		<section id="H4A50D772C67F41AD8EB646840000A5F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Protect
			 Patients and Physicians Privacy Act</quote>.</text>
		</section><section id="HE3029A7E17F54081BA38F5ABC59B5F38"><enum>2.</enum><header>Patient right to
			 opt out of electronic health records system</header><text display-inline="no-display-inline">All individuals shall have the ability to
			 opt out of any Federally mandated, created, or funded electronic system for
			 maintaining health care information.</text>
		</section><section id="H91C2CA8337584264BC6C614E4C2D3328"><enum>3.</enum><header>Repeal of
			 standard unique health identifiers</header>
			<subsection id="HA5B1A7EAC91E408C988477EFDEE30001"><enum>(a)</enum><header>In
			 general</header>
				<paragraph id="H58ACC13703F1490DA5CE61478C5F28F9"><enum>(1)</enum><text>Section 1173 of
			 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320d-2">42 U.S.C. 1320d–2</external-xref>) is amended by striking subsection
			 (b).</text>
				</paragraph><paragraph id="H4721D8A3C7CF444493EC72D080E99D4D"><enum>(2)</enum><text>Section 1177(a) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320d-6">42 U.S.C. 1320d–6(a)</external-xref>) is amended by striking paragraph (1).</text>
				</paragraph></subsection><subsection id="HB58DCC4B5B2948F000DA136EC3468FD7"><enum>(b)</enum><header>Prohibition of
			 Federal expenditures</header><text display-inline="yes-display-inline">No
			 Federal funds shall be used to support, encourage, or otherwise promote the use
			 of standard unique health identifiers (such as those described in section
			 1173(b) of the Social Security Act, before the amendment made by subsection
			 (a)(1)) in any Federal, State, or private health care plan.</text>
			</subsection></section><section id="H6CCA52DC175F4DE4AAB1624B008400B1"><enum>4.</enum><header>Requirement of
			 informed consent for sharing information from electronic medical
			 records</header>
			<subsection id="H3B5BF215AB3F47B494F9C5D4CC00427B"><enum>(a)</enum><header>Limitation on
			 sharing information from EMRs</header>
				<paragraph id="H9E45BAA1D6F0407693509012B8A0F161"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 paragraph (2), no information from any electronic medical record maintained by
			 a health care provider and created pursuant to a Federally mandated, created,
			 or funded program may be shared with another health care provider absent a
			 signed, informed consent from the patient involved.</text>
				</paragraph><paragraph id="H092E107C569D403E85DDEF327F14AA89"><enum>(2)</enum><header>Exception for
			 emergencies</header><text>Paragraph (1) shall not apply in a medical
			 emergency.</text>
				</paragraph></subsection><subsection id="HC63B24C882F845EAB65E4711867C0068"><enum>(b)</enum><header>Limitation on
			 merger of information</header><text display-inline="yes-display-inline">No
			 health care information from an individual medical record shall be placed in a
			 Federally mandated, created, or funded electronic system of health care
			 information, absent a signed, informed consent from the patient
			 involved.</text>
			</subsection><subsection id="H2F8BF387E3F747A1A0F88280CCF35E4F"><enum>(c)</enum><header>Definitions</header><text>In
			 this subsection:</text>
				<paragraph id="HBCE1E6603EE144F496A04F78E424514E"><enum>(1)</enum><header>Informed
			 consent</header><text display-inline="yes-display-inline">The term
			 <quote>informed consent</quote> means, with respect to the sharing of
			 information concerning a patient, a written document certifying that the
			 patient gives permission to such sharing of information.</text>
				</paragraph><paragraph id="H0438608D1BF24C85AE3C26365561B5CD"><enum>(2)</enum><header>Medical
			 emergency</header><text display-inline="yes-display-inline">The term
			 <quote>medical emergency</quote> means any situation where the failure to
			 provide immediate medical treatment or assistance could result in serious
			 injury, loss of life, or both.</text>
				</paragraph></subsection></section><section id="H6474093BD3C24E668D45FAD148159F2"><enum>5.</enum><header>Provider freedom
			 from required participation in an electronic health care records
			 program</header>
			<subsection id="H1C845C29DB20471BBC60721B1524E951"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Federal
			 Government may not require a health care provider to participate in any
			 Federally mandated, created, or funded electronic system of maintaining health
			 care information.</text>
			</subsection><subsection id="H5555C549B8DF43D995F5E7DA38CB6D6E"><enum>(b)</enum><header>Limitation</header><text>No
			 health care provider shall be denied participation in, or otherwise sanctioned
			 with respect to participation in, a Federal health care program because the
			 provider refuses to participate in a Federally mandated, created, or funded
			 electronic system of maintaining health care information.</text>
