.S.C. 2009aa et seq.</external-xref>).</text></subparagraph> 
<subparagraph id="H1F4868315EF1412782E3FE54EAA70418"><enum>(J)</enum><header>Department of health and human services</header><text>The discretionary award program relating to local community economic development under section 680 of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9921">42 U.S.C. 9921</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="H60CEEB97F08B42C9A5A92F8B7C457F5" commented="no"><enum>(2)</enum><header>Federal financial assistance</header><text display-inline="yes-display-inline">The term <term>Federal financial assistance</term> has the meaning given such term in section 101 of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/42/4601">42 U.S.C. 4601</external-xref>).</text></paragraph> 
<paragraph id="HE3F17CBDC34D448097D2CCB1141ED67D" commented="no"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means any of the States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, Guam, the Virgin Islands, American Samoa, and any other territory or possession of the United States.</text></paragraph></section> 
<section id="H84F719FCE52B4B8C85D7AA90F100F5C5"><enum>5.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, or the application thereof, is held invalid, the validity of the remainder of this Act and the application of such provision to other persons and circumstances shall not be affected thereby. </text></section>
